What To Expect At A C&p
A big THANKS to everyone on this board. I finally got most of my civilian medical records together (also learned that they are only kept for 10 years and then destroyed) and met with a VSO for the first time. As soon as I get a couple more pieces of paperwork we will file the claim (VSO says we need to do it before the end of Sept) and once filed it will take 8-12 months for the VA to schedule an exam. My question is: What should I expect from the C&P exam? The claims are for hearing loss, tinnits, and headaches. Dick

Bva Baffled By Mysterious
I was just checking with the BVA on my issue there- and they have my Remand Request. I explained that one issue on the appeal is moot because they are working on it now at the RO level (SMC CUE accrued ) That only left the direct SC death due to AO issue. This went to the BVA on July 18th. On August 2nd 2006 a Motion for Reconsideration was filed apparently by someone at the VARO- my vet reps sure don't have a clue to file one and I didn't file it. Checking my RO log- as the BVA person was very confused and asked me what decision I got in June because there is no decision there regarding this- in June I recall only getting a letter that they wanted to re-open …

ptsd Corroborated Stressor
Hi all: A viet nam veteran at our local VFW showed me his award letter of a claim that a VFW S.O. had filed last year for PTSD. It said that the stressor could not be confirmed but that the stressor was corroborated due to in service medical and service records. I don't know what was in his in-service records, but I was surprised to see those comments. I thought that stressors had to be confirmed. Any thoughts?? Mike

ptsd Nsc And Sc Symptoms Overlap
When itis not possible to seperate the effects of the service-connected condition and the non-service conected condition, the VA [must] attribute the signs and symptoms of the non-service conidition to the serce-connected condition. See Mittleider v. West, 11 Vet. App. 345 (1998); 38 C.F.R. [ss] 3.102 (reasonable doubt on any issue must be resolved in the claimant's favor) In 1996, when adopting a revised rating schedule for mental disorders, the VA stated "{W}hen it is not possible to separate the effects of the service-connected condition and the non-service connected} VA regulations at 38 C.F.R. [/ss] 3.102, which requires that reasonable doubt on any issue be resol…

Employment History Question?
Can leaving out a former employer on the VA form of your work history keep a vet from an award? I put down my last employment as 1995, but I did work for about half of the year, then my wife took over the marginal... piece of dung job? I have tax returns, but it seems that I have inadvetantly left out where I worked for a couple of months, and made $658.00 total...I forgot all about it honest! What can I do to make it right. I am not stupid enough to lie on purpose to the VA, and it goes against my code of ethics. BoonDoc

ptsd Any Opinions?
I heard a ruckus went on some time ago at my POA's main office as a vet and his wife were livid over a decision they had just received. My POA told the vet he was denied due to No diagnosis pf PTSD.The local vet rep involved (my former vet rep) laughed over this as he was the rep who handled the claim. I didnt get much info however I believe this is his BVA decision. Any I nuts? Shouldn't the PH have triggered a C & P and an apointment with a shrink? He didnt get a VCAA Notice either from what I can see. I have a list of many many of claims at the BVA that my POA screwed up. If I dont get my Remand by Sept 21, Gov Pataki will get this list. Any comm…

You Must Use The Cfr & M2-1 Against The Va
I am so thankful for this site, I will show the webmaster how much when that big back payment comes in! I was reading what the VA wrote in their decision to leave me at my present rating, and then went to the 38 CFR section on the VA rating schedule guide: http://www.access.gpo.gov/nara/cfr/waisidx...38cfrv1_06.html I also find this page a great jumping off point: http://www.hadit.com/38cfr4schedule.htm and I found it staring right at me that the rating officer had not used the second paragraph of the guidline when they had written that I had used corticosteriods every day for the past 12 months, that's proof that I should be rated higher. It allways bot…

App. Today Didn't Go Well
Well I had my second of 3 appointments for the claims I put in Oct 05. Todays appointment was for depression and anxiety. From the get go I didn't feel comfortable talking with her. She asked a lot of questions that when I answered it was like she was looking at me like, "yeah right". I do not like talking about things I went through and or what I'm going through now. I talk to my "shrink" every month at least 2-3 times a month and the Dr. today asked me today what her name was and my mind went blank . I felt at that moment it descredited everything I had said. The Dr. today asked me alot of dates and times and what happened at this time period etc.... I know I got a co…
