  1. Yes, it was recommended that I enter on HLR. Maybe it is my ignorance for not insisting on Supplemental. I was informed that as long as all new and pertinent evidence in for my claim before the informal conference, that it would be considered. I was waiting on a couple of additional IMO's and had them within 2 weeks of opting in. My VSO is not authorized to represent me in this so he is in contact with another organization that is representing me. They also said I would be able to insert new and material as long as it was in before informal conference. I believe I will call my rep and see about supplemental although I think it is too late. Also my opt in was in play before new regulations (which are only proposed) and will let it be know in my conference if necessary. Who knows maybe I will get one of the 5% that are decent and read the evidence that proves I had these atrocious things in service.
  2. Perhaps I come off as a bit rude. My apologies I understand what you are saying with regards to the completion date. I hope that they one day get their act together as well.
  3. I opted into RAMP on June 12th and just now jumped from claim received to review(stage3).
  4. Thank you; my veterans superintendent for county I live in is going to investigate for me. I may see if I can change to supplemental; just costs you the breath to ask. He recommended HLR with the informal conference. I had plenty of 5 star evidence I gathered since my initial denial before I opted in. According to the letter for RAMP I received you can't submit new evidence after you opt in. I will read Comer vs Peake this evening. I should have just insisted on supplemental to ensure all evidence is considered. I might be overthinking this.
  5. So according to part 7 bullet 2 the VA will not even consider the additional evidence I submitted for my appeal. They will also take the defective C&P exam I had for migraines where the doc didn't take my SMR in to account. Am I correct in assuming this. I was told by my Veterans county superintendent and representative that the evidence accumulated for appeal and after while waiting 30 months would by reviewed in the HLR. I just couldn't submit anymore evidence after it was submitted.
  6. Don't know if anyone cares but, My RAMP estimated completion date went from December 4th, December 13th to January 8th now down to November 17th after moving to phase 3 which is review and evidence gathering. I check 2-3 times a week. Just an update to compare with my fellow vets.
  7. My VSO seemed to think I'd get new exams ordered. That being said I have 3 IMO each now for all 3 of my issues plus lay evidence. The caluza elements are proved. The FAULTY C&P exam and the gentlemen who performed my 90 second exit exam have both been discredited by a specialist. I did do all my stuff earlier and have my act together.

  9. Well put sir; I opted in 74 days ago with an estimated date of completion of Dec. 13th which is well over 125 days. Nonetheless that is a lot less days than 1273. Good luck!
  10. I am at day 64 with my estimated completion date moved from Dec. 4th to Dec. 13th. I am not near as far as you though. Good Luck my fellow Veteran.

  13. When writing a PTSD statement in form 21-078 and then adding 8.5X11 paper, would it be wise to just do a separate letter for each stressor/incident or should I make it all one letter? I personally think separate would be better but the VA might not think so.

  15. I'll keep that in mind. Thanks Could I have demanded another C&P right away for this guy not taking my SMR into consideration. It was in April of 2015 and I put in a NOD and just went into RAMP 47 days ago.

  17. I agree 100%. In April of 2015 I had a C&P exam(rescheduled 3 times) with a regular family practice doctor. Nice as heck, said he agreed with everything in my records. He did not take my SMR in to account. He stated that there were not any complaints of migraines in service(less likely than not) and it is in my SMR in black and white. Every time I brought up my SMR and time in service he would cut me off. I don't think it would be proper to post his name here. Anyhow I got a IMO from a board certified neurologist and 4 buddy letters plus 3 letters from people in the civilian world that attest to my affliction to show continuity/symptomology since service. A great paper trail of medical records as well. WE will see what happens. I have put it in God's hands.
  18. Don't know if you care but I got in RAMP on June 12 2018. I have an estimated completion day of Dec. 4th 2018. No movement on mine whatsoever as of yet. I'll keep people posted if they want to know.
  19. Yes I have heard that the BVA is extremely back logged so makes good sense. My rep has informed me that I can still go to the BVA in case I am denied again which is very possible just seeing the statistics. off topic a bit here but a friend of mine's father in law has a purple heart and bronze star from service in Vietnam and was denied for PTST. I'll bet the VA rep who performed the C&P gets a hefty bonus. Too bad you can't go directly after the C&P examiners(legally) who belittle you and basically say you are a liar when their report comes out. Defamation of Character is what the VA does to deserving Veterans.
  20. I don't know if anyone cares but I opted into RAMP on June 12th and just hit day 45 and just checking today I discovered it hasn't moved; still at the receiving stage. Don't know if anyone has had similar situations or not. Has there been any updated statistics on Supplemental and Higher level claims in RAMP that have been awarded and denied. Last good update I read was May 25th from CCK law.
  21. Good morning; I have been blessed to have had physicians fill out DBQ's both family practice, specialist and a psyc doctor. In my humble opinion, during my initial claim I feel that the VA just put them in a pile to collect dust without any care.
  22. Would the same be true for a Higher Level Review Officer in the RAMP? I'm told they are more senior than the DRO's.
  23. Thank you, these are records from military facilities that I thought may have been put on microfiche. Unfortunately this will be on me. I keep excellent records but relied on the medical facility to keep these medical records so I will have to go another route.
  24. I don't know the circumstances of your case but I wish you the best of luck in future endeavors with it.
  25. Does anyone know how to retrieve a copy of dependent's medical records? I have checked my last 2 duty stations for a possible copy. These are needed for a VA claim of mine. We used to have them and should have made copies before giving them to our civilian medical practice. It's amazing that civilian hospitals are allowed to delete medical records greater than 10 years old. Should be a law against this. JMO.
