  4. so i've done some research on this question here's what i've found prior to the VCAA a veteran had to have a diagnosis for the claimed disability and the va had no obligation to help them get one without the veteran first proving the claim was well grounded which sent a lot of veterans through a bizarre maze where they needed a diagnosis but couldn't see a doctor. the VCAA makes it clear that the VA is now suppose to help you get to see a doctor to get a diagnosis after you file the claim. so it is true that you have to have a diagnosis for the claimed service connected disability, it is also trough though if you don't have a diagnosis you can file the claim and ask the va to assist you in getting an exam with a doctor to get a diagnosis. this is what my research has come up with. the law 38 U.S.C.S. §§ 1110, 1131. below if from The Veterans Benefits Manual 2007 edition and they explain it better than me i think. "Before November 2000, when the VCAA was enacted, veterans had to obtain a medical diagnosis of a current disability on their own. The VA was not generally obligated to help them in obtaining this medical evidence. 110 Some veterans, who could not afford a private doctor, were placed in a no win situation. They could not receive disability compensation until they submitted a medical diagnosis of their current disability; they could not get the VA to provide them with a free medical examination to obtain this diagnosis because veterans who already had service-connected disabilities were more likely to receive free VA medical care; and they could not obtain a medical diagnosis from a private doctor because they could not afford to pay for the private doctor. As a result of the VCAA, most veterans who file an original claim for disability compensation do not need to obtain a medical diagnosis on their own. 111 The VA is generally obligated to provide veterans with a VA medical examination to diagnose the current medical condition. There are only a few legitimate reasons for which VA may refuse to schedule a VA medical examination." Veterans Benefits Manual

  6. well this thread seems to be a hot button for a lot of folks. would someone post the 38CFr law and the requirements for filling a claim for disability compensation, just point us to the law and then we will all know. we don't want to give bad advice here, nor do we want to let our hot buttons get pushed, disagreeing with each other is one thing, and disagreements about the law can easily be settled by just referencing the law. also it serves no one to put down another poster, i believe we can all use a more professional tone with each other when we disagree, and like i said if it's about the law just post the law. tbird

  10. here's a question and i'm just not sure what the answer is, anyone out there want to take a stab at this? if you receive retro pay, non-taxable to you, and then you in turn gift it to someone else, will that person then be responsible for taxes on that gift?

  15. i've been on celexa for years now it works really good for me but i do take 80mgs a day, it's a high dose but it gets me up and moving about, and it works better for me than anything i've taken so far, i also take atavan for anxiety, but the celexa is the one that keeps me going. don't forget to reorder the withdrawal sucks.

  19. after years of being in the system, i came to accept that the va would never give me validation only compensation, so i get the validation at the therapists office and compensation from the va. it is what it is, it sucks.

Putting together a database to show rankings for Veterans Service Officers, we use to have one, but for reasons beyond my control that database broke and i have to recreate a new one. so the question is what questions should be on the form. they should be questions that can be answered on a scale of 1 to 5 - 1 being very poor - 5 being excellent some of the questons i thought of are On time for appointments? Returned phone calls promptly? Satisfactorily answered my questions? Paperwork filed on time and correctly? Attitude towards me and my claims? please add any other questions you would like to see, remember to phrase so that the answer can be on the 1 - 5 scale or a yes/no answer. once we get this one designed and working i will create another one for VARO rankings. thanks
  21. i am waiting for att uverse in my area, i am hoping it will have more stations with stuff that i like to watch. the computer, the tv, and books are the only things i do and am always trying to fill my time. i am thinking of getting one of the those Kindle devices that allows you to download books, i think that may be good for me since i never seem to leave the house to browse books and also would think it would cut down on book clutter.
