ptsd Appealed
I have a question, i received my rating in jan 09, i originally filed for it jan 08. I got rated 30%ptsd and 10% for a neck injury. I did not like my rating so my rep filed a NOD and had a De Revo and 6 months later i got a decision that did not change my rating higher for ptsd. Well now i just submitted two letters from treating physicians that agree i should be rated 70% for ptsd with a VA form 9. Now what should i expect in the coming months? Do you think i will have to do another exam, and if i do get an increase in my rating will it date back to jan 08 of my original filing. Thanks for any advice.

Request For Reconsideration
I sent a request for reconsideration to the VRO and got a confirmation letter, at least I think it's a confirmation letter. I'm a little concerned or maybe it's paranoia. The letter stated the following: "We have received your application for benefits. It is our sincere desire to decide your claim promptly. However, as we have a great number of claims, action on yours may be delayed. We are now in the process of deciding whether additional evidence or information is needed." The rest goes on with the normal stuff. The concerning part of the letter is the first part and no where did they state this being a request for reconsideration. Should I be concerned or is this …

Docket Date
Hello everyone... We have an appeal I'm told is in the "rating" phase at the AMC in DC. Have been told that this phase is basically a point of jumping back in line to have your claim reviewed. We have an original docket date from Jan. 05, wondering if anyone knows where we can find out where the BVA is in the docket? Does AMC render the decision, send it back to BVA, then if SC, back to rating for SC%??? What is the order? Rating to me seems like it should be rating but, it's apparently not with the AMC. Thank you's......

hypertension Should I Submit A Nod For A 0% Rating For Hypertension?
Should I submit a NOD for a 0% rating for hypertension? On one hand, I think that if I lost 50 lbs or so, my BP may not require medications and I have a family history of high BP so I don’t place blame on the military or the VA for having this condition. However, VA reps said I didn’t have it for my first 16 years of 26 in the military so I should claim it. So I did and because my BP was often but perhaps not “Predominately” documented in my medical records with a diastolic of 100; I was given a 0% rating. About 5 years ago, still on active duty, they doubled my dosage to better control my BP. Throughout the years, my BP would be taken, the diastolic would be…

Dro Disqualification
Hello all. Need some advice here. I filed a NOD on a decision that denied an earlier effective date. The RO held a DRO De Novo hearing. At hearing, we found out that the hearing officer was the one that had made the denial. It did not hit home that he should not have been officiating the hearing. A few weeks later, we received a denial by the DRO. We immediately filed for an appeal with video hearing. This past week, after a lot of research in preparation for our appeal, I stumbled across the requirements of M21-1MR, Part 1, Chapter 5, Section 13 ©, which stipulates that the DRO that made the decision of which was under review at said hearing could not of…

Settled @ The Bva
My case at the BVA was finally 'settled' on 9/8/09. Does anyone know what that term means? I tried to do a google search for the term on hadit.com from my phone last night but had major issues. So if this has been posted before someone can post the link as my response. Thanks bunches :P

Question On Appeal Calculations And Decision Reassessment
Wondering if increased ratings after appeals are subject to the weird VA math? I heard they are face value. Ex. Original overall rating of 50% with two 0% ratings which are later granted (after appeal) to 10% each.. so, the original 50% + 10% + 10% for a total of 70%. Is this correct or would I need the special calculator to figure it out?! Also, are certain ratings reassessed/reevaluated overtime/in the future simply because of being a high rating? Ex. 50% "Depression" could be reevaluated in 5 or 10 years for potential increases or decreases. Does the determination letter from the VA, under "Reasons for Decision", need to specifically state a requirement for future e…

Recieved Rating Today.
I recieved my rating letter today. I was rated at 30 %. Its a start I guess. I was MEB'ed prior to my retirement with a Macroprolactonoma, a large tumor on my pituitary gland. This thing did some major damage and is inoperable due to its location to the artery going to my brain and the optic nerves. I got SC but 0 comp for it. It partially destroyed the pituitary and the surrounding sinus bone causing migranes, frequent sinus infections, hormonal deficiencies, and a laundry list of other good stuff. All of these were SC but all were 0 compensated. I dont understand that process. I recieved the comp for tinitus and two issues that were discovered during my retirem…

Am I Legally Entitled To A Dro Review/conference
this is what I entered into the IRIS system attempting to obtain the following: Before I obtain an IMO and complete VA Form 9 selecting BVA hearing I request: 1. Statement of Case (were the two mailings referenced above the Statement of Case?) 2. I never received a DRO review that Is documented as requested. 3. I never recevied the DRO personal conference. So far all I recevied was another written denial. Am I not legally entitled to a DRO personal review and conference if requested, which I did? If not I will accept that and move on in the appeals process, but I would still need clarification on the Statement of Case (SOC) or (SSOC). This was my entry into iris …
