Dro Hearing Waco
I filed my NOD and requested a DRO Hearing and haven't heard anthing back other than they recieved my NOD. I filed this with the Waco office. I wanted to ask folks who have been through the process how long it took them to get a hearing. Or if anyone has experience with the Waco office specifically what the timeframe is like dealing with them. I was given the impression that a DRO Hearing would typically be completed within 4-6 months but that doesn't seem to be the case. Anyone have any idea?

Who Decides Service Connection?
Hello everyone! Question-My case for Service Connection was sent from BVA to Appeals Mgmt Center. They in turn sent me a request for additional info to decide SC, which I sent back to them within 30 days. Then about two weeks later the sent me a letter stating they had ordered an exam at the nearest VA facility. Does this mean that the Appeals Center has decided the SC matter and are now sending me for the rating portion, or is SC decided by the rating team for appeals from the BVA? I think I read somewhere that decisions are handled a little differently if they are sent back from BVA??? Thanks in advance for your response, Blackbird

Nod/dro Va Obligations
I have submitted a request for reconsideration to the VARO. They responded by requiring me to choose between the "normal appeal process" or the DRO Process. I selected the DRO process. They acknowledged this choice in writting. I then requested a personal conference with the DRO and submitted new evidence. I started the NOD request on 29 june 09. On 24 August I received a decision on 2 claim items that had been deferred and a rubber stamp denial of my lumbar injury denial. Completely in contradiction to submitted evidence, in writing from their Neurologist, on his stationary, and the approval of a fee basis epidural injection, which the VARO has denied ever happened. …

What Is The Difference?
Im not sure what the difference is between a NOD.. whatever that stands for.. and a Appeal?? I do not know which one i should use for denials? If i got a diagnosis in the military will that be good enough for service con,or do i have to get a diagnosis out of the military?If i got service con. but do not agree with 0% how can i fix it? They said when i have my headaches i dont lay down but i do and i told the Dr's when i got out and they put it in the report that i lay down so i don't understand?? Can anyone please help me understand this better. thank you

I received several SC approvals and 1 denial. I requested a reconsideration. The VARO responded by requiring I choose between the normal appeal process or the DRO process. I chose the DRO and requested an in person consult with the DRO. The VARO acknowledged the DRO selection. The next thing I receive is another denial completely ignoring the additional new evidence I had submitted, being a copy of an approved fee basis epidural injections and a hand written list of lumbar problems and options from the neurologist consult, which ranged from surgery/injections/PT/Medication. The denial stated the Neurologist stated the pain was not sufficient for injections and surgery.…

Conformation
Quick update, I recieved the conformation letter from the RO explaining the process. It stated that it could involve a informal hearing or request for additional information. It did not give me the option for De NoVo or formal hearing. I did request a formal hearing with my NOD. so its hurry up and wait again.

Question About Appeals And Wrong Diagnosis
I will try to make this short. I am a combat veteran (CMB), infantry medic to be exact. I was in Iraq, July 2006- October 2007. I hurt my back and was service connected for lumbar strain at 10% in Jan 2008. Now since then I have been on profile for the same problem. I am in the Florida Army National Guard. I basically can not run. Feet fall asleep and go numb and my back just becomes unbearable. Walking is a chore sometimes, as is standing for long periods of time. I usually wind up bed bound for 2 days after trying a pt test. Since then, I have followed up with the VA outpatient clinic here in Tallahassee. Migraines? 0%
Im going to appeal the 0% migraines they gave my husband saying he was not Posrtating. We have told every Dr he has seen that he has to lay in the bed in a dark room?? Only one has said anything about it in his report.. this is what he wrote"Pt tends to turn off all the lights, reduce any noicse, lay down in bed and tries to go to sleep when he is experienceing a migraine. Completing A Nod
I recently received my rating for migraines. The rating was 0%. The rating decision stated I did not suffer from prostrating episodes and the examiner stated the migraines do not affect my work. This is a total contradiction to what I put down on my claimant medical history form I turned in to the examiner during my C&P exam. It was also contrary to what I stated to the examiner. I am going to send in a NOD. I'm just not sure what to include in the NOD. I have a copy of the Claimant Medical History form I filled out (I try to copy everything). Would it be a good idea to include this and refer to it in the NOD? Also, should I add new evidence in the NOD? I have …
