Something I Haven't Read Before
Speed Up Your Claims! There are a few simple things that you, the beneficiary, can do in order to expedite the processing of your claim. Here are a few suggestions: Submit pharmacy summaries, not labels. Submit pharmacy summaries. Your pharmacy can give you a printout for the date range you specify. If it is necessary to submit prescription labels, send copies only, making certain they are on pages that are 8-1/2 inches by 11 inches in size. Retain the originals for yourself. It is also unnecessary to send drug descriptions. Do not staple your claims. Staples jam machines we use to scan your claims. Do not staple your claims together. It is not necessary as our e…

Cue "one Shot"
This time, I know where I read it..it is from Jim Strickland, and it is here: http://jimstrickland912.com/CUE.html Earlier I asked about this "one shot" cue, and the general consensus was that it was bunk. (my slang for "bunkum" or "BS"). Still, I do think Jim Strickland is both knowledgeable and credible. So, I will ask again..is Jim Strickland wrong, or are we only allowed one CUE? This is from J.S's "A to Z guide to VA Disability Benefits"

diabetes Even With A Representative
I find this BVA case interesting as it shows some ways BVA looks at or doesn't consider the responsibilities of POA's when they screw up. Of course the argument stands you can try to sue the POA at a later date. The question on that is, a) how long and how much energy will this cost the claimant b) will there be any monetary results This case certainly shows that when you sign over your form for representation, the bottom line for responsibility,is still in the claimants hands. carlie http://www4.va.gov/vetapp09/files3/0923959.txt Citation Nr: 0923959 Decision Date: 06/25/09 Archive Date: 07/01/09 DOCKET NO. 07-31 352 ) DATE ) ) On …

Berta - Lawyer Finally Takes My Tort Claim
A year ago this month the va screwed up my left eye cataract surgery. I have looked of lawyer for a year. Today a well know Austin texas law firm accepted my case for represenation. I was told that a claim of 300,000 was not unusal for the damage the va did, and that it likely will settle outside of court for at least 200,000. The law firm gets 20% of the settlement or 25% if it goes to court. I was really surprised by the call from the lawyers office, I expected another turn down, but was assured that I clearly have a winning claim.... wish me the best of luck because since I am already 100% a new rating would not provide me any additonal compensation...... so this …

ptsd Special Claims Handling Procedures For Missing Documents? (berta?)
My award date for PTSD was July 2002, but I applied for PTSD back in 2001. The VA lost my application but I have a copy of the original 4138 filed by the DAV. Plus a letter from the DAV county office verifying they sent it to the VA. Since I missed the Special Claims Handling Procedures for Missing Documents deadline, should I file for reconsideration? Also, I filed for Chronic Fatigue Syndrome back in 1993. I found the original 4138 while digging through my paperwork. I got service-connection for Chronic Fatigue Syndrome in 2004. But the VA never gave me a C&P exam for CFS back in the 90's. I guess the disease wasnt really on the radar yet. I am currently 60% f…

Upcoming C&p For Parkinson's (ao Presumptive)
After my VSO had me sign the VCAA letter "I have no other information or evidence to give VA to support my claim I started reading over the letter VA sent in more detail. My VSO said the information we already sent should cover most items and the VA already has the rest. There are seven bullet items in the VA letter under "What do we still need from you?" Quoting them with my comments/questions (in bold) on them: 1) "We need evidence showing that the following conditions existed from military service to the present time: Parkinson's disease, tremor, bradykinesia, and rigidity." I didn't think this had to be proved as the new AO directive made PD presumptive. 2) "…
