Submission Of Nod
Hello, Well, I must say that this message is not a good one for me. I am really sad and disappointed,,, to the point of tears. :P On 11/21/2008 and 12/06/2008, I submitted inquiries about my claim through I.R.I.S. I did not get any response. So, I did the next best thing,,, contact my Veteran Service Rep. I emailed him yesterday to see what was going on with my NOD. -- He responded and said that he could not locate my NOD!!! this is how the email went: Sent: Thursday, December 18, 2008 4:17 PM To: "Veteran Service Rep." Hello Mr. "Veterans Service Rep.", This is "Tayo" again. I hope all is well. 1. I am writing again to see if you have a…

Mishandling My Claim
I have no new information to give them. Now after all this dialouge they are contradicting themselves by telling me my claim has to be cancelled and done over taking longer to continue my process The VA ;intially told me that my process would not have to be started over because of the mistakes made by the office in moving my folder and canceling my CNP exam due to them tranfering my folder I never asked anyone to move my claim so why was it moved and mishandled several times? I was in NJ they moved my claim ot NY while I was in the Montrose VA hospitalIs their a supervisor I can talk to and a phone number so I can call them and get assista…

ptsd Dro De Novo
I am wondering how long the DRO de novo process takes? is it any shorter then requesting a hearing? I dont think i need a hearing becuase i believe the evidence will clearly state how my ptsd has increased from the intial 10% bogus level I got to between 50-70%. I'm looking for the case to be increase now and if needed NOD it afterwards. I'm currently 50% comnbined (10 ptsd, 10 tinnitus and 40 bi lateral shoulders) I had C&P on dec 11 and file is already in the hands of the "appeals team" as I was told by an IRIS inquiry. the response said it could be 12 to 24 months, si this true for just a review?? I'm out of VARO Boston, anyone have ideas or comments? …

Using Iris To Get Nod Resolution
A reoccurring theme here at hadit.com is the lost NOD or the VA not seeing the NOD. I too had this same problem this past year and here is how I resolved the issue by using the iris communications.

lumbosacral Spine - Secondary Conditions
I am: 10% SC for degenerative disease, cervical spine; 10% degenerative disease, lumbar spine amd 10% tinnitus. I am appealing the ratings for the spine conditions and am asking for additional benefits for secondary conditions i.e. headaches and lower extremity pain. The secondary conditions have already been denied and I will appeal that decision as soon as my other appeal has cleared. How do I know what codes the VA used when rating my case? There is no mention of codes in the decision documentation other than a reference to title 38. I read a lot in the forums about trying to get a case rated under certain codes. How, for example, can I present my case for the second…

Evidence Submitted During The Dro Appeal
I handed the DRO a clinic note from a neurologist that ultimately changed my diagnosis. it conflicts with the rating doctors diagnosis. during- the following appointment I was injected with botox and this proved the rating doctors diagnosis to be incorrect. also 2 emgs/ncs were included with my evidence submission. one emg was negative, the other indicated and proved the diagnosis of the neurologist who diagnosed me with dystonia and treated me with botox. im uncertain that these facts are being considered by the DRO. also the x-rays of the vamc were read by UCONN who found results different than the VA. The report is in the file, but I am unsure if the x-ray cd…

Nod
I received my initial denial - dated November 8, 2007. I submitted the evidence they requested in the VCAA letter in June 2008, prior to the end of the one year deadline to submit the requested evidence. Though I have requested they readjudicate my claim based on my submission of evidence within the one year time-frame, they now deny receiving the evidence. Though I still think I have the right to have my claim re-decided (and remain open) as I submitted the evidence requested in the VCAA notice within the time-frame (and have a signed certified mail receipt - plus a copy of the IRIS I sent to let them know I had sent it) - I filed a NOD. I did receive a lette…

Speed Of Claims Process
My claim was put in AUG of 2008 and my exam was to be held in Nov of 2008 Does the fact that the VA has put my claim through so fast three months mean they have the evidence needed and does a faster process work in my favor.

Appeal Questions
Sometimes I get frustrated with finding what to call my disagreement, NOD, appeal, or reconsideration. But here goes, one claim for increase headed to dro (nod?) and one claim appeal submitted with imo (reconsideration?). What do I call each? Mixing my apples'n' fuzzy oranges, must be Friday! HA. tanks, :P :P :P B) Cg

Ssoc-got It Today
Got the SSOC today, apparently, the VA psych doctor who treats my husband saying he is at 70-100% isn't ENOUGH evidence to grant 70-100%. They denied again. What should I do now? They even read the NOD and said that the appointment that was on a Saturday happened because even though it was "input" on Saturday, the appointment happened. We have no record of it. Clearly, they (think) they do. Anyways, what should we do now?
