Can Govt. Officials Be Personally Sued ?
. I saw this last week and do NOT want to make it a political issue, but a ... "TRUTH & LIABILITY ISSUE" ... for some "hazardous materials claims" that have been mentioned on this site I want to address the issue of .. "Govt' and/or Personal Liability" .. ie .. while EPA Chief is performing in an .. "Official Govt Position" ????? This primarily has to do with liability during 9-11 and what areas were safe and what the EPA told the people at the time .... but this could possibly apply to other "hazardous material" areas also ????? If the EPA could make this big of a mistake or lie ... with perhaps 1000s of people after 9-11 (in the civilian world) ... well …

Past Ro Mistakes
Greetings, Big, multipart, generalized question. I'm curious about the RO and BVA not siting the evidence and, of course, not discussing the evidence. When that happens, is the decision incomplete and of no weight or force? Does the decision count? Is the decision appeallable? Upon winning the award at a later date, will the effective date of the compensation be the date of the original claim filing, (after the claim is later, finally won)? Does [not appealling an incomplete decision within one year] nullify the original effective date on a later winning appeal? When nothing is explained in the decision, does that lack of information co…

Letter From Appeals Management Center
My husband received a decision from the AMC a few days ago in the mail, and we are confused as to how to figure it out. He called the AMC, and the person on the phone couldn't explain it. We called the 800 VA number, and they couldn't explain it either. So we've come to this board to see if anyone can help interpret this for us. The information is as follows: Total Award Amount: $1196 Amount Withheld: $1063 Monthly Entitlement Amount $133 Payment Start Date: September 1, 1993 Reason for Change: effective date of increased payments/military retired pay withholding Total Award Amount: $1227 Amount Withheld: $1090 Monthly Entitlement Amount: $137 Payment …

ptsd Had The C & P Yesterday
I went for a C & P exam yesterday for stress/depression due to AO SC Lung cancer, DM11, nueropthy, back pain, sleep apena. The physc dotcor seemed great. Took about 2 hours and was very efficant and asked alot of questions. He was 74 years old, very alert, and really seemed to like Vets. He jokingly said I was in worse shape than him. I was expecting a hassle prior to seeing him but he was great. Anyway, he stated he was going to put me in for PTSD with P & T. He looked at my records and seen were I had purple heart from Viet Nam and asked me a couple of questions about stressors (was I shot at, did I see action, etc). He stated that with my medical conditions ang…

Psychological Testing ?
As difficult as it was, getting the written evaluation for my recent MMPI-2 psychological test and since it dose not appear in any of my records, I have thus far requested. Is their or do you have to make a special request or for that matter does you PC Dr./Psychiatrist have to request these types of records from the MPRC (MPR)? I'm wondering if certain type of Medical records are only available at the request of your treating Psychiatrist, due to the sensitive nature of the enformation in these types of tests. Does anyone know if this is the case and if so, must you make some sort of special request to get the written evaluation of thess sort of tests. I know I t…

Can You Add To Cue After Sending It In?
The VA already has my request for revision due to CUE but now I've found a Supreme Court ruling that speaks to the heart of the matter. And if they can find ANY way to lawyer their way out of this one, I'll eat my hat! The problem is, I don't know f there's a "right" way to get it added to the letter I've already submitted. Do I just send another letter and ask that they add it to my original CUE request? Angela Oh, in case it'll be of help to anyone else out there......... In Brown v. Gardner, 513 U.S. 115, 118 (1994), the Supreme Court held that if a statute is ambiguous, any interpretive doubt is to be resolved in the veteran's favor.

Advice On The Sixty Days That I Have To Submit New Info
Its Feb 8 and I am working hard on my stressor package and want to submit it before the sixty day window is up. My question; When does the sixty day window start? I returned the letter response (certifed) to the post office Jan 8 telling the VA that in fact I did have more information to submit and I wanted them to wait before deciding my case. Does the VA sixty days before they make a decision on a case include weekdays, weekends or every calendar day? Thanks so much, pretty stressed here trying to get the package together, but I truly beleive I will make it. Prayers are appreciated meanwhile! Thanks for any resonses in advance!
