  1. congratulations! we will keep our fingers crossed for you. I looked on e-benefits today and my appeal status isn't listed. Glad you got into it yesterday, maintenance until monday now....
  2. Got the queen sized sleep number today. Looks small compared to my old king size. It is adjustable on each side but both sides go up or down, not by theirself. Also got the new desktop yesterday to replace this old one. Don't have it hooked up yet-----Just not ready to tackle it in this frame of mind yet.
  3. everything has been returned to Muskogee. So I am waiting to hear when date for DRO review is going to be. I did request in writing. Thanks Carlie for all your help.
  4. 2 additional IMO's from my private pcp and my back surgeon. Both stating unable to do sedentary type work.
  5. There was no record in the evidence section on decision mailed to me, nor is there any record when I looked in e-benefits section of evidence. Also sending two new IMO's from two different MD's showing not able to do any physical or sedentary. The more I read from Hadit the better my replies to VA have become. At least in my opinion; so THANKS to all on this site.
  6. My new counselor that I have had for a couple of months sent me a letter that last councilor was susposed to send in Nov of 2011. I think the RO didn't see it either or he would not have denied my claim for IU. But again maybe he ignored it. Anyway here is the contents, "after carefully reviewing the evidence, I have determined that it is not reasonable to expect you to be able to train for or get a suitable job at this time." "In reaching my decision, I considered the following evidence: Your disabilities are so severe that training and subsequent employment in the future does not appear to be a reasonable expectation." I have been approved for a new computor and a lift up chair already. Waiting for bathroom remodel and new garage doors with opener and sleep number bed. ThaNKS TO NEW COUNSELOR. aLREADY FILED A NOD FOR THE DENIAL OF TDIU.
  7. Just received copies of SMR that was requested 2years ago and I guess that open claim kept them from sending them out. Already had up to 2001 and now have up to date.in march2012. I was awarded ssdi in 2004 for COPD and secondary diagnosis of osterorthrosis and ALLIED DISORDERS. So now I am trying to decipher those records to find out what to do with CAD, HTN, Pain Right Hip and Low back area.. Got 40% for the low back from VA, but no one seems to know what is wrong with right hip pain down to scrotum is caused from.

  10. Need help to see what else I can do.....Here is what the c&p examiner wrote::::::::::::This veteran meets criteria for major depressive disorder. It is associated with marked interpersonal dysfunction. He does not socialize with anyone, including family members and evens includes his grandchildren. He screams at his wife frequently. This type of interpersonal problem would make it very difficult for him to function in most jobs, and it would impact his ability to perform sedentary activities of employment. Having said that the veteran himself will note that he is not working at this time primarily because of physical disabilities. He is in extreme pain from DJD of lumbar spine, and this would impair his ability to perform physical work..He is not able to stand for very long or sit for very long and this may disrupt his ability to perform sedentary activities actives of employment. VA's denial report..............Your claim for IU was denied because the evidence does not show you are unable to secure or follow a substantially gainful occupation as a result of service connected disabilities. Note....Although your mental health examiner indicated you may have difficulty in the work place due to some of your mental health symptoms, you stated you are not working at the present time because of physical disabilities, which WOULD NOT preclude SEDENTARY types of employment... Service connected 40% for IVDS of lumbar back, major depressive disorder due to back pain is 50% and 10% for bladder dysfunction. I have already filed my NOD.
  11. STOP at the point of pain when getting a c&p exam. My C&P examiner helped me get to 50 degrees after I had stopped around 30 degrees. Still took a reduction from 40% down to 20%. I had my physical therapist measure to 30degrees and on next c&p I STOPPED at 30 degree. Got my 20% back for Range of motion to 30 degree. First C & p examiner that got me reduced also helped me to be able to twist sideways, he applied good pressure, but never once asked me to remove the back brace I had on. He also forgot to mention the cane I was using that had been prescribe by my VA pcp but the rater took his word as gospil.
  12. I had a c&p exam in sept 2010.. Examiner said i could bent to 50degrees. Same examiner had in his report I had 47 days of doctor prescribed bedrest. One private physician and one VA pcp. What does VA do,,,,,,reduce me from 40% to 20% effective on date of exam. Got my 40% back on range of motion from another c&P examiner on March 8 this year. I have already filed another NOD. and asked for DRO review.
  13. Thanks Carlie that would be about 600 miles from Okla to sioux falls, only 55 to ro at Muskogee. Maybe they will pay milage.
  14. Got my denial in mail for TDIU and ED. Want to ask for the dro review, but notified that regional office of jurisiction changed from Muskogee, Okla to Sioux Falls. Would I have to travel to sioux falls for the hearing?
  15. Back problems (ivds) was restored to 40%. BIG question now is what does Regulatory or Procedural review mean, I guess for rest of claims filed..Went from 60% back to 70% after two years of waiting. Also changed from the Muskogee , Okla RO to Sioux Falls RO of jurisduction. Maybe should have filed in E-Benefit question which is where I find this action with notification IN THE MAIL.
  16. Hi all....Gives me hope.....Contract consulant was here the 22nd. She was going to recommend....1. New bed 2. new walk in shower. 3 Stool riser...4. computer ( Desk top)...Garage doors (old ones wood and I can't lift because of back ddd....6 A chair that lifts you up and throws you to the floor...Just kidding on last part..
  17. My pcp put in my request at Muskogee, on sept. 13/2011.. Had hearing test on 2/16/12 and return visit for the hearing aids is 4/09/2012. Left is is completely gone so they are getting an amplifier for the left ear and a tube behind the neck to channel it to the right is which has mild-moderate loss in it.What excuse can I use for the wife then....
  18. No diagnosis of this . First I have heard about it doing my research now. Yes have type 2 but no medicine taken. Lost 42 # when doc advised of diabetes. Blood sugar has been running less than 100 for last 2 years. Appeal yes but I haven't gotten the decision yet just the c&p in October. Now have 20 months + since filed. Thank you Sharon
  19. This one shot me out of the saddle.......results from c&p......Less likely than not that ED was caused by citalopram. Rational: There is a diagnosis of erictle dysfunction and is most likely caused by microvascular disease and exacerbated by Citalopram, because 60 packs a year of smoking history likely caused microvasacular which is a known cause of erectile dysfunction.
  20. I sent mine to Regional Office by certified-return receipt at USPS. Use address provided on their correspondence. I had an appointment set up by voc-rehab in about 2 weeks.
  21. says in e-benefits that (in developement phase). I did ask about cue on the reduction because of no 60 day notice. I mis-stated, should have said no final action taken on reconsideration decision before the 1 year time limit.. Yes sent in additional doctors reports and also pointed out that they had reports from 2 doctors of which 1 was VA service provider that showed over 6 weeks of bed rest due to those epidural shots. This was completely ignored in this decision. Oct 12, 2010 decision says monthly entitlement for 70% (50% + 40%) effective May 1, 2010 and reduced on sept 15, 2010 to 60% which knocked me out of consideration for IU.
  22. I filed a reconsideration request in Oct 2010. Should have filed a NOD because no action taking on reconsideration. Have had 6 C & P exams with only 2 concerning IVDS lower back and major depression which were both in Jan 2011. Then came more for heart, breathing and chest x-rays in May and June. IRIS kept saying decision was ready to be made but had to file the Nod when another C & P in mid October could not be completed by my 1 year time frame to file the NOD. Now e-benefits say new claim re-opened. So be sure and think about Reconsideration filing. My VSO advised to file the reconsideration and I did. They reduced my 40% for lumbar ivds to 20% and made it effective on day of c & p in sept of 2010, No notice just reduced my pension and then I didn't have the 70% necessary for IU which they denied on those grounds. Had 50% for the major depression. So my wait will continue for a while longer.
  23. I got my reply from Health and Human Services. They can take no action because the QTC didn't receive any payment from Medicare. Like Carlie said it would create more headaches if filing FTCA or 1151. So no path left but civil action against the Doctor. I don't plan any more actions at this time. Thanks all for the replies.
  24. I have been in contact with the Oklahoma Board of Medical examiners, and we know what they did, NOTHING. I don't hold out much hope but not ready to completely let it go either. Thanks everyone for these replies. Hope is what keeps us going so I will haang in there. Still haven't heard back from the civil right violation people yet.
