Need Help - Which Doctor Takes Precedence?
Hello everyone and Merry Christmas! I'm in the final stages of putting together a NOD - and thanks to all those who helped me thus far. I'm taking AskNOD's advice and putting appropriate CFRs in my rationale for why the RO wrongly denied service connection. However, I can't find an obvious CFR cite that covers which doctor they should listen to. In my situation, my ENT filled out a DBQ that said that my hearing loss was related to military service. My Attorney For My Appeals
I have an attorney helping with my appeals for an early effective date an his way of doing it just didn't sound right at first but it might work. He want the judge at BVA to make a decision'' without a hearing'' just off the evidence on file. I have never heard anybody going to BVA without a hearing but he said he have seen were a judges have tried to tie people up in their claim or catch you in a lie or something. He wants the judge to make the RO send it to Washington DC for extra-scheduler consideration and why it was not sent there in first place since I was consider to be unemployable from a back surgery alone. Va Form 21-0958 Not Availabe From Va Site; Veterans Unable To Use It To File Nod
Brought to my attention this week. The VA appeals form, VA form 21-0958, isn't available online so it's blocking veterans from filing appeals of their healthcare ruling. If you're on a Windows, Mac, or Android platform no matter whether you have the newest Adobe Reader software or not, you can't download this form. This is the VA form that all veterans who disagree with a VA decision on disability rating must fill out to start their appeal process. Hi, I hope everyone is having a great Memorial Day weekend. As always, thanks to all the Elders and everyone who make this place possible! I have to submit my NOD by June 18th, 2014 - soon, I know. I'm hoping Berta, Carlie, Bronco Vet and/or the others can weight in on how/whether to file my NOD. First, do I have a legitimate NOD for either or both: My OSA rating being combined with other ratings, when OSA is supposed to stand on its own? Seeking a 60% rating for CFS because the decision letter cites "no compensable symptoms"? Regarding CFS, my symptoms rise to the 60% level, as they stand all on their own. Decision Review Officer Or Traditional Appeal Process
I was awarded 30% 1 year ago. The VA only gave me 6 months back. I filed an appeal for an earlier effective date. In June 2008 the VA Cardiologist prescribed medication for my heart condition because he said it was getting worse. Then in October 2012, I had a heart ablation, by a private doctor and hospital for my PSVT. The ablation was partially sucessful but I am still having episodes of PSVT, but not as severe. My Cardiologist says I will probably be on my heart medication for the rest of my life. Because of this ablation, the VA awarded me 30%, which I am very grateful for. Bva Decision And Whats Next?
I am currently 30% service connected with three separate issues each getting 10% rating.I appealed two of the original decisions because it was clear to me that my conditions warranted a higher rating. So, after years of patiently waiting I received my packet in the mail last week with the BVA decision and it stated that one of my service connections is going from 10% to 30%. The other one was still denied but noted. I am curious of what happens next? Will my overall rating increase? and how long should I expect to hear anything?

ptsd Someone Help Me Plz With This Mess....! Need The Gurus!
So I am retiring from ARMY with a disability of 50% (PTSD)... which the VA came up with. At the same time I had an appeal for PTSD with the BVA. They granted it and sent it to AMC(AMC rated it). I talked to my VSO and she can see rating of 30% for PTSD. How the hell are they going to give me 30% for PTSD when they already gave me 50% for military disability evaluation. What should I do when I get notice? Shout I do a reconsideration or maybe a CUE? It is clear that they made an error and did not review all the evidence. Now I am gonna have to wait forever again to get what is owed to me.... at least 50% .

Question About My Claims, Please Help !
I just recently joined this site, and happy to see all the brother and sister here helping each other. Can someone please help me with my question. I just have few question about my claim, First, since I keep going in and see doctor for my headache, back pain, feet and other problems, now the doctor setting me up to see a doctor for Fibromyalgia, but I been told that if you have so many symptoms of Fibromyalgia ( that have already been SC) that the VA will group those individual ratings together for 1 rating. How long does it take for the AMC to rate a BVA grant of service connection. My VSO<IRIS inquiry<BVA all told me my claim is ready to rate at the AMC. No clue y my RO is not doing it.

Remanded Again To Amc
Hello all I am back, once again my case was remanded back to the AMC from the BVA last year i went through the same thing. The BVA remanded this case again because the AMC/RO refused to send me a SSOC or SDOC , from an August 2007 CNP that was in my favor "the term as least as likely as not" used by the Doctor in the 2007 CNP. The above CNP is connected to a 2003 appeal of a non compensable case.
