That is just absolutely amazing. I saw a news story where these universities are now suing people for not paying their student loans years later and putting leins on their houses and property.

I am happy for you.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

GREAT!!!!!!!!!!!!! My husband had a very small student loan balance - less then 700 bucks and when he had a 1151 stroke, NYSHED called here relentlessly for payment when he could no long go to Voc Rehab or work

He wanted me to send them the money but someone told me,that if he makes one payment while disabled, they will pressure him definitely for the full balance. There calls were constant. No caller ID in those days.

We found a Student loan form waiver at the local law library. Limited internet ion those days too. You would think those NYS Higher ED clowns would have sent him one,knowing he had become completely disabled.

His VA PCP doc filled it out and signed it right away for him.Bingo NO more calls and he got letter about the balance being waived.

This was in early 1990s.

I found a copy of the same waiver the VA doctor signed a few months months ago in my C file.

VA had awarded me only 6 months retro for his Section 1151 stroke in 2012 in the award letter for his AO IHD and the SMC CUE I filed, indicating he was not totally and permanent disabled after the 6 months time frame of the retro.

Not my butt. I found very significant medical evidence and information (that VA already had but ignored in this 2012 award) that he was in fact P & T from the 1151 CVA for 2 years. VA owes me some more cash.

My point is that the Student Loan waiver signed by a VA doctor says he was P & T disabled due to the 1151 CVA . Thus they waived the balance.

We CANNOT overlook or misplace important stuff like student loan waivers signed by a doctor, as they might be needed down the road to support a finding of Total and Permanent Disability.

Rafebanks, did VA give you the P & T designation too?

Yes, it is ridicilious. Even tho its the law that they discharge these loans for disabled Vets, they try to "weasel" out of it. It took 3 tries for me to get my student loan discharged.

First, they did not like the form I used, whining that it was a Phd and not an MD. Then, when I got the MD's signature, they said his form was incomplete.

I finally sent them the VA letter and got it done. It took months and months, and my credit report still shows "past due" while they were "processing" my student loan forgiveness paperwork. I have contacted them, and they wont budge taking those errors off my credit report.

Even if you declare bankrupcy you will not get out of student loans. 100% vets are about the only ones who can get out of it except maybe those on SSD. I owed the VA $250 for G.I. Bill back in the 70's and they hounded me for that money for years. I appealed because they overpaid me and I was broke except for 28 bucks a month I got for 10% disablity.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
