Lower Back; Help Please
This is my first post and I apologize if it's in the wrong area. I researched other peoples issues but I find mine to be a bit unique. I will do this chronologically and as summarized as possible: I left the U.S. Army Infantry in May of 2009, after serving since Jan 2006. I had not found any work but I was attending school (GI bill was coming in nice). When I received a recall packet (not unexpected at all) I dropped school happily to have my back checked out. Soon enough, they found the problem and released me. 9 Oct 2009 FINDINGS: There is bilateral spondylolysis at L5 with grade 1- spondylolisthesis of L5 on S1. IMPRESSION: 1. Bilateral spondylolysis at L5…

Court Of Vet Appeals Process?
After your lawyer has submitted your brief to the court what are the next steps before you get a decision? I imagine the VA gets to submitt their brief opposing whatever you are asking for in your brief but what comes next?

At A Loss
7 years ago I was diagnosed with a brain tumor. I was 9 years out of service, however, there where 3 other men from my Team of 40 with the same afliction. One has since passed. I filed my claim in March of 07. It was denied 6 months later. I apealed and it was again denied. I filed suit in the court of veterans appeals and it was remanded with specific instructions to have me undergo another C&P exam. The BVA said that the "respectfully disagree" with the court order and simply denied the claim. However, they gave me specific reasons as to why the claim was denied. I filed suit again, and, again it was remanded. I have since submitted medical information t…

Glaucoma Treatment - Or Lack Thereof...
Last week I went back to the VA optometrist for more glaucoma tests. After the pressure test and "what flashing lights?" test, she showed me a read-out where there appeared to be dark spots around each of my eye's range of vision. She said "Now we have a base-line, we will check you again in four months and see if there is any progression. But looking at this, I'd say that you do have glaucoma." She did not ask about my medications. She did not talk about any kind of treatment or what progression might mean or even what glaucoma was. I was scared, had taken an Ativan to keep my eye open enough for the pressure test, and was too afraid/fuzzy to ask questions. …

Pow's Widow - Any Long-Term Healthcare?
I don't know if this is the right forum or if it's even the right question. My father-in-law was a WWII vet. Landed at Omaha (2nd landing), got captured and spent the rest of the war as a guest of the Third Reich. Tortured, starved, etc. The whole of Germany was starving by that point, I suppose. Anyway, he retired from the Army, and just before he died his Comp rating was increased to 100%. The death certificate said the right words and my mother-in-law receives DIC. Big kudos to the people at Newington, CT, VARO for putting a rush on everything for him and for her. Now my MIL is showing signs of dementia. Her doctor filled out a form (special to Newington, no…

Va Decided My Claim Before Receiving My Va Directed Medical Exam
Good day everyone, My first post here. I am SC, 60%, 24 years AD USA. Claim was initially opened 1 May 2010. Partial payment for 60% started 1 DEC 11, with a relook for three areas: IBS, Chronic Fatigue, and GWS. Relook done in South Korea. My paperwork was initially sent to a wrong address and wrong first name. It did find its way to me after 3 weeks. Must use the US Embassy overseas to schedule appointments. After two weeks the Embassy finally had me make my own appointment. had two very indepth exams over the next 6 weeks. Sent VA a fax on 30 June 12, stating not to finalize my claim and listed the dates of my appointments, one had already been completed. Emailed…

Double Or 2 Hour C And P Exam
Ok, quickly, I had 5 claims and two came back denied, two came back SC, and one came back deferred. For the deferred claim, they scheduled and I went to a C and P two weeks ago. After the C and P for the deferred (?) claim the claim went to prepared for decision and then back to gathering evidence. Now I have two C and P exam in a row, one after another, in the same day with the same examiner that did the deferred C and P for the plantar warts. Question. The deferred claim is a simple one for plantar warts. And I did have that exam. So I don't get the deal with the two hours for another C and P. Could they be looking at one of the other claims that were either d…

tdiu Rating Decision C&p Evidence
Hello everyone, I have been a member for a while and visit the site often, but this is my first post and all advice and recommendations are welcome and appreciated. I received a Denied TDIU rating decision from the DVA last week using what the letter described as a Single Streamline Notice which took 23 months to decide. After reviewing the evidence in the letter that DVA said it used to make their decision I noticed only one (Hearing Exam) of four C&P Exams I took is mentioned as evidence. The other three for Prostate Gland, Degenerative Disc Disease Lumber Spine, and Upper GI are not referenced in the evidence section. Can I use this as a reason the appeal their d…

Veteran Preference
I am 60% disabled. I understand how to claim a 10 point preference, but is there a letter/form that you can request from the VA for more significant preferences? Such as claiming a Veteran Recruitment Appointment. I have a bunch of decision letters for the various conditions I am connected for but I would think there could be a single page that the VA could give you that describes your status(total percentage) without all the gory details such as the fact that you are rated for hemorrhoids. I am most concerned with Federal employment and proving that I am over 30% disabled which as I understand is the most advantageous benefit.

ptsd Iris Vs Truth... Another Adventure With The Va
Update on my initial PTSD/+other conditions claim at just short of one year at VARO: I knew this would be slow, especially after finding the hadit site, so have been trying to be patient. Claim went in Feb 2011, finally got C&P first of November. Claim went to rating board November 17. I sent copies of bankruptcy and foreclosure along with my request to expedite due to hardship. After a month or so, I began sending IRIS requests to my VARO (Wichita, KS) for updates. Each response (which seemed to respond directly to my questions) told me clearly that my claim had been "flagged to expedite due to hardship." That would be at least four IRIS responses. Afte…
