ptsd Question On Inferred Claims
Does the statute on inferred claims (5.8.2) apply just to claims for increase of ratings for disabilities? Or, does it also apply to claims that were previously denied, but then new and material evidence became available through a VA C & P exam for another psych condition (organic mental syndrome, a physical disability) that also indicated PTSD? The GAF was 55, and the examiner gave the veteran copies of literature dealing with coping with PTSD. Yet, the examiner did not formally diagnose PTSD because the exam was not ordered to evaluate PTSD? thanks!

C&p Exam For Pulmonary Fibrosis
This is along the line of someone's previous post "Does The Va Have A Duty To Order C&p Exam". I had requested copies of a claim and denial for pulmonary fibrosis that I filed in 2000. Before I knew it the VA establish a claim for pulmonary fibrosis. I asked if I would be sent for a C&P for the pulmonary fibrosis. The VA said that if one was needed that then I would have a C&P exam for pulmonary fibrosis. Well the VA denied the pulmonary fibrosis claim based on evidence from the 2000 claim. Anyone have any input on whether the VA can denied a claim based on evidence more than 10 years old? 68mustang

Chronic Pain And Ruined Life
After years of dealing with chronic back pain I finally broke. A while back I developed pan colitis. I blame that on all the meds I take. The colitis knocked the wind out of me. Mentally I have fallen apart. I started drinking to relieve the pain. I know this was wrong now and I am truly sorry for it. The drinking got out of control. It all came to a crashing halt. Vet Needs Help With Bva Case
Hi all, For the past 3 days I have been looking through BVA cases for a higher rating of 40% for a sc knee injury. The Vet that I am helping has 60% rating for his sc knee injury and was fitted for a hinged knee brace by VA, that he wears for stabillity, etc. The VA is saying that his hinged brace is not required and he does not have nonunion and loose motion. The decision to deny him 40% states that: "A higher evaluation of 40 percent is not warranted unless a brace is required because of nonunion and loose motion. diabetes Imo
I am thinking about getting some IMO's to help SC some illnesses, and I was wondering what sort of DOC I should get the medical opinion from. Diabetes? Prostate? Eye Problems? Optomotrist? COPD? Do I just get a regular primary care type doc or should I see specialists? If I should see specialists what type? If I see a primary care doc does it have to be an "MD" or can it be a "DO". Va Math - Determining Your Rating
I was recently moved from 60% to 90% SC disabled. I asked the rater how they determine this when I have 7 disablities with the following ratings. 50% 30% 30% 20% 20% 10% 10% looks like is should be 170% to me! well he explained that the VA does not simply add them together and get a number. it is basically 50% of 100, and then 30% of whats left, and then 30% of whats left after that, and so on down the line. They start with 100 points and subtract the 50% from that (50 points)... then they take the 50 points and subtract 30% (15 points), then they take the 35 and subtract the 30% (10.5 points)........ After retirement I was denied for a condition of numbness/tingling down my right leg to my right foot. Navy's Knowledge About Asbestos Exposure Harmful Effects
I thought you all might be interested in this info that I found on the internet it refers to recently declassified documents that the Navy knew in the 1930's and 1940's about the dangers of asbestos and allowed its continued use in combat shipbuilding. The info is from 1983 when the Manville Company filed suit against the government because many former shipyard workers were filing suits against Manville. The Manville Company contended the government should foot part of the monetary judgments because the government knew about the dangers of asbestos exposure yet required by law that asbestos be used in shipbuilding. Wording For Imo
My doctor said she can not say that my mental health condition was caused by service, because anyone can come down with it. So how do i word it, in the imo that it is more likely that not, or is due, to military service. Should i just say it is more likely than not that he contracted this disease during military service, He 100% without a any doubt that he contracted this during service. ptsd Iraq Veteran
During my visit to the dentist yesterday I noticed a picture of a soldier on the wall. It was the son of the dental assistant. I asked her what his MOS was. She did not know what that meant, then I said what was his occupation in the Army. Infantry. I asked her if he served overseas. That's when she opened up. He served 8 months in Iraq as an Infantry soldier. Came home for a two week leave and went Awol for 30 days. We all know that's a bad decision.
