Confusing Decision

Hi all:

I just received a letter from my service officer about the decision on my claim for SMC Housebound.

I work my claims myself but I submit them through a service officer whose office is in my RO.

I have not yet received the official decision from the VA, but I thought that I would throw this out to you all to see what you think.

I was 70% PTSD TDIU T&P when I filed for SMC Housebound last August.

"A combined evaluation of 100% has been assigned as a result of the following actions:

1. Evaluation of PTSD with Panic Disorder with Agoraphobia and Depressive Disorder which is currently 70% disabling is increased to 100%, effective August 1, 2010.

2. Entitlement to Special Monthly Compensation based on the need for aid and assistance or being housebound due to service connected disability is denied."

I will know more when I can read the VA's reason and basis, but for now I can't figure out how they can deny Housebound but approve Panic Disorder with Agoraphobia.

Even though I don't log in, I do read HADIT and learn from you all every day for the past 8 years.

Your response to my situation will be greatly appreciated.

P.S.: If it were not for the posts from Berta and Flip, I would still be on the streets (or worse).

Hi Mike - nice to se ya back but sorry it's under those circumstances. Hope life is being good to ya! They do it because they can. Sorry but that's about it. What you'll probably need to do is get an IMO showing how you are HB and/or need A&A. I've been battling that one, myself, for yrs. Do you have other SC disabilities that could qualify you for SMC "s" via the 100+60 route?? I ask because they used the word "combined."

Hi Mike. It looks like they slipped the issue by increasing you to 100 percent schedular.

Agoraphobia alone should make you entitled to SMC S. You need to NOD this one and have it re considered. You may even have to get it out of the RO and to the BVA. You ahould also get an IMO that states you are housebound by reason of your condition.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

That's the way I've been thinking, PR & John.

I will post Reason and Basis when i get it.

Maybe others can benefit from my situation like I have learned and benefited by theirs.

About the IMO:

Not sure that I need it.

I've got 4 years worth of Progress Notes from 3 VA Docs who I have been seeing on a regular basis.

They all have been making notes that I am and have been housebound for at least 4 years.

They don't use the word "housebound" all of the time, but they do describe it very accurately.

I actually like my VA docs because they call it like they see it without making me feel bad about my problems out in public.

An IMO might be difficult for a doc who does not know me or does not know veterans.

Any thoughts?

P.S.: I only filed for Housebound because of the 2009 decision of Bradley v Peake.

The last thing that I wanted as another C&P. But, the ptsd and the housebound have made me a prisoner in my own home.

Good Mike. I am baffled as to why they denied the SMC.

Agoraphobia is probably more common in veterans than we know.

I hope they fully considered the Progress notes but it sounds like they didnt.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
