C&p/imo Written Or Verbal Requests For Copies?
C&P/IMO Written or Verbal requests for results? There was some discussion earlier on whether a request for a C&P/IMO needs to be in writing. I came across this in my C-file after a copy of a favorable C&P I requested went missing. Neither a verbal request or written request was honored by the VARO. I found a copy of it hidden in a packet marked,"For Administration Purposes Only" stuck between my medical records nearly two yrs later. Every time I went to the doctor there it was, but I never knew it until I asked to look through my records at the records dept one day. You can see by the comment the RO made they showed the C&P opinion never made…

Va Class Action Suit
Hi to everyone, I'm a newbie so if i'm in the wrong forum I'm sorry. I have a question about a suit that was filed. I can't find out the status of the suit other than one letter I got from: VA Settlement Claims PO Box 6727 Portland, OR 97228-6727 Here's the back story: I'm a "Life Member" of the DAV and they publish a magazine of current events. I believe it was the June 2009 edition that contained an article about the theft of a computer from a VA employee that had personal information about vets in it. It said that the "United States District Court for the District of Columbia" had begun notifying vets that a settlement had been reached with the Dept. of Vete…

Question About Claim Being Sent To Authorization
I am probably going to ask a moronic question here, but I am new to this. In response to an IRIS I got this: The information you were told on the phone today is correct. We show that a decision has been made on your claim. Once your claim is authorized we will send you a notification letter explaining the decisions made and the action being taken once it has been finalized. Unfortunately, we are unable to give you a timeline on how long it will take for your claim to be authorized. I was told at the 800# that if the claim was sent to authorization that meant it had been approved and they had to authorize the payment. I was told if it had been denied then it would not…

2009-7024 Eugene Charles V. Eric Shinseki
This is an interesting case that seems to fit my husband's situation. It seems to state that a claim which has new and material evidence in support of it cannot be deemed abandoned when an earlier claim is still pending. When VARO receives new and material evidence in support of it VARO is supposed to prepare a supplemental statement of case.

Nexus/imo Question
Regarding my lower back claim, I understand that a nexus/IMO from a neurologist or sports/rehab medicine doc is really desired. However, would a well worded nexus/IMO statement from a doctor certified in internal medicine, with 25+ yrs experience, be a good idea or should I keep saving my hard earned cash for the neuro/rehab doc? Thanks

Shredding Veterans Documents Continues At Roanoke
Once again Veterans documents were in the shredder bin at Roanoke. This is AFTER fast letter 08-41 expired so that Veteran victims have no recourse against the VA. No "special handling" will be allowed as this Veteran's documents were shredded outside of the Apr 07-Oct 08 limiting dates the fast letter specifies. The VAOIG did not even put this incident in the highlights of the report, but rather buried it in the body where it would not be noticed except by those who read the whole report. Obviously, whether or not Veterans claims are shredded is not important enough to include it in the highlights of the inspection, and the VAOIG made no references that anything w…

ptsd Still Time To Add Info To My Claim?
I had my C & P for the part of my claim but no exam for my PTSD (my Vet Rep added PTSD to my claim for feet, etc). The Vet Rep had me sign the "no further info to be submitted" response a while ago, but... I've had an MRI since then on my knee, which had been dx'd with DJD. The MRI revealed CMP as well. I'm thinking that since CMP is known to be caused sometimes by overuse (from favoring other limb) it might help my case. Also, in the notes from my last visit with my psychiatrist he put my GAF at 40. I'm also going to see my VA PCP next week and will ask her to PLEASE put more info into my records - she's been saying a lot more than she's been writing, from…

Does The Va Keep An Electronic Record Of Decision?
I received a copy of my C file from the RO recently. I thought it was odd the box was only 3 inches thick, when my box, which is incomplete, contains a stack of at least 12 inches of records. The RO has shredded (or they are missing) more than 1000 pages, about 70% of my files. Since there are multiple RO decisions missing from my files, multiple VCAA letters, multiple NOD's etc, does the RO keep an electronic record of the RO decisions, or do they even know about them? I know they keep an e-record of the percentages, but do they keep an e record of the "reasons and basis" for denials? For about 3 years, I noticed that whenever I filed a NOD, they dont respond to it,…

Claim Status @varo(oakland) - Rep Has Very Little Info?
Hi gang, After thorough research work and preparation, I finally hand carried & resubmitted my OSA claim as 'Case Re-open' file last month @Oakland VARO. On the way home from business trip, I dropped by the VARO to inquire about my claim status. > According to the rep, he looked at my file before being called in. I was not satisfied(still w/ smiling face) leaving the place as the rep just said my claim was sent to Phoenix VARO for further processing. That's fine with me as long as it doesn't get shredded or returned safely to Oakland in one piece! > What bothered me is that he said he does not have indepth access to the status of my claim. He was mumbling…
