Mike's Obituary
Dear Hadit Friends: I cannot tell you how much your support has meant to me these last few days. As of today all of Mike's Brothers and Sisters are here in El Paso as well as many friends and as his funeral is expected to fill the Church. I plan to go back to Dallas on last plane on Thursday and on Saturday drive to Oklahoma to attend graveside services. After it is over I will return home and hibernate for a few days. http://www.legacy.com/obituaries/elpasotim...p;pid=137958840 My Sister in Law is doing better now and so are the rest of us. The one thing we have is Love and we are strong enough to get through this together. Thank you all. Pete

The Va Never Forgets
Something interesting that could raise some eyebrows... Many of you that go to the VA like I do watch the doctor, nurse, tech or whomever open your records on the computer screen in front of you. On mine there is a box that is surrounded by aterisks * and it says in the box that it is sensitive or secure. I asked one day what all that was about and the person told me that the only reason the box is there is because if you have ever been violent or a problem, or if you have ever worked for the VA. She asked me jokingly "which one i was"? which I replied " Which one do you think i am"? Truth be known ive worked at a va before and ive been a problem so both i guess but, dont…

Old Vet - New To The Va System Needs Advise
WOW, where to begin. I was discharged from the USAF in 1978 (long time ago) after a Medical Board with 6 years in-service. I was given a rate 0f 20% at that time and moved on with my life even though I didn't want to be discharged. The reason for the Medical Board was a massive fracture to my left ankle that required 2 surgeries while on active duty. Now I am 59 years old and beginning to realize I have screwed up by not pushing for a higher rate until now. I never realized there were forums like this until after I filed for an increase in May of 2009. I did receive an higher rating but I appealed it. My current combined rating is 40%. I appealed due to having a…

All Va Fast Letters
The Texas Veterans Commission (much to my joy!) has published this link to all VA fast letters. I am posting the Nehmer Fast letter links in the AO forum here as well as well. Fast letters in some situations could even be used as evidence if the VA fails to follow the administrative instructions in a Fast letter. http://www.tvc.state.tx.us/HTML%20Pages%20...ast_Letters.htm

tdiu The Va Destroyed My Brother
Thursday my Brother Mike will have his funeral in El Paso. The Church seats 185 people and they are expecting an overflow crowd. Everyone who knew Mike liked him as he was a standup guy. He always was there to help. He was a great Dad, Now his wife can;t stand to live in their home cause although she has great memories and they had a beautiful home its not the same with out him. She plans to move to Austin Texas and live with her parents now. On December 25th Mike in despair took his own life. Why did he do it? No one can be sure but most of his family believe it was because of his pain and the incompetent bastards who run the VA Medical in El Paso. Mike had good insur…

Svr Radio Show 12/20/2009
Kurt Prissman wll be our guest speaker. This is just some of the things that Kurt will be commenting on so please call in 319 648 5144 is the VA claims process really worth saving. If the top-level management is the reason the Department of Veterans Affairs (DVA) is broken, do we really expect mid-level supervision and workers not to be problematic? Are appearances not everything? VA witnesses spout everything is “fixed”, “not indicative of the general health of the VBA system”, or euphemisms about “how much they care for our veterans”. In fact, it is extremely doubtful they have done anything to fix these problems. These scandals continue week after wee…

Treasury Offset Program
The taxman commeth! Many of you will be filing your taxes this year and will be in for a "rude" awakening when some, if not all of your tax return is "taken" from you through the Treasury Offset Program. Some of you have recently separated from the United States Armed forces and currently still hold a (charged-off/delinquent) balance with AAFES (back child-support as well). If you have not paid AAFES in full by the time your tax "return" arrives to you via direct deposit or check, you can look forward to having your money "taken" from you via the Treasury Offset Program (provided, you are not making regulary monthly payments to AAFES). I'm just referring to agencies …

Info On Eeds In A Recent Post
I cant find the exact topic or post. It was in reference to EEDS and the date of liberalizing regulations.I think James added to the topic but still cant find it. I didnt have this caveat on hand to respond properly to the info and just found what I was looking for- The General rule in 38 CFR 3.114 and 38 USC 5110 requires that Awards cannot be made with effective dates earlier than a liberal rule's date on publication. However, the topic here seemed to suggest that could be for AO claims too. Caveat:Source VBA Feb 2009 Fast Letter -re Nehmer: "It is important to note that the general rule in 38 USC 5110 (g) and 38 CFR 3.114 that an award based on a libe…

Appeal Gone Wrong
I receive a letter from the VA which was a Supplemental Statement Of Case dated 12-15-09 which I received 12-24-09 and it states that I had 30 days from the date on the letter to respond. However, upon reading the letter I found that they had changed the original issue which was "Evaluation of aggravation of osteochondral defect, right medial femoral condyle evaluated at 20 percent disabling." to my current rating after I had a right knee replacement which is now rated a 30 percent. My original claim was filed 9-28-05, where I requested an increase in my rating due to right knee instability, bone lost, increase in pain and swelling, and the fact that my doctor document…
