Iu Vs. 100%, Which Is Better Way To Go?
I just received a request for a reply from the VA. It is concerning an "inferred service connected compensation claim." I didn't request this so I'm not sure what it really means. My initial combined rating is 90%, but there are a few disabilities(big ones) that were denied due to "lack of evidence" that I ever had these problems in the service. I have a copy of my medical record and I plan on submitting copies of what I clearly see as chronic documented evidence. I'm not sure how it was missed, but then part of my rating was farmed out to Philadelphia instead of all being done here in Buffalo. But anyways, if I were to get 100% without IU, what advantage wo…

A Good Example Of Why Vets Are Confused
So how's this for confusing. Feb. 26,2005 This is in further reference to the appeal you have filed from our decision on your claim for benefits. It is not a decision on the appeal you have initiated. It is a Supplemental Statement of the Case which contains changes or additions to the original Statements of the Case sent to you on June 17,2002, and August 12, 2003. A previous Supplemental Statement of the Case was sent on August 12, 2003. DUHHHHHHHHH ! carlie

tinnitus Denied Again
I was denied again for Tinnitus, bilateral hearing loss, bilateral otitis externa, and upper respiratory infection. I have medical records in service to prove otitis externa, and upper respiratory infection, but that isn't good enough, and have suffer with UPI ever since, although, don't go to a doctor every time I have the symptoms, as I learned to live with them, and never even considered that I could get service connected for it, until about a year ago, hence no medical records, except at the VA, tinnitus in a coin toss, what I have read on the BVA site for veterans cases, some get approved and some don't with the same evidence I have, some if you have been in combat…

Camp Lejeune Toxic Water Victims
I attached the AWHTTN Newsletter. You can click on the hot link in the newsletter that says Form95help website and fill out your info on line, it is very short so you are not filling out the whole form 95. This law firm is handling the class action suit and will get back to you and notify you if you have a case based on your conditions, etc you believe could be attributed to the toxic water at Camp Lejuene. This law firm specializes in toxic suits. They have sent their own specialists into Lejuene and guess what? The level of toxic stuff is actually 35 times the safe level of 5 parts per million. All of you that were stationed at Lejuene prior to 1986 have drank…

Proactive Witout Being A Pest
Hello, Last Tuesday I had a C&P appt. at the VA Hosp. for cataracts and the worsening of my multiple sclerosis. I am 100% S/C IU. It has been extremely hot in California and the trip to VA Hosp. rendered me almost unable to walk or even stand up. My MS is extremely heat sensitive. I found the medical arm of the VA to be extremely compassionate and empathetic; the confusion and "bravo-sierra" lie with the RO across the Bay. At any rate, my SO is avaiable only on Thursdays now as he has much ground to cover in this county. My latest e-mail and telephone call to him have yet to be answered. Would contacting the RO Finance dept. regarding this 8,000.00 I allegedly…

diabetes Suing The Veterans Administration
All: I am a Vietnam Veteran (67-68) with a 40% service connected disability for diabetes, hearing loss and left & right side neuropathy. I have been playing the VA paper game for over two years with additional service connected claims and am really losing my patience. I have had two friendss die within the past 6 months both Vietnam Vet. I am feeling that the VA delays our claims unnecessarily in the hope that we die before they are settled so they need not pay us any compensation. If there are any Veterans that have sued the VA in this forum. I would appreciate some feedback on your experiences in court. Thanks. Tom!

Title 38 Of The United States Code - Help?
I saw that someone ask this question earlier- What is the basis for Veterans Affairs law? The statutes governing VA law are set forth in Title 38 of the United States Code, while the regulations implementing these regulations are in Tile of the 38 Code of Federal Regulations.. In addition, further directions for implementing the program are in the Administrative Procedure Manual M21-1. The General Counsel has issued formal interpretations of some of these laws, and there is court precedent from the Court of Appeals for Veterans Claims (CAVC) and from the U.S. Court of Appeals for the Federal Circuit. All of these resources are online. [b]My question is how do you f…

tdiu Success
I got the big envelope. The good news was left ischemic cervical myelopathy, which is currently 10% , is retroactively increased to 40% eff 5-14-05. Right ischemic cervical myelopathy 10% increased to 30%, retro to 5-14-05. I have 30% on feet for pes planus. I expected TDIU, they still have not used SSDI, disability retirement from P.O. or the nuero letter stating I won't be able to work again ever as evidence. I guess that will go on the VA form 9. I don't have any idea what I'll be getting but this will make life better at the home front. Thanks all, especially John 999 and Berta.

Could This Qualify As A Dic Claim?
The veteran's advocate who has been working with my husband on his VA disability claim suggested that there would be nothing to lose for me to file a claim for my mother. I had made a comment that I was so sorry that my father had never tried to get an increase in his VA comp. My father is deceased but up to the time of his death in 2000, he had received 10% VA comp for a service connected knee injury from World War II. Over the years his knee became worse and he finally went to an orthopaedic surgeon to have his knee fixed. The surgeon would not operate until my father had his heart checked. Upon going to a cardiologist and having a heart cath, Dad found out he had …
