Claim Evidence Interests
a. looking at my last decision NOD/DRO the evidence only lists three items. It referred to orginal claim and two other peices of information I submitted. By the grace of God the claim was decided correctly. Like I can return to the first claim submitted and see exactly what was submitted and what they considered? hmm...not telepathic here. Caution for people like me who occasionally 'assume' that the VA does use all VA available records - they don't. Or at least it didn't show on the 'evidence'. Reading Through The Decision, Etc
Okay. So my DH got his big white envelope. Here's the background of his disability: He was in an jeep accident back in the military, severely burned, especially his arms, shoulder, and head (both his ears were burned off and most of the back of his scalp - they did reconstructive surgery and did a decent job, but the scars are still very noticible. His shoulder joint was partially burned away, and he very narrowly missed having both hands amputated. He spent a year in the Burn Center at BAMC. tdiu Can Someone Help Me?
Hello Fellow Vets, I was reading another post and it was stated that if you are 70% TDIU, you should get the same benefits as being 100% P&T. When I was awarded 70& TDIU, I wasn't told that I would be eligible for ChampVA or education benefits for my spouse? As a matter of fact, I was told that I would be re-evaluated in April 2010....So, I'm a little confused.. Can someone explain.. Thanks, Cherie33

hypertension Doc Lied On My Husband's C&p
So my husband is applying for an upgrade in his disability, to allow the 100 +60 rule for SMC. He had to do a C&P for Diabetes II and hearing loss with tinnitus. So the C&P just got released and I was looking through it. I was horrified to say the least. It states that medical records were reviewed, but C-file review not required by VARO. Medical History: Cardiac History: No history of Myocardial Infarction; Hypertensive heart disease; Angina; Dizziness; Dyspnea;Congestive Heart failure; Valvular Heart Disease;Heart Rhythm disturbance; other heart disease. ptsd Records At National Archives
Hey Hadit people! :) I just wanted to remind everyone requesting records from the national archives of something my husband just discovered. Asking for a copy of all records they have is not sufficient. You will not get all records. Ratings Board
I just spoke with the VA and was told my appeal was sent to the ratings board but was returned back to open status due to the need of more infomation. When They say it is being sent to the ratings board does that mean a decision has been made and the rating board will assign a percentage or does it mean the ratings board has to make a decision of denial or approval? Weird... Sudden Money, But Feel Anxious Instead Of Happy
Checked the bank account today to discover a deposit of a fat deposit from the VA in my DH's account. He's 50% and filed for an increase back in July. I tried to call him, call the VSO, but no one available. I could just wait and see what comes in the mail, but I hate seeing mysterious deposits. He has spouse + one in-school child. The retro would go back to July, right? So if that means July should be included, and March should be included, that would be 9 months?

My Claim At Legal
Spoke to the AMC rep who told me that my file was at General Counsel. So I thought why not see if I can get a hold of someone in GC. I did. That person was the GC, he took my information and promised to help me. He called me back in 10 minutes. He said that file was sent back to the AMC Friday and that they just had not logged it in yet there. The "Executive Review" had nothing to do with the claim or quality of work. They merely wanted it so they could reference it for 4 months in filing the brief against me at the CAVC. tdiu New Information
I received a sorta SSOC from the BVA. In it they declared that TDIU was not considered because TDIU has already been assigned. The problem is: The Board was discussing an assignment of TDIU that was dated in 2002 compared to the instant claim dated 1993. TDIU is not being considered for the 1993 award because it was assigned in 2002. This mailing was for information only and not an assignment of benefits. Does that make sense to anyone? sledge
