Hep.c Treatment Complications
Ok i am sc for bipolar disorder and have been suicidal ,been recently hospitalized. I also hep. c positive. In the past i discussed getting the inteferon treatment,but after talking to the doctors they decided i was not a candidate for treatment due to my mental status,as the treatment has severe side effects mentally. I put a claim in for hep. c and on my decision they said the docs said i was not a candidate for treatment ,leaving out the fact that it was due to my mental illness,wonder why? ptsd Specific Rating Formula For Ptsd - Does It Exist?
I question if diagnosed PTSD (9411) or PTSD (mst) are being properly acknowledged, treated and rated for VA disability. Is there a specific rating formula for PTSD? PTSD with MST? or is PTSD simply 'covered up' or 'combined' within Mental Health Ratings? For instance I am diagnosed for Depression and PTSD with MST, so I think at minimum I should have two seperate codes. I don't - yet . From what I've found there seems to be ONE General Rating Formula for Mental Disorders in CFR 38-4 and all codes are rated under code 9440 Chronic Adjustment Disorder. (*exception Bullimia) Is there a different way that PTSD is or should be rated soley for itself? Should I have a …

tdiu Question On Tdiu W/ P&t And 100% Schedular
Hello. Have not been on here in a while. But, After several years, I finally got my new rating. As of now, I am 80% schedular, granted the 100% rate due to TDIU, and considered Permanent and Total which makes my dependents eligible for the education assistance and ChampVA med insurance. This is all based off of several condition including postop back, postop knee, sleep apnea, and a few other small ones. Effective date on all this goes back to when I had my back surgery in 2007. However, for some reason, they did not give me a c&p for my claim of major depressive disorder secondary to my back, and for my claim of radioculpathy secondary to my back. Both of…

Does diabetes and sciatica have anything in common? Is it rateable by the va as being an aggravating factor of diabetes. It incapicates me at times and really interfers with my quality of life. Any help will be appreciated.

Ro Called Today
Hey guys, RO lady just called with alot of questions about my claim, says she's just confirming? Asking about how meds were affecting him, and why we said that evidence suggests that more than likely too much meds could cause him problems later on. Why is she doing that? Asked her to send a letter about our discussion. She agreed. Was she asking was this information an additional claim? She didn't say and heck I was too shook up to ask. Gave a number to call. I Had To Tell You About My Ro
Just when I thought I had gained a little confidence in my VA, I get a letter from them telling me that they have no record of my late husband being married at the time of his death....let alone married to me! This pertains to my request for month of death payment on his disability compensation from January 2004....~ So of course I put together a packet that has our marriage license; his death certificate which lists me as his wife; a copy of the letter they sent to me, and I restrained myself from including a copy of my BVA win for my widows pension. Strange Happenings
First let me state for the record that I have a strong suspicion that VARO monitors the posts here on hadit. Recently I posted on hadit that I had discovered that VARO had received additional service records in 1966 and placed those records in my husband's claims folder 2 days after his 1966 V.A. rating examination. Within 4 days after my post on hadit my husband received a letter from VARO stating that they were unable to locate a 1966 letter notifying him of the decision. I now know enough about the presumption of regularity not to argue on appeal that he wasn't notified of the 1966 decision. Instead I sent a letter recently to VARO Oakland asking that VARO prepare …

Independent Living Program...help!
Hi Hadit members, I am trying to help my husband get ILP to help with making life a bit easier for him..... ie. runner boards on our vehicle to help him get in , shower modifications, ramp at teh front and back doors, adjustable base for our bed etc. But he went through the ILP years ago and they gave him a computer. So now we have to re-open his ILP file. Has anyone else done this???? What is involved?? We have a meeting on Monday with a Voc Rehab Counselor. To have her evaluate him for reconsideration..... The Voc Rehab COunselor said "We don't do hobbies anymore." Does anyone know the specific regs about hobby supplies? Have these changed recently? …

Could someone put up a link to the Federal Circuit case in AG v. James Peake ? The full title to this case is 2007-7217 AG v. James Peake decided by the Federal Circuit on August 15, 2008. I think this case should be added to hadit's entry page. The court decided in this case that 38 CFR 3.309 ( b ) has retroactive effect. This case concerns the issue of notice to the veteran. The veteran had sent VARO a letter in 1985 asking about an earlier 1983 decision denying his claim and VARO provided a response letter about how to reopen the claim that the court didn't like which failed to notify the veteran of his right to appeal.
