Nod Ignored
I filed a Notice of Disagreement on March 10, 2004. So far, it has been ignored. What can I do about this? I complained to them and the RO said my NOD was "interpreted as a claim for benefits". However, that statement conflicts with the evidence: 1) ON my NOD which was recieved by the Regional Office, it has "appeals" circled on it by a VA employee (although I cant make out the Employees intitials) 2. I have never received any benefits (nor denied any benefits) with an effective date of March 10, 2004. Any Advice? Can they just ignore my NOD or misinterpret it and get away with that? Thanks

Appeal To Bva
okay...HI, i have repeatedly put in a claim for S/C for a mental disability since 1995...served from 7/30/86-->10/15/87....got chaptered out (chapter 13) for unsatisfactory performance...gen/honorable...the reason for my admin seperation was because i was having problems (writing bad checks, missing formations, poor concentration, poor hygeine, started signing stuff John the Great, including my Military ID, was clearly manic...ect)...got sent to the dmha for suicidal ideation after a suicidal "gesture"... OD'd on tylenol...went for 2 or 3 therapy sessions...went awol...3 weeks after suicide attempt...for 3 days...this was on 08/21/87...showed up for my scheduled therap…

Notice Of Disagreement
I had a C&P exam for major depression secondary to service connected knee disability. The doctor stated my mental condition was exacerbated by my physical condition. The doctor stated my GAF was 65. Even with this evidence the VA denied my claim. They stated something about alcohol in remission. Does this makes any since to anyone. My doctor states I might have been an excessive drinker but never an alcoholic. I haven't had a drink in 15 years. Does this make any since to anyone. I appeal the decision. Questions About 2nd C & P Following Nod
I tried posting this on the wrong forum I guess, had it under the "how do I" forum, hopefully posting it here will be more helpful. I had my first C & P exam in Aug of 08. I was rated in Oct 08 with a 10% rating on my back for: Residuals, back surgery with degenerative arthritis I submitted a Notice of Disagreement in Nov 08 and had a secondary C & P in Jan 09. I recently requested a copy of the C & P notes for both exams, (I had no idea I had a right to a copy). There are some big differences between the 2, and am curious what those differences translate into. Can someone tell me what the results of the second exam will mean in regards to my rating, or…

ptsd Here Is A Snapshot Of My Claim For The Last 12+ Years
I was injured in field manuvers in 1995 and ruptured a testicle, turns out it was a Saturday had trouble getting me out of the field for one reason or another. I was finally evac'd to a local civilian hospital for ER surgery and removal of the testicle. I then went to my parents home for what I thought was going to be a 2 week vacation minus one of the fellas. Va Appeal
hi again, I have an appeal hearing coming up in April. this is my first time going thru this and i don't know what to expect. my appeal is for GWI, Major Depression Disorder, Chronic headaches, respiratory, all of which i have current documentation and diagnoisis of. i also recently received my service medical records showing that i was hospitalized for four days after i got discharged from SWA. it also shows chronic headaches. i believe everything will go well. i just don't know what to expect. can someone give me an idea. desertshield/storm pamelab

Question On Nod
My friend Has a question. His question ? He has a NOD in a previous claim and wants to file a new claim but is concerned it might clog up his NOD. Will this have anything to do with it? or would this be two seperate things any advice to tell him would be appreciated. Should he wait for his NOD to come back, which who knows how long it will take i guess is the question? or just go ahead and file a new claim? thanks

Hello all, I retired less than a yr ago and have a rating of 50% Thanks to you all and your advise. When I recieved my rating, there where several disabilities I claimed that were not rated/not service connected and I would like to ask for a reconsideration review. I was wondering if anyone had any help in wording or could site previous cases. 1) Bilateral Breast reduction- this was recommended to me after a motor vehicle accident in which I was having severe back pains. The surgeons evaluations reads "C/O back pain due in part to a known post tramatic disc problem but also felt by her to be secondary to her large breast." The reduction was signigicant 38D to 38B.…

Amc - How Long Has Your Case Been There?
My service rep called me today and informed me that his man on the inside told him that AMC had recently cleared out the "old cases" 2003 and earlier, and were working on 2004 cases. Since my case is a March 2004 case, my eyebrows went up a bit, but I thought I would check here on the board and see if there were folks out there that had a pending case filed earlier than mine that was at AMC who have yet to hear any word in writing about their appeal. I want to corroborate that information with you and yours. Something tells me I can believe you more than them.
