Claim Sent Back To Developmental Stage
Hello again family. I hope all has been well. I have just a couple of quick questions for you guys. My claim was filed 05-11. In November it went to the raters desk but was sent back to development due to an appointment for an MRI. I then was set with an appointment for orthopedic eval for surgery. I was sent back to physical therapy after my orthopedic evaluation and the claim went back to rating on the latter part of feb 2012. My questions are. If this claim went back to developmental due to an appointment for an MRI, what will happen if now I am sent back to ortho for surgery (which is happening). In addition, if surgery occurs, will this have any impact on my…

ptsd Ptsd Treatment While Filing For Compensation
I am currently filing a claim for compensation for PTSD and the process itself has prompted me to get care for the first time. If I make improvements during my treatment process and my claim is still being evaluated, will this lower my rating? I realize this is ambiguous because I have a medical record trail of significant PTSD issues for over 10 years. I've also had a couple TBI's, so I guess my fear is that I may see some improvement in the PTSD area, but that I will still have difficulty with employment, relationships, etc even if I have the nightmares, etc more under control. Just curious what people think about how the raters view current treatment in the big pict…

Va Neurologist Says Osa Related To Organic Solvent Exposure
just got c&p report for obstructive sleep apnea. Dr checked box that says "at least as likely as not" due to service. In the comments he stated that I was exposed to solvents/jet fuel/isocyanytes as reported in my smr's. He then referrenced the internet articles that I took to the c&p describing exposure to organic solvents as a cause for sleep apnea. Good news. I think they need to work out some bugs in the new system. He examined me for DDD of the neck -- I was claiming it seciondary to DDD of lumbar or due to the use of power tools (vibration damage) He also examined me for headache. In his report Under Medical opinion for "direct" service con…

ptsd Some 38Cfr 3.156 Awards-Bva Back Up
The BVA is back on line! Yippee. Here are some recent decisions that involve 38 CFR 3.156 © “As discussed below, 38 C.F.R. § 3.156© is for application in the present claim. However, a review of the record reveals that the RO did not consider this regulation, either as in effect prior to, or as revised on October 6, 2006, in adjudicating the Veteran's appeal. Nevertheless, given the Board's favorable decision in this case, the Veteran is not prejudiced by the Board considering and applying the revised version of this regulation in the first instance. “ ORDER An effective date of December 8, 1969, for the award of service connection for ulcerative colitis is grant…

I finally got my C-file and was it a mess. there were very few medical records pertaining to my claim. even the ones i sent to them myself were not included. All Va medical records with my diagnoses of parkinsons were missing . To top it off my service and medical records are classified to the point my state senator said she can no longer pursue them for me. Thats right my medical records are classified. at least thats the answer i got. so at this point my file Claim has been on a review officers desk for over a year for the 4th time. tdiu Back Payment Time Frame For Military Retirees?
I filed for Service-Connected Disability in July 2010, then I retired from the Army in September 2010. I had the Comp & Pen Exam in late October 2010 and received my decision in September 2011. Initially, I was awarded 90%, but I was approved for Individual Unemployability in January 2012. I received monthly payments at the 90% rate from OCT 11 to FEB 12. This month was my first at the 100% rate. I still have not been paid from retirement in SEP 10 to award in SEP 11. I realize that the VA had to send my decision to DFAS to obtain a CRDP Audit Sheet. That was accomplished by DEC 11. I am guessing that the process was repeated when I was awarded IU in JAN 12. I am wond…

ptsd Help With Understanding Remanding From Appeals Back To Ro
Hello, I am a Vet advocate in my small town. I help as many as I can with their claims and following them along the process. I am not associated with any organization. We don't have any organized VSO's in our town so I try to take up the slack where I can. I have an issue that I need to get some understanding of. One of the Vets I'm helping has had claims in for several years and under appeal. When he came to me his claims were very convaluted and all had been denied because no one had helped him with the processes. He even had an attorney that advised him to file for agent orange but the vet is a blue water and was never qualified for agent orange. I was able to ge…

Got My Rating Today
OK, the envelope came today and I was awarded 80%. I am retired military and I am recieving a military retirement check. Here is where I am confused. Page two states my VA comp will be $xxx monthly, then it goes on to say " We denied your compensation grant because you elected to recieve your military retired pay in lieu of compensation. VA restricts payments of military retired pay and VA comp. If you elect to recieve VA comp please complete VA form 21-681, Election of Comp in Lieu of Retired Pay or waive of retired pay to secure comp from dept of VA". I was under the impression that any rating 50% or more would qualify for both, retired pay and VA comp. Can an…
