TDIU taken away because of long term disability insurance.

Question

My brother  was 90% and awarded 100% IU P&T two years ago. He was awarded SSDI about a year and half ago. From the day he stopped working he was put on long term disability insurance an entitlement he receives because he paid many years for in case he would not be able to work or if he was hurt on the job.

He received notice they was taking his IU because he was over the threshold for taxable income.  I  was not aware long term disability insurance could be included in the income threshold. It is taxable income but it is not a working income. He is too broke to work. He just recovered from another knee surgery. 

Is their anyone who can assist with this.

Now it makes sense.  Two computers collided.

Basically, SSI says he had income, and he stated he did not on the form.  Which are both correct.

The VA probably should have another question regards that type of income on the form.

Now we are way above my pay grade.

I guess I would have him call Peggy and ask what to do...

I agree with you John999, what I don't understand is how can they take away veterans IU just because he has the long term disability insurance? thats not an income that's protection?

I mean we got to have something going for us...not so much  extra-income be peace of mind

We set aside a little each month out of my VA Comp and have been for the last 12 /15 years  this is my 17th year on TDIU P&T and 4 years with 2 SMC's. we are trying to save  so when if I make it to the 20 year mark we always wanted to  go to Rome and see some of the Biblical sights over there.

  We been to Athens Greece to the Pathathon  <ms....its a weary feeling  to be inside that and touch those large pillows, it sits high on a Hill as this was their fortress to over look the enemy.  I find all this educational and Interesting that things that truly happen back in the historical Years of long ago.

Rocky01, you need to write up a letter explaining the income is from LTD and that you are not working and take it to a VSO ASAP. If you only filled out the 4140 with no explanation of the income, they will reduce your IU. Thank you for your service!!

No I don't think they can take it away for the reason you stated above Long term disability insurance should not be counted as Income. IF HE HAD THAT BEFORE GETTING THE IU? 

Because he is Rated Total Permanent  OR P&T by the VA, His SSD Also should not be counted as an income.

However because this L.T.D.I. is consider a Taxable income that is above the minimum income threshold And is reported to the IRS that may be what breaks the camel Back my friend?

Also if he has over a certain amount of savings in a savings account this too is reported to the IRS as taxable income. (jmo)

His TDIU P&T is not Temporary.

I agree with Buck.  Veterans compensation is "not" needs based.  Senator McCain got VA compensation as have other high profile people.  Can you scan the letter that says his compensation (TDIU) is being removed due to long term disability insurance??

Unfortunately there are two types of Long term disability insurance.  Pre tax and after tax.  If you are working and read this make sure that you get the after tax insurance.  Pre tax LTD is taxable where after tax LTD is not taxable.  It looks like he may lose this one.  When I applied for TDIU they attempted to say my LTD plan superseded my rights to TDIU but mine is not taxable.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
