I filed a claim for my back condition not understanding that I needed to file for all my injuries. I received 20% rating for my back codition. my MRI at the time stated that I have a herniation disc L4-L5. The award I received was for a Lumbar Strain. My latest (Aug. 8 2009) states that I have a Disc Bulge. When I filed a claim for my neck and shoulders the va stateded that it was residule to my lumbar strain. C&p - "mere Speculation"
If any of the experts would be so kind as to comment on this, I would really appreciate hearing what impact this exam could have on my claim. Does it seem that this examiner who is a GP is simply deferring to the opinion supplied by my neurologist? How much of an impact might this exam have on my claim for service connection? Despite the C&P examiner telling me there was no doubt as to onset in service, here is how her opinion is worded: PERTINENT EVIDENCE: Note from Dr. _____, specialist, stating it is his opinion that the initial headaches in services were the onsetting symptoms of MS. He said that patient was recommended for discharge due to the headaches,…

ptsd Nod Appeal
:) I Was going trough all the paperwork I have since I filed my NOD last oct. I noticed that on one of the letters my VSO sended to Va, he Requested a traditional appeal proces to take place. Back then I didn't know a thing about the Va appeal process. Now that I know a little bit thanks to hadit, I ask myself and you guys, why my VSO didn't ask for an DRO review first?, and, if that failed, then go to BVA. I'm really mad cuz of this and will talk to my VSO about this next week. Also, I call IRIS and they told me the appeal is already on it's way to the BVA. I have a 2nd NOD for PTSD, that one with DRO review requested and I'm thinking to have another VSO handle that NOD…
