Substantial Gainful Work And Periods Of Remission
This is a really interesting, favorable case that was decided in the Federal Circuit on November 21, 1996. The case citation is 100 F3d 1389 Gregory Andler v. Shirley Chater, Commissioner of Social Security. The Federal Circuit seemed to state that an error was made in failing to consider that the periods that Gregory Andler worked and exceeded the poverty threshold were periods where his mental illness was in remission between hospitalizations. The Court stated these periods where the veteran worked during 2 summers should have been viewed as unsuccessful work attempts and ordered that he be considered disabled. Desperate To Know What Can I Do?
Hey all a desperate plea for help. My current job has aggrevated my disability from the Veterans Administration. I am currently at 40% and have been told without surgery on my knees I cannot continue in my job. My knees are at 10% each for Retropallete Femoral syndrome with pain. My hips were added in Aug 2009 as per pain etc..... My back showed arthritis which the VA claimed was not a issue of theirs and stated my ankles were due to weight but I had medical records showing that it was in ralation to my knees. This was apparently ignored. The issue is I work as a mail man. My knees are preventing me from working and according to my Ortho Doctor need surgery. I have not w…

Ulcerative Colitis Frequency
I received initial rating of 10% for moderate ulcerative colitis(UC) with infrequent exacerbations. Looking at the schedule of ratings, what number of exacerbations differentiates infrequent, frequent, and numerous? I have searched for this number online in various places but cannot find. Complaining About Va Medical Care?
I would like to know the best and most effective way to complain about poor medical care at a VAMC. I was recently injured by an x-ray tech at the VAMC. During the same visit, I was also given large amounts of IV and oral steroids, which resulted in me missing almost two weeks of work due to an adverse reaction (i.e. severe side effects). Should I deliver my complaint through: - Patient representative at the VAMC - The IRIS web site I have everything ready to go, just need some opinions on the best route to take. Thanks!

Hello, I sent a message to another board, but i didn't find it there, so reading through this topic I decided I'd send some questions to the forum members here. After a 2007 Double ANCF with plate, I had a relapse with a enormous pain about 6 months later. I retired in 2003 from the Army, but for a variety of circumstances I never got a round to getting my VA physcial. I did get my retirement physical though. So after my neck got worse, I decided I needed to file to protect my family for the long term. It was for specific problems with my neck and didn't cover anything else. My Brother Mike The Rest Of The Story
Re: My Brother Mike passed on Christmas Day The story behind the Story. Mike was my best friend since we were toddlers. We pretty much thought the same way, liked the same food, the same sports and took pretty much the same meds. He was 6'5 and I thought that he would live a long time more than me. Hepatitis In 1973, File A Claim?
I am real new to all this VA maze, I had Hep A soon after being seperated from the service in 1973. I was hospitalized at a Veterans hospital for 4 weeks. This was within 60 days of seperation. I was a emergency room medic for the last 1 and a half years. We were always covered in blood and body fluids. Poked with a dirty needle more times than I could count while trying to sew up a drunk or injured soldier. Most of us were OJT,ed into this posistion. ptsd Incompetency Means No Firearms, Too?
Last week I got an award raising me from 30% to 70% for PTSD. Today a lady called and identified herself as a VA representative and said my claim is still "being processed". Then she said I cannot purchase or transport firearms since I am being determined incompetent, based on the C&P examination report. During the exam I had told the C&P doctor/examiner that my wife handles our finances. She's a financial planner, for pete's sake! So the lady said, as was also stated in the award letter, that VA "proposed" to find me incompetent to handle my finances and I would need to designate a fiduciary. Withdrawal Of Claims
On 10/3/09 i recieved my 50% rating(great c and p with a real doctor on 6/30) for sc migraine headaches, no exam until after 10/3/11. On 11/16/09 i filed two claims - chronic pain and chronic fatigue syndromes secondary to migraines. On 12/5 I received varo letter dated 12/3 acknowledging my two claims and that they also added a claim for an increase of my sc migraines(note - already at the highest rating of 50%). On 12/7 I sent an iris and 21-4138 statement to my varo saying that i wanted to withdraw my claims. On 12/8 i received vamc letter dated 12/7 saying that i have a c and p exam on 12/29.
