request the 100%schedule Rating From combined IU Rating?

 Calling All Hands on Deck,

Anyone know what the VA Form # is to request the 100% scheduler rating be given & the IU to be moot?

As I understand  when a veteran is rated for combined IU/with P&T and no future exams schedule and his S.C. Disability is of nature not expected to improve in his life time.

The Criteria is,a when veteran has a combined scheduler IU Rating & the veteran has another separate rating of 70% or higher   he can request the 100% scheduler rating....the R.O, is supposed to do this at the time of the separate rating but the fail to do this and the Veteran don't know he can request the IU to be MOOT and given a 100% schedule rating.

This would change things for the veteran  if he was/is able to do some kind of work he could add to his family's income.  & Not be worried about for getting to send in the aggravating 21-4140-1  Every freaking Year.

Anyone know the FORM#?  or more information on this?

Just to update this thread- if you are 100% P/T then your family is eligible for DEA and ChampVA. I guess I don't understand the issue, but I am 100% P/T and my son is currently receiving DEA, and my kids receive prescriptions (and tonsillectomies) under ChampVA.

Buck, you can be 100% scheduler and IU for rating purposes.  That is my current condition.  As 100% P&T and IU I must fill out the form every year.  When I asked why I am still required to fill out the form it was stated that my SMC is based on IU even though I am 100% scheduler.

so in all your basiclly still IU with SMC House Bound....getting SMC Don't increase your rating but it increases your compensation payment in addition to what your already being paid for the IU   WHICH IS A 100% PAY SCALE.

I was on IU due to two conditions and it was decided that one of these conditions was serious enough to make me IU.  With my rating for neuropathy and that IU rating I was granted SMC.  The neuropathy rating then bumped my to 100% scheduler P&T.  I do not have a 100% scheduler rating and then another 60% rating.  I still have to fill out the IU forms every year to keep my SMC.  If I go back to work I lose my SMC.  I cannot so that is mute.

Speaking of the 21-4140, I called the VA last week concerning the so-called "requirement" to fill out the form stating your employment status when you have IU. I asked them specifically what VA regulation covers the form, and why the requirement isn't in writing when the veteran receives IU?

I was put on hold for a LONG time, and once  I finally got an answer, it was vague, and STUPID as well. In other words, no straight answer.

Does anyone have the specific regulation about the 21-4140? If so, please post it.
