Hello All Hope All Is Well.

If this doesn't pop your bubble I don't know what will.

Some of you are aware of my situation and the East Orange VA Medical Center.In my attempts to resolve falsified documentation and progress notes.

After contacting nearly every Various Agency regarding these concerns,only to be redirected back to this Facility to Include especially SECRETARY SHINSEKIS OFFICE and his wonderful,courtesy,professional STAFF whom never responded to my letter to date.A secretary placed a call to OIG, who called me on Friday and accused me of bodily harm to the director of this facility imagine that.Now mind you I have bad legs spinal injury and 50 years old and high school was over 35 years ago.The arrogance of this guy who spoke to me was like a street punk no professionalism at all,I did explain to him that I will never NEVER return to this Facility in this life time.And I asked him for his supervisors name and number and i will be contacting him on the behavior of this representative of Office of Inspector General.

Needless to say i called today to speak to the Secretary Shinsekis Secretary to explain what has transpired on Friday,Only to be scolded by this individual and threatened me with law enforcement action.Sure as the sun will rise OIG was at my door giving me a WARNING not ot contact any Various Agency till further notice.

AND YET I WHOM SERVED BACK IN THE SEEVENTIES THE ARROGANCE OF THIS WASHINGTON DC PEN PUSHER SHOULD BE SO ASHAMED OF HERSELF TO BE A REPRESENTATIVE WHOM ARE SUPPOSED TO BE IN PLACE TO ASSIST VETERANS WITH ISSUES.

At this point these individuals whom live off the TAX PAYERS should go and pick up a weapon and serve before they know what the heck they are involved with half of these pen pushers are not veterans.

All I can say Is I am ashamed to be an AMERICAN CITIZEN AND A VETERAN WHOM SERVED PROUDLY TO be BELITTLED BY THESE ASSHOLES.

SHAME ON YOU ERIC SHINSEKI AND YOUR ILLICIT STAFF.Take responsibility for your endeavors

That is messed up I also use the east orange facillity, I was just there for a C&P, And from what i can take there is no professional attitude there, During my C&P the doctor was asking my questions and no of it made any sense then i realized he did not have my file he had someone else's medical history. And then complained to me that there work load it to much, And could of cared less that i was there for a C&P.. I hate going there

Hello All Hope All Is Well.

The reason I have posted this is I find that the more you attempt to gain or search for resolve with the (VA) various Agencies the more they either dismiss,ignore my favorite (Redirect) your concerns as one of you have said in the past WELCOME TO THE HAMSTER WHEEL. LOL

And yet when you have been transparent and compliant not only with documentation,as well your commitment to obtain resolve they always manage to find a way to weasel out of it or take responsibility for there ways of ERRORS.

It is also very CLEAR that there is no culpability or accountability by anyone and yet these are REPRESENTATIVES OF THE PEOPLE? REALLY I DON'T THINK SO THEY ALL HAVE THERE OWN AGENDA. NO CUSTOMER SERVICE.

I find that if you do find an individual who will commit to assist you with your claim or concerns they are now an outcast of the (VA) Various Agency reason they helped the enemy as the way I see these folks look at all Veterans.

If this were not true no one would need an Attorney or POA to search for resolve.

AS FAR AS IAM CONCERNED SECRETARY SHINSEKI HIS STAFF AND ALL VARIOUS AGENCIES CAN KISS MY ASS!!! PICK UP A WEAPON A GO FIGHT THE GOOD FIGHT YOURSELVES.

Berta is right. Get a lawyer to see if the VA can bar you from contact. Don't threaten or abuse the VA. Get the legal eagle to do your work for you. If you ever plan on using the VA again it would be worth it. Just remember anything you say to the VA can and will be used against you.

I would kindly suggest that you really DO need the help of the VA, just by reading your posts.

It would be good if you got help.

      Frost v. Shulkin (2017)

This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
