tdiu Dental Coverage
Finally made it back from a short vacation. went to visit my daughter out of state. She was promoted to Captain in the Army. Anyway, I been fighting with the VAMC Dental office for authorization of dental work for myself here in Phoenix Az. What a frickin nightmare this has been. They were denying me because my award letter for TDIU said "future exams" and they interpreted that as saying it is only a temporary award and not permanent. I asked them to show me where in the CFR it says that, and all the supervisor could say is, that they were told that from the VA Health Eligibility Center in Georgia. I then contacted that Center and talked to a gentleman that said that wasn…

Allergic Sinusitis – What To Do When You “Soldiered On” With The Condition On Active Duty?
What options do I have to prove allergic sinusitis at when my service records do not show that I had antibiotic treatment for four to six weeks? I have had more than six non-incapacitating episodes per year with the condition, but I don’t have headaches with it. It’s not in my record that I went to the clinic often enough to substantiate my claim. Why are those records not there? I just lived with the condition unless it was really, really unbearable. It was part of of who I was and am: I just get sick often, and the meds don’t really do that much good for the routine symptoms. I just let the nastiness run its course. The bottom line question is, when you “soldi…

tdiu Do I Appeal? What Would You Do?
So I recieved my proposed rating of 90% "see below". I know they low balled me on a couple of issues, and a couple of those "10%'s" could/should easily be 20-30% or more. Since I got 90% already, "I feel lucky and fortunate to recieve this much" Is there any benefite to me appealing their decisions on some of the below contentions? (NOTE) I dont think any of my contentions that I would appeal would garner a 50% or more rating. Maybe 50% if I am lucky. Since I am at 90%, can I apply for the TDIU even if I plan on working when I get out?

Va Benefits And Medical Retirement
I am looking for information about if it is possible to apply for medical retirement after you've exited the Army. I have my VA rating and I need to know where to find the forms to continue from here into medical retirement (if it is possible that is). I saw on another forum that it was possible to obtain both VA and MR at the same time depending on your percentage, but no where that I have found thus far, has stated that you may CAN / NOT apply for medical retirement post Army separation. I was not medically discharged and I have very few resources to reach out to that may have the correct answers or the resources to point me in the right direction. Thanks in advan…

hypertension I Think The Va Screwed Me On My Percentage (Need Help)
Yesterday I recieved an unofficial rating letter from the DAV, here is what it stated, "Service connection for right shoulder impingement syndrome is granted with an evaluation of 0 percent effective Sept 18, 2006, A 10 percent evaluation is assigned from June 7, 2012". Here is a cliff notes version of my process. I did and appeal for and increase for my back, in 04 and opened a new claim for right shoulder secondary to my left shoulder and hypertension in 06 , my claim was denied for all three was denied in 08, so i appealed the back pain and it went to BVA asked for a reconsideration and de-novo review for the shoulder and hypertension, I then had a meeting w…

Thoughts On "new And Material Evidence" Standards.
Mods, feel free to move this topic to the appropriate forum if I have posted it within the wrong one. I am getting ready to go head to head with the VA helping another Vietnam veteran reopen a claim vs. filing it as a new one because the original claim was not only incorrectly filed by the county VSO (that I hope to replace soon, interview is tomorrow for the job), but the VA RO in its denial really didn't address any evidence for or against the claim and was rather vague about it. I made a great investment buying two books from Lexis Nexis that focuses on case law, etc. and the CFR/USCS on veterans benefits, and in reading it I cannot help but question something. H…

tdiu Va & Dol Introduce A New Training Program For Unemployed Veterans
The VOW to Hire Heroes Act of 2011 was recently passed by Congress to provide assistance for unemployed Veterans. If you are an unemployed Veteran between the ages of 35 and 60 you might qualify. If you know other Veterans that may qualify, please spread the word about this program by forwarding this email. The Veterans Retraining Assistance Program (VRAP) was part of the recently passed legislation. The program is a Department of Veterans Affairs (VA) and Department of Labor (DOL) joint effort to provide training to Veterans unable to find work. Update To Decision
I just got another update to my claim that was filed Aug 2010. They service connected 3 more contentions at 0% (I now have 8 at 0%). However, they denied me two of them and I'm not sure if I can't do anything about it or what my options are. Dyspareunia (painful intercourse) and Dysmenorrhea (pain during menstruation). On both the denial reason is: The evidence does not show a current diagnosed disability. On both the explanation is: **** is not considered a chronic condition for VA purposes. In 2004 - 2006 I went through a long process of trying to fix my chronic vaginitis, painful intercourse, and cramps. They 0% service connected the vaginitis but not any of …

ptsd Mental Illness Claims
Hello All. I am working with a young man that was discharged from Air Force in 2006 after 3+ years of service. His records show that he was diagnosed with Dysthymic Disorder and that he was discharged for Personality Disorder. Dr. report claims the Dysthymic Disorder was pre-existing. I reviewed his entry physicals and there is nothing there for mental illness so that is bogus. He has since been diagnosed Paranoid Schitzophrinic for which we filed VA claim for. I've read his files and it shows an above average to exemplory performance up until 2005 when it all went backwards. He has been seen in our town by mental health facility and documentation has been forwarded t…

Retroactive Pay?
Hi guys. Sorry, I tried to search my question and couldn't find anything already posted. Going off of ebenefits (I know it isn't always right), but according to it they upped me from 30% to 40%. Now, I have had to pay back severance pay since Aug 2010 and this Aug was to be my first VA payment that I would receive. However, because they upped me to 40% according to the va payment history portion there is a deposit for Compensation & Pension - Retroactive pay pending for July 31, 2012. Will this include my Aug payment at 40% or will they deposit that separately? Does anybody know? Thanks.

diabetes Re-Examination Likely?
Hi This is my first post, but I have read quite a bit. Thanks for the informative posts and all the help I have already received. I was VERY recently awarded 70% for PTSD. I have a previous 20% disability dating from about 1990 related to Agent Orange, so I'm 80% overall. "Agent Orange" gives it away - I'm a Vietnam vet, 62 years old. My question is - how 'permanent' is this PTSD disability rating likely to be? Will I be reexamined every two years or so? I have read quite a bit here on hadit about people being called in for re-examinations. My C&P for PTSD was no fun at all - it took me back through a lot of things that I try to avoid thinking …
