Just Returned From My C & P Exams

Question

i just returned from 3 c&p exams today.

i am besides myself.

please people dont critisize me for the way i type this post???

im trying to unwind and catch my breath and find some help from seasoned vets with this experience.

the dr who conducted my exam for my ptsd claim was sooo condescending,rude,very impolite and very uncaring or thorough.

i brought my wife with me and he said she was not allowed in the exam????

i asked once again once we got into his room as to why she cant be in w/me and he said because this is what i said is going to be done and thats it???

i have terrible anxiety and memory problems so i needed her to analyize and help me during and after the exam???? about what happened??

he vigoursly interrogated me for about a half hour and it was over.

he did not even touch on any of the problems i face or effects it has on my life.

he asked me more about my child hood, arrest records, drinking problems???

of which i dont have any???

i hope there is a way to justify my claim in another way???

i dont know what all the acronyms mean nod or dro hearing?

i guess ill be reading up on all of this while i wait on the decision to come back??

all 3 exams went almost exactly the same,except the drs were nicer then the phsyc???

i felt like i was on the stand being cross examined by the prosecutor for a capital murder trial???

i was so thrown off, i dont even remember what he asked?? what i said???

i just was sooo uncomfortable and feel violated???

there is no need to conduct an exam like this.

i have severe anxiety issues as it is just going out in public anymore.

let alone have this guy be this way?????

i left the appointment and went outside and literaly cried to my wife that i cant believe it went like that??

ill await the decisions and then i guess go from there.

i guess i should have expected this. from reading so many posts i should have been prepared for a fight till the end.

i already fought in a war??thats whats made me like this.

i didnt think id be home fighting again against my own govt.?

i am so angered that this is how vets are treated after returning or serving our nation.

i thought i truly knew about it from hearing news stories about other veterans, war veterans (vietnam vets) what they were being treated like.

and how they were and are still treated today.

but i truly apologize from the bottom of my heart.

me and millions of other americans dont truly know what vets go through.

its a crime that should be punishable by laws!!!

now that i got just a little taste of what goes on.

i just knew in my heart though that someone could examin me for an hour and just know from what i told them how bad i am actually feeling.

but was i ever wrong.

any body have anything to say???

they have let my wife into every C&P exam I have ever had except for PTSD they have banned her both times the first time I got 50% and on appeal I got 100% P&T so don't let it depress you the bastards never let you see what they are really thinking don't get upset until you get the enevelope and it took me about 3 months after the C&P I have a BVA hearing on Feb 4 and I am what into my 7th year just don't GIVE UP thats when they win

100% SC P&T PTSD 100% CAD 10% Hypertension and A&A = SMC L, SSD
a disabled American veteran certified lol

i'm so sorry you had to go through this. you are right...you should not have been treated like this. please know that you are not alone. take some time to settle down and perhaps do something good for yourself...do you have a hobby? or have a comfort food you like?

take a few days before you start thinking appeals and nod's and all that crap.

take good care...

You'll be fine. Don't sweat it. Maybe be a bit more forceful on the wife thing next time, though. My C&P doc said my wife couldn't come in to my MH C&P. When I stood I told her to come on. He said "I just said she can't come back." I said "I don't f******g care what you said." That was the end of the discussion, and he was nice and polite to both of us, and wrote a very favorable report. It was the rater who screwed me in my claim. I only got rated for 30% when the language was in the C&P for a 70% rating.

i want to thank everyone for there kind words of encouragement.

im not trying to jump the gun before i even get my results back.

but i was truly not prepared for the treatment i recieved. or lack thereof.

it just doesnt even feel the slightest bit positive in my favor by his actions.

one of the ?'s he asked towards the end was do i ever think of killing anyone??

i wanted to so bad say yeah at this moment in time "YOU".

but wasnt sure if i wanted to stay the night or who knows how long in a padded cell!! lol

im glad i didnt say anything because i was telling one of the other drs i had an appt with, how rude and ignorant the dr was.

and he told me how they have had death threats in their office.so they take that kind of stuff very seriously.

im with you rentalguy.i went with it at first.the whole no wife thing.

and then after he started interogating me i forcefully asked him why my wife couldnt come in.

as ive heard numerous vets say they had there wifes in with them??

and i just kept remembering that people on here told me to not freak out on the dr as it would not help my claim???

it took every ounce of strength in my body to not go off the deep end rip his F$@#&*^ head off.

It sounds like the PTSD examiner was probably more concerned about filling out a VARO required form, than helping you deal with your PTSD at the time, TANKERJOE.

I remember in 2008 when rentalguy 1 responded to a vet that had the same experience as you,...[[ "Sorry for your experience, but don't judge the whole system based on one incident. We can all have a bad day, so maybe give her ( the C&P doc ) the benefit of the doubt. I have seen some really great C&P docs, as well as regular VA docs. I have also seen some really bad ones, too. You'll know exactly what the doc had to say when you pick up your C&P results in a few weeks."]]

Until then I think purple is right on target... take a little R&R for a while. Try to have a good weekend with the family.

i would never give this doctor the benefit of the doubt. :)

im a pretty good judge of character.

and this guy is no good.

im wondering how long do i wait??? and how do i get a copy of my exams??

i live in jacksonville florida.and go to a va clinic here.

the c&p exams and any specialist visits are in gainesville or lake city.

will i be able to go to release of info. here in jax and get a copy????

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
