I am a 80% TDIU veteran, I have been fighting for 3 years to get T&P and I got a letter from DAV saying that I have been approved back in August 08. I have called and track the file down to my regional office at St Petersburg, Fl and they said the file have been approved and is being written. "Back log of files" My wife is back in school full time and need medical care in which Champ-VA would take care of that need. And yes, we can use the money for being in college under CH35. I will be back dated until 2004. How can I get them to expedite the process so I can get benefits and Champ-VA for my family. I have went back to DAV and they cannot do nothing, Call 1-800 number. Just sit on my hands and wait.

Folks I would like to give you all some advice. I am currently awaiting an IU decision. I have been dealing with VA for 22 years. I have never dealt with the appeal process so I cannot commit on this.

1) VA and SSI have one thing in common. They look for reasons to deny your claim. If some clerk or doctor does night not write your diagnoses correct or a legal beagle interpretation is wrong you will be denied or delayed.

2) Never deal with the government without a lawyer or VSO. Your chances of approval are cut in half before you start.

3) The Government will lose your paperwork. Always keep a copy for yourself. Always get a receipt from your VSO or lawyer. they will lose paperwork too!

4) Nothing is quick with the government. You could be living on the streets and hungry makes NO difference. There are plenty of people that pass away before there claim is approved. You will need to depend on charities, churches and welfare if necessary.

5) When budgets are tight in any organization weather it is government or business. You may not get what you deserve. A lower rating or a denial could be the result of their budget. That is why appeal process is in place. Use it or lose it.

6) Take every thing you hear with a grain of salt. This includes your lawyer or VSO. You could be told by your VSO that you will have a decision in 2 weeks. He could be telling you this just to get you off the phone. The government is cut to the bone and working with a half of their staff. These people are over worked and under paid. Everyone that comes for help has a sob story. These people do not have the time to hear yours.

7) According to where you live. Expect up to 1 ½ years for your initial claim, two years for an appeal. If you are denied again, you might have to file a new claim and start over.

8) Do not give up! You may have to get new evidence, doctors or reps. the team you are working with may not be as good as another team will be. If your sick keep trying, you will get it. If you are a con artist, get out of line and go to church. You are hurting the truly injured and disabled.

I am not trying to be negative in this advice but if you go into this expecting the worst and hoping for the best, you will survive the process and keep your sanity.

Something don't jive here. Either the the DAV is incorrect or the R/O is super slow at the financial figuration stage. Usually, once the R/O makes a decision the rest is a cake-walk so it seems to me that the DAV has some issues here.

You write...I got a a letter from DAV saying I had been approved in Aug 08...yet nothing from the VA? No notification, no statement of the case, no award letter? Something sounds fishy here. The phone center tell you it's there, where?? Back log of files is bull! There has always been a back log, and probably always be.

No more time for excuses. I would get my congressman involved. You have been waiting all this time, get him/her involved. Is your congress person on the vets committee? Waiting hasn't been working, action needs to be addressed now.

Good luck and make sure you ALWAYS keep copies of everything sent/received.

Hidden to most in every VA Hospital is someone who is a liaison between the client and ChampVA. I recommend that you go to your VA with your medical information and award info and ask the information desk where the ChampVA person is or you can call the 800 number on any of your med bottles and punch 0 and ask operator to connect you to the ChampVA.

      Service Connection

      Frost v. Shulkin (2017)

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
