Question

This story was sent to me by another woman veteran....disturbs me greatly that a woman, with that much "power" in the Pentagon would say something like this, and it was obviously covered up, well not anymore! I've also passed this along to Jim Strickland and asked him to make it public in his special way!!

Time to send Ms Whitely some correspondence, don't you think?..........

The Pentagon is launching a sex assault prevention camapign which advises soldies to "ask her when she's sober."

WASHINGTON - It didn't get the attention of President Obama's recent Special Olympics. gaffe, but a "wait until she's sober" crack by the military's top sex crimes watchdog was more offensive, one New York lawmaker says.

"This woman is not in the right line of work," Rep. Louise Slaughter (D-Rochester) said of the statement last week by Dr. Kaye Whitley, director of the Pentagon's Sexual Assault Prevention and Response Office.

Whitley's bizarre quote came as she released the military's annual report on sex assault, which showed a 25% increase in combat zones, including 22 cases in Afghanistan and 143 in Iraq.

In pitching "bystander intervention" to curb attacks and harassment, Whitley gave this example: "If you see one of your buddies serve drinks to somebody to get them drunk, maybe what you do is step in and say 'Why don't you wait until she's sober?'"

Slaughter was aghast. "I was really shocked anyone would say a thing like that," she said.

In effect, Whitley was telling the troops to "go after her when she's sober - that says she's fair game," added Slaughter, who sponsored the legislation that required the military to report annually on sex assaults and its efforts to curb them.

In a written response to The News, Whitley said Slaughter did not "hear the statement in the context of the overall prevention strategy of the Department."

The statement came from a poster in a military marketing campaign called "Our Strength is for Defending" that is aimed at prevention, Whitley said.

The poster reads: "My Strength is for Defending, so when I saw that she was drunk, I told him, 'Ask her when she's sober.' Preventing sexual assault is part of my duty."

Whitley's annual report showed that the number of sex assaults in the 1.4 million-member active-duty military increased 8% to 2,908 in the year ending in September 2008.

Whitley noted that only about 20% of the attacks are reported because of "the fear and stigma associated with the crime."

Just 38% of the cases that were reported eventually were referred to a court martial, she said.

"This is one of the problems," said Rachel Natelson, a lawyer at the Veterans and Servicemembers Project of the Urban Justice Center in Manhattan. "It's a lack of consequences. People think they can act with impunity."

i for one think american women are the greatest and most beautiful women in the world!

i was raised to treat women with respect . i admire the american women who fought to vote and be counted.

american women fought for this country ,cared for the wounded the soldiers in every war we have fought.

you can spot an american woman whether she be chinese american, african american ,hispanic,there is something about her that seperates her from all the rest.

Who cares what mean people think. I've lived for

30 years traumatized and stigmatized and grieving. I'm glad for you.

You did your homework, dealt with the VA system efficiently and got your benefits

within a reasonable of time. I could never wish the drawn out struggle

for benefits on anyone especially PTSD sufferers.

What some don't realize is no amount of money or free medical care can change sexual trauma or

make it easier to live with. I've had immeasurable losses in my life from one trauma.

Rape during intoxication. I lost so much. So, when I think about 'Just Ask Her When She's Sober'

it feels more like men are being warned. I like the accompanying sentiments of watch your friend's

back and defend, but JAHWSS is a slap in women's faces.

California calls it 'Wasted Sex' which is a campaign targeting young adults. There's an epidemic of rape

during intoxication there. Anyway, in California you could be charged with a felony and go to jail for 3-5 years

if charged with having sex with someone who is intoxicated. http://www.wastedsex.com

Two police officers have been assigned to desk duty while prosecutors and the police investigate a complaint that at least one of them raped an intoxicated woman after they escorted her into her apartment in the East Village three months ago, the police said on Sunday.

Footage from a nearby bar’s video surveillance camera shows the two officers helping the woman into her building on Dec. 7 and returning twice during the next two hours, according to the bar owner, who provided the video to investigators.

Rape, Intoxication and Consent

In two cases decided last Friday, the Supreme Judicial Court clarified requirements for proof in rape cases in which lack of consent due to intoxication is an issue.

In Comm. v. Blache, the court ruled that jury instructions should clearly explain the following two requirements:

1. that the intoxication rendered the complainant incapable of consent. Jury instructions must make clear that "for the Commonwealth to meet its burden of proof on the complainant's nonconsent by establishing that she was incapable of consenting, the Commonwealth must show not simply that she lacked sobriety or was intoxicated, but that as a result of the alcohol and drugs she consumed, the complainant's physical or mental condition was so impaired that she could not consent."

2. that the defendant "knew or reasonably should have known that the complainant's condition rendered her incapable of consenting." This second element is a new requirement, and the court ruled that "we will not give the new rule retroactive effect, but apply it solely to trials occurring after the issuance of the rescript in this case."

Prevent Rape

* Face the facts: If she's wasted, intoxicated, asleep, or unconscious, she cannot give legal consent, even if she said "yes"

* Face the law: Rape by intoxication is a serious felony that can carry 8 years in state prison

* Drink responsibly - binge drinking is dangerous to your health, and can impair your judgment

* If your friend tries to take advantage of a woman who is too intoxicated or passed out, tell him to stop and explain that it’s illegal and not right

* Pay attention to the warning signs including slurred speech and vomiting

Protect Yourself

* Stay with your trusted friends at all times

* Have a safety plan for you and each member of your group to get home

* Drink responsibly - binge drinking is dangerous to your health, and can impair your judgment

* Decide ahead of time how much you can safely drink while maintaining your good judgment. Stick to that limit.

* Don't accept a drink that is open, as you risk ingesting a date rape drug

* Never leave an intoxicated friend unattended, and make sure that you can count on the same for you. Help your friend by giving her water to prevent dehydration, and putting her on her side to avoid choking on vomit. If symptoms worsen, call 911 as she could have alcohol poisoning

* Always lock your doors and windows, and if you are looking after a friend, make sure that doors and windows are locked before you leave

Thanks Pete. I was actually speechless when I saw that. I couldn't reply with what I wanted to without probably getting thrown off of Hadit. I hope to never see that person on here again.

I don't ban people on Hadit but I am pretty sure you will get your wish. The minute I saw the post I unapproved it and made it invisible as I think it was necessary for all the mods and Tbird to see it. I also PMed the cretin and informed him that he had messed up big time. Just closing the thread would have left it up so that was not a solution that I thought would help.

Once again I want you to know that that kind of behavior is not going to be tolerated. If you had responded all that I would probably do is disapprove your post and ask you not to respond to such a blatant misogynist.

Pete 53 made a statement why don't more people (I suppose I refer to men as I am one) do more courting instead of walking up to a woman & asking for sex or raping them.......Rape is not a sexual experience for the raptist but instead a power trip

Getting to know a woman & a few dates is not that difficult....But, for someone to rape another is despicable....Said person in my opinion is a bit sick or has a hatred for women so he must dominate then.....But, if a man & woman are sitting together at a bar drinking who's to say they don't already have some sort of relationship & to expect someone to go over to the man & say "Wait till she's sober" might be an invitation to a punch in the mouth

On the other hand if U notice said woman is not having a pleasant time & is attempting to leave & being restrained I feel this would be the proper time to do this...Remember not all men are Raptists & not all rapists are in the Military.

I hope that everyone knows this is just my opinion & anyone can do what they want in defense of the fair sex

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
