Question

If I get SS Disability will it at all help with my increase in disability?

I have read some comments on here but nothing specific meaning whether to send the ss disab approval to VA to help my case.

I can add more info regarding disability if necessary.

thanks,

Aquabear.

If you get SSDI based solely on a service connected disability.

Note that both VA and SSA are animat about their individual and separate disability systems and will tell you one has no bearing on the other.

SSDI uses this: The disability must keep you from working for a period of 1 year or result in death.

The VA disability is the percentage of lost earnings capacity your disability has cost you.

Hope this helps.

J

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Well I don't know the answer but I am basically doing the same thing. I was just awarded 100% P/T + housebound by the VA and filed for SSDI just last month. I have not heard anything from SS yet and did not send my approval letter to SS.

Don't ask me why cause I just am not sure. I would expect that SS can look at my medical conditions and come up with the same conclusion if not it will be interesting what they say.

Please let us know how it goes and I will do the same.

If it was me I would get a letter from a doctor who will say exactly what Jbasser said about you being disabled for at least one year. That is the format they like to see. I did that and got my SSD in about 4 months. They will also send you a form to fill out that has a self-inventory about what you can and can't do. If you are wise you will say you need help wiping your @#$. You can't drive. You can't prepare food. You need help doing basic chores of life. SSD wants you really disabled. Generally speaking, getting IU or 100% from the VA is a much lower standard than the SSD. The VA is just so much more messed up than SSD. With SSD you should get an answer back in a few months Yea or Nay. Your SSD file does not look like your C-file with moths flying out of it. The SSD expects you will hire a lawyer if you are denied.

Holee moly I got approved for SSD, got letter yesterday. I am so relieved that I can get help with our (wife and I) finances. Happy I got it but yet sad that at 39 years old/young I am on ssd. Thru VA Voc RehabI am going to college but I barely am able to do that.

Doing research, I can't find it but thought I read that if your approved for Social security disability for the condition of your VA disability that VA Disability is supposed to go up or you can get umm a temporary 100% disability rating? is that correct??

Also, I remember reading that there is a ummm hardship thing to push the 100% disability faster? Correct??

I will post my win on the win forum, my wife and I are so happy we have this. A win can take so long with the VA and it's the most stressful thing to deal with them and your disability at the same time.

Thanks for your help everyone.

Sorry about the double post.

Rephrase the question: How can the SS Disab decision be used to help increase in a current VA disability? If I have a current rating for my lumber and left hip (right hip is waiting for rating). The SS decision was granted due "severe impairments: degenerative and lumbar discs.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
