Osteoarthritis Help
spend 21 yrs in and on my exit physical about 5 months prior to retiring I told the doc about it and again on my Gulf War registry and ever since till present I have complained about it but never had a diagnosis and now I do 12 yrs later. So do this mean it will be rated or service connected or not? I have read the following but don't know? Certain chronic diseases, including arthritis, will be presumed to have been incurred in or aggravated by service if they manifest to a degree of 10 percent within one year after separation from service, even if there is no evidence of such disease during service. 38 U.S.C.A. §§ 1101, 1112; 38 C.F.R. §§ 3.307, 3.30…

cervical strain Bva Hearing 11/13 Headaches
I have my Video Conference hearing on Tuesday 11/13 at Bay Pines, so I will fill all in on how the proceedings go. One of the issues I have on appeal is headaches and I got a letter from my doctor that states: His headaches have a significant vascular component, although they are not classic migraine. He also gives history of at least 2 motor vehicle accidents where he sustained severe cervical strain and possible concussion. In my opinion his vascular headaches are being driven by his suboccipital neuritis by way of trauma. Both of my auto accidents were while I was on active duty and I am hoping this is enough of a nexus for the VA to service connect me for my h…

National Archives And Searching Also Hire A Researcher
Hello All, Though I have not had much success at the National Archives searching for Documents(because of secrecy issues) there is another service and that is Hiring a Researcher. I have talked to one for the purpose of trying to get records and specific DA forms and DD forms and the initial cost will usually start around 35-50 per hour and a minimum of 5-6 hours so there is some expense. The main advantage is that most are court certified , meaning their study request is admissable in court and their research usually goes beyond what the Veteran is able to do on his or her own. I would like to also say that some records will not be released due to their security cl…

Cyst On Back And Removal
Hello, I wanted to see if anyone could provide some guidance. I got out of the military in 1995 and was given a 50% VA disability rating (Back, Knees). In 2008, I was given 10% rating for insomnia related to my lower back and knee conditions. However, my rating stayed at 50%...I still don't understand that math. :) I was at a Veteran's outreach event recently and a vet had told me she received 10% for a cyst that had been removed. I looked in my VA medical records and I also had a cyst noted on my Service Medical Records back in1995 and my final Army medical evaluation. I believe I had the cyst removed before I left the military but couldn't find that record...or p…

C&p Results From Claim Re-Opened By The Va
This is the first time in a long time that I have tried to attach anything, so please excuse my brain at 2:00AM. I would appreciate it if you all will exam this C&P for me, and tell me what you think. The ROM gets me confused, and so does the flexion scale. Is there a slight chance that I could get rated on this? I believe the first time that I put in a claim for this was 1973 in Indiana, but can not locate the paperwork. The earliest that I can find is from an appeal decision on Aug 7, 1975. This decision basically said "impression of Back Sprain" , now there is nothing in my military medical files that says "Sprain". I did not no you could "Sprain" your Bac…
