When Is A Claim A Claim
Most vets would say that a claim is a claim when the VA says it is a claim or when the vet thinks there is a claim. And we talk here on this board and in the VA waiting rooms about claims being decided. Just my thoughts: The claim is a claim when the vets service records show the disability or injury or illness occured. So,,,excuse me,,,where is there a decision to be made? The only decision to be made is the extent of the disability (percentage wise). A lot of things would, IMHO, go faster, and easier if (and jump me if you want,,,,but this MUST be said.) folks without legitimate claims filing in the first place... hypertension Ihd/secondary Conditions
Army said I had allergies(Hay fever), now have asthma, can this be a claim? Had a claim but didn't pursue it but was not diagnosed until after got DMII. Also have PN, Hypertension high cholostorol and triglycrides would this be considered a contributing factor to IHD?

tdiu Unsigned Medical Report
Hi all, As you know my husband's friend was denied TDIU, cervical myelopathy and low back condition which was secondary to his right knee injury. I posted here several days ago under TDIU Denied if you care to get a background of TDIU. However, in VA's decision they used a Doctor's Progressive Notes which was never signed by a doctor nor states doctor's name on note to deny him service condition on a secondary basis. The note states in part: ".......These records document your reports as to the circumstances of your fall, to include stepping from your car and missing a step and falling, falling while making a delivery on the job, and falling after getting out of you…

If I Have A Recon At The Rating Board And Then I File A Nod, Will It Delay The Recon?
I have a RECONSIDERATION that is at the Rating Board for Lumbar Condition with Radiculopathy. I just filed a NOD on Monday for a Rating Increase for Degenerative Joint Disease, Right Ankle. Will the NOD affect, slow down, pause, etc. my RECONSIDERATION that is currently at the Rating Board?

Need The Legal Beagles
Question is, if a medical report is not signed by the doctor or shown in CAPRI, will it still be weighed as evidence in adjudication of the claim. Payment Error?
I had heart bypass surgery on 2 Jul 09; I filed a new claim which was rec'd by the VA on 3 Aug 09. The ratings schedule says that veterans received 3 months of temporary 100% after heart bypass surgery. I received my decision letter the other day and they granted temporary 100% with an effective date of 1 Sep 09, ending 1 Nov 09. That's only 2 months. The check I received today confirmed that fact. August is missing. Should I file a NOD to tell them I disagree or can an obvious error like this be solved over the phone or through IRIS? Thanks, A.H.86

Opinions Please
Under 38 USC 5108 a veteran can submit new and material evidence to reopen a previously denied claim. My husband's file had a 1966 decision granting a 10% rating, a 1967 decision stating the disability was still 10% disabling, and a 1971 denial of an increased rating. V.A. didn't have a duty to assist until 1972. I recently got my husband to remember the name of the hospital that he received fee basis treatment at in 1966. I'm wondering if he couldn't try those 1966 hospital records and then reopen the 1971 denial using those 1966 fee basis treatment records. Does anyone have any thoughts on this? VA Electronic Information/Research Systems I have been doing some reading about various information systems used by the VA, which include the following: - Automated Medical Information Exchange (AMIE) - Compensation and Pension Record Interchange (CAPRI) - Veterans Examination Information Request System (VERIS) I found this article about CAPRI, but it indicates it is only for VSO's and people within the VA network.
