Help With Content For A Letter In Support Of Fibromyalgia Claim

Question

I am looking for advice.

I need to write a letter for support of my claim of Fibromyalgia. I have a diagnoses from the Rheumatologist that states I have Fibromyalgia and my C&P was clear I have a severe case of Fibromyalgia. But it also said "not connected to Active Duty Service by review of service records".

So I think they are going to screw me.

What content should I include in the letter to support the claim related to the Gulf War/SWA.

I am already 50% connected with PTSD that validates I was in the Gulf War.

There is a lot of stuff about presumptive illnesses diagnosed and undiagnosed.

So Please provide guidance on the content and format that I should put in this letter so I don't screw myself with my own wording.

Thanks Pete and Berta,

I read the e-CFR, it seems they write this referencing back and fourth to confuse you and to be able to use it against you.

After reading it I got angry. It seems the Nurse Practitioner also read it. I looked back at the C&P and it actually reads as follows.

1. Diagnosis

Does the Veteran now have or has he/she ever been diagnosed with fibromyalgia?

x Yes

ICD code: 729.1 (was not incurred during active military service per Medical Record Review).

This is the exact verbiage used by the CFR stating Compensation "shall not" be paid for a chronic disability:

(7)(I) If there is affirmative evidence that the disability (was not incurred during active military service).

I think they are trained on what to write so the review board can deny any compensation.

Man this really drains me. I shouldn't have waited so long to file any claims. It's just for the last several years I've been too unstable to make sense of anything or make rational decisions.

Thanks Pete, being new to this claim stuff drives me crazy.

How does this affect the 70% you already had BlastDaddy?

Or maybe you didn't have 70 and have it now......due to the recent award.

If so are you unemployed, and if that is the case, did they send you a TDIU form?

Thank you for previous advice.

I haven't been on the site in a while and seen this and decided to update the condition. I was awarded 40% and that is included in my 70% combined rating.

I have two claims in right now! The first is prep for decision and the other is for IBS it is under Gathering Evidence.

The one in prep for decision is looking to be 20% from what I've seen. I had a great C&P and the doctor provided a nexus connecting my injury directly to service. Even wrote it on the C&P.

The one for IBS was started by the VA on my behalf as a fully developed claim. Funny huh. I guess after being seen by the GASTROENTEROLOGY department and they seen how bad my IBS was they prescribe pull ups and ordered the C&P.

I am in preparation to file for Migraines and Headaches. I have been treated for these for years but never claimed them.

I was seen by a specialist in Neurology due to having seizures. He also has been trying to find the cause of the Migraines.

The head of the department of Neurology has taken my case and has had an MRI and EEG done. He has annotated in my records that the seizures occur when I have hallucinations. (a condition from my PTSD) and believes the seizures are Traumatic Seizures.

Also I have been diagnosed with CFS by the Rheumatologist. The VA wanted to use pool therapy but it was denied due to IBS and seizures. So they had me go to physical therapy in hopes of relieving some of the pain and constant fatigue. After a couple months with no success physical therapy was canceled. It was added in my records that my recovery time from the therapy was increasing and the only part of the therapy that was helping was the heated pads.

I will finish preparing my paperwork for CFS and also submit a claim for it as well.

I currently have an appeal in for my PTSD and GERD.

The PTSD I was awarded 50%, but the award should have been higher. The VSO had me file a NOD because the C&P clearly showed 70%-100% because of the two suicide attempts. (Which I no longer desire to kill myself, but find each day a challenge)

The GERD was denied so I simply went to a specialist and he provided a nexus showing the combination of medications the VA provided was the cause of my GERD.

As far as TDUI I have not received anything from the VA for it. They have it throughout my records I am unemployed due to my conditions. But I am not sure if I would qualify. I am kept on the records of a company I receive profit share dividends that are paid out weekly to me.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
