Denial Of Treatment
This is rather a long story, but hopefully I can keep it brief, but may omit a few important details in the process. I would like some suggestions on how to proceed with this because I am lost at this point. In 1999, my husband had reconstructive surgery on his left shoulder at the VA hospital. Claim was lost and wasn't pursued at the time. In 2004, he refiled and was given service connection 10%. He is a paramedic. His job is to treat and LIFT patients. His shoulder has acted up since the surgery. In July, he left work early (first time ever) because the pain in his left shoulder became so severe he couldn't do his job. Saw primary at VA. Ortho referral. Saw…

ptsd Peridoic Limb Movement Disorder/sleep Apnea
I have been diagnosed with Periodic Limb Movement Disorder (PLMD) and Sleep Apnea by a civilian doctor. I use a CPAP machine nightly. I am currently S/C for PTSD at 30%. I asked civilian doctor if it was possible that my Sleep Apnea could be related (a secondary condition) to my PTSD, and if so, would he state that in my medical records. What my civilian doctor did was to write To Whom It May Concern Letter for me. The letter said "This is to confirm the Mr..........has a diagnoses of obstructive sleep apnea, periodic limb movement disorder (PLMD), anxiety, and PTSD. It is my impression that his sleep apnea, PLMD, and PTSD/ Anxiety Disorder are all service related. If…

Writ Of Mandamus
BroncoVet, You wrote about a writ of mandamus in another thread. Please start a new thread (or reply to this one) and keep us posted on this topic. If you have already done so, please direct me to it so I can mark it to follow the thread. -- by BroncoVet Dec 11, 2007 on the C-file, disorganized and in a state of disarray thread -- "Yes, I also got my C file recently. Lo and behold, right in it is a NOD that I filed back in 2004. The VARO has ignored the NOD since 2004, and I checked with an IRIS inquiry..no appeal pending. I filed a writ of mandamus asking the court they take action on it, as my pleas with the VARO have, again, fallen on deaf ears. So far, the ju…

diabetes Med Ops
They just got my stuff and said No problem at all in getting another IMO to support my other IMOs- I thought they were getting me a an Oral Pathologist IMO based on my evidence but they said an Internist can tie it all in together better to the AO diabetes so I said that would be swell. They have been doing some IMos for vets represented by the VVA out of Des Moines. It is so nice to talk to someone who understands my claim and gets it all- right away-it took Med Ops mere minutes to comprehend my claim and the evidence and yet it has been at VARO for almost 5 years-and they have not even read the evidence yet. The RO told me it appears to have gone to a differen…

ptsd Time Line?
I have a C&P scheduled for 12th of Dec 2007 for the medical increase for my service connected disability. I also filed for PTSD and my question is, how long is the wait usually between the two C&P's? and if I 'm found to be TDIU with my SC disability alone will I still have to wait for C&P for PTSD or will VA render help if I'm found totally disabled from my SC injuries? Thanks for your help...Rich

"clear And Unmistakeable Evidence "
Hi to all, I am back at it again. Gosh, I never thought that I would have to prove that I was sane before service. I have to go back to the years before 1964 and most of you weren't born then. I spoke to David Barrans, Attorney, Office of General Counsel concerning this regulation. VA’s regulation implementing the presumption of sound condition, 38 CFR 3.304( I am not putting those little faces in this. It is susposed to be a (B) This is what he said to me, " Everyone is considered to be in sound condition as noted on the enlistment form and it would take "Clear and Unmistakeable Evidence " to rebut that soundness. This is a complicated m…

Finally At Post And Determination At Amc
Thanks To All Of You, I finally made it to Post and Determination at the AMC. For the last few days, my claims file has been with the Raters Supervisor. I called today and was told by James the decision was completed and my claim was at Post and Determination. I could tell that he was looking at the answer. Just to double check, I waited a few hours and called back. I don't know what department I talked to, but yes, it is confirmed that I am finally there. This is her exact words, " We hope to have your letter to you before Christmas." I believe tomorrow, I may be able to get a hint out of James what he is looking at. If I receive a denial, L…
