I was denied depression as secondary to my service-connected knee disability. Although the C&P doctor stated my condition excertabated my depression. The Rating Specialist stated the doctor said I had depression before I had severe pain. In my NOD I stated I had pain while in the military and had pain every since. So when did I developed depression, before the military? The DRO agreed with the Rating specialist and denied my claim again. My question is if I ask the RO how the C&P doctor came up with that conclusion are they required to give me an answer? Sick Of The Illinois Va
I am a regular Army veteran who was medically discharged in 2003 (after 3 yrs active duty), for L4 - L5 disc ruptures, plantar fascitis (both feet), and elbow tendonitis (no rating). I was given 30% disability for my back and feet and I have been fighting/waiting since 2004 for my rating to go up. I have been denied once, in 2006, and have been waiting for some word ever since. My back has degenerated to the point that my VA neurologist says I MUST have surgery, my feet have not improved, and my elbows are worse; I filed for a de novo review in 2006 and have been forgotten since then. Va Now States Error With P&t
When I received the VA's standard yearly I notice they did not have my P&T on it. So I sent them a letter through my senator asking them why this was not on it. (I sent it through my senator since my last four letters sent by mail for the clothing allowance they say they never got). The VA's reply is that I am not P&T and I am scheduled for a review in June. They also said if I was P&T I would not be scheduled for the review. So I sent them a copy of my award letter stating I was given P&T 6 years ago. I was already 100% IU before the DAV had requested the P&T rating for me. The VA replied that the P&T was in error. It has been six years now …

ptsd Question About My Appeal Decision
I received my award letter from DC granting PTSD 50% an increase from 30% with a retro date of Oct 05. During my appeal process I moved and changed VA reps. I told her all the info about my claim in DC. I was starting a new claim for migraines and Gerd and she suggested putting in a claim for my ptsd so I did. Is this new claim which was opened two months ago going to affect the retro date of my decision that I just received?

Evidence Missing From Decision
I received a decision on my claim for TBI at 40%. The problem is my neuropsychological exam I submitted from a private doctor was not listed in the evidence section or mentioned in the narrative of the rating letter. My question is should I just resubmit the the exam or do I need to file a NOD? The exam is pretty substantial. Would fetch at least a 70% if not total rating under the TBI criteria.

Fiduciary Program Not Working.
Where to start. For give my writing. I did not get much schooling I drop in 8th grade. My writing and English skill have all way been poor. there lot of things I did not put into this. because then I have to write a book. So kind of short summery. In 2004 I was finely award my V.a Benefits After 16 years of pursuit.since 1990 with the V.A. At first I was getting 10% then 30% then 70% , 80% then 100% then another 100% and incompetence. I am serviced connected 90 percent. I filed for TDIU in 07 based on PTSD 50%, and I received Social Security in Jan 09. for PTSD, depression, and Substance abuse disorder. I just received infomation from the VA I have severe Sleep Apnea (new claim). I filed the new evidence with the VA for service connected. What are my chances of beening approved for TDIU or just plain out 100 percent due to the rating schedule of 90 percent, plus 50 percent from Sleep Apnea is 100 percent total . Should I wait for the decision on IU, or file a new claim for 100 percent based on new evidence? Thanks

Effective Date Of Award
I have a question my original claim for increase dated 2/16/08 was increased from 0% to 10% 4/08. I filed a NOD 12/08 if I get an increase from the 10% what will the effective date be? Thank you, Bergie

tdiu My Case Is Somewhere Between Rated And Signing Off On
I appealed my case and elected a de novo review by the DRO.Got a letter saying(March 12)that they denied my increase for both knees,but ruled in my favor on my other issues.The other issues were lower lumbar,both hips,and TDIU.The local veterans assistance rep looked on his computor and saw that those"other issues" were indeed granted by the DRO.The 800 number also so verified.As of June 11th,still no white envelope.I am told my case is being calculated and signed off on.I am sweating this out,waiting for the white envelope.My question is,can the rater overturn the decision of the DRO.?Since I still do not have anything official in writing,I am worried that something will…

Need Advice With Lawyers
Hi, I have a law firm handling my appeal. The appeal has already been denied once. When I was handling it I wanted to get out of Region and into BVA ASAP. The lawyer's strategy is to work within Region as much and as long as possible. The law firm (a big one) has submitted a Form-9 but it doesn't specify anything. they say the form is not necessary, I forced then to send it but it isn't filled out, they say they submitted "substantial appeal," I guess meaning their "substantial appeal" letter is effective as Form 9. But see, I got screwed once on this same claim and had to start it all over after I waited 2 years for an appeal that never happened because th…

Remand Stall?
On May 18th, 2009 the BVA remanded my service connection claim back to the RO to have a 2nd Comp exam performed, this time the doctor is suppose to review my c file first. Today, June 3,2009, I got a letter from the "VETERANS SERVICE CENTER MANAGER" stating that it was their "sincere desire to decide your case promptly, However as we have a great number of claims, action on yours may be delayed". I'm new to this so could anyone tell me if this is just a form letter that everyone gets when a case is remanded? Also where exactly is the Veterans Service Center in the VA chain of responsibility?? Any thoughts would be appreciated!!!
