My name is Linda. Alex agreed to help us with my husband aid and attendance claim. After zero help from va and other veteran organizations, my husband found Alex on this forum. Although we have been difficult at times, Alex has been on our side and shows this wisdom in all communications. We trust him and know our appeal will be eventually grAnted. We also believe Alex will endure my husband receives every benefit he deserves. Happy new year to all and when you are at wits end with va, you have a sincere and strong advocate with Alex.

My PTSD and Back just increased to 100% Permanent effective 12/1/17, along with SMC S. Only took 6 wks from start to finish with this claim. I submitted PTSD DBQ along with other evidence as a FDC claim. Thanks so much, and I really appreciate all the support from Hadit. Been a long couple of years, but I am so grateful for you guys, and the fact the Military and Govt is admitting what they put me thru.  Hope you all have a Happy New Year, and God Bless!!!

Success because of Hadit and its members. I would like to say Thank You to all that post their stories and to those that share their knowledge on Hadit.  I received notice of my award benefit for TDIU P&T at the end of June 2017. Received deposit into our account last night. E Benefits confirms TDIU P&T. Still waiting for the BBE.
I started this journey in Jan, 2015. By May, 2015 I had received notice of award at 70%.  Shortly after I received notice of award on a pending issue and award went up to 80%.  May 2016 filed NOD.  May 2017 received award to 90% and also my SOC.  Requested a RO hearing and submitted more evidence . End of June heard thru the grapevine that award was imminent and it would be P&T.
Looking back its been unbelievable to have received this gift from the citizens of this great country . THANK YOU HADIT and all whom take their valuable time to help others.

I had a very bad habit of checking E-benefits almost daily. Yesterday I was shocked to see I had been awarded 100% P&T. If you are going to be addicted to E-benefits take my approach, "don't get upset and never expect anything" it will come eventually.
Today I want to say thank you to so many people on this forum for responding to past posts I have made and also to the ones I just learned from reading theirs.
I am truly blessed that in comparison to so many, my NOD for increase was decided in two years and a week. I know that many have been waiting longer, but NEVER GIVE UP.
Now I have to find out what all the benefits are that comes with this award. I know they vary from State to State and I am in SC. I am going to need to get ID cards for the wife and I, now she won't have to wait until our daughter is in town before going to the commissary LOL.
I just want to say God Bless you all and I will still be lurking around. I truly am still in shock!

ncjoe1970 reacted to pepperD in Success! Finally Sleep Apnea Approved @ BVA
I must thank the Veterans on this forum for sharing their stories, successes and wisdom.  My appeals at the Veterans Board of Appeals finally granted my claim for sleep apnea.  It's taken 6 years and 3 C&P run around to finally get a favorable decision.  The advise provided on this forum kept me motivated to stay with it and not back down.  BVA's last attempt in July 2015 to close my appeal was thwarted by my refusal to give in.  I disagreed with their "findings" and was able to prove that the C&P examiners were not considering all evidence presented.  My first C&P examiner flat out refused to acknowledge sleep apnea even though my record stated I had mild-sa, but I wasn't on a CPAP.  Forward to 2014, I got a Nexus from my private doctor that stated in his medical opinion, symptoms I was experiencing in 2007 were the same I was currently having.  Testing confirmed SA and CPAP issued.  Follow up C&P doctor did everything he could to contradict the test results.  He even went as far as to recalculate the math and his number came up less than what the Sleep test showed.  (Beware of doctors at Jackson, MS C&P clinic) they have screwed up 2 rounds of C&P's.  When BVA came back to me in July 2015 and wanted me to agree that my claims should be closed, I did more research, got 6 months worth of CPAP usage data together and filed a VA Form 9 and pointed out everything the Dr. at Jackson VA did that wronged my claim.  I pointed out the facts of my case again, 4th document to BVA, same subject. This time the Vet Law Judge concurred with the evidence.  The nexus letter from current doctor, though it was overlooked previously was mentioned in the letter from BVA.
Now the waiting game again while the AOJ in North Carolina re-adjudicates my claim for all the other items they failed to properly award compensation.  Though I may end up with another C&P exam for my lumbar spine, I feel much success finally getting to this point.  All the Vets that post their questions, cases and opinions on this site certainly helps other like me to see and stay motivated to fight VBA for what they deserve.
I'm not done with the fight and will continue to learn from advice on these forums.  For those Vets that just received their first statement of case and feel they've been handed an unjustified low compensation rating, I say to you, dig in and fight like a Vet!  It will be a long time consuming fight, but with the help of this forum you will get what is due to you so don't be afraid to ask for help.  The Vets on this forum have years of experience and many have fought and won numerous claims that VA originally denied.

I jumped off the board while I worked on preparing for my DRO hearing, this board can stress me out at times. Here's my timeline
10/2015- applied for VA benefits based on stage 3 MM/ caused by chemicals (benzene/TCE's) I am NOT qualified under Camp Lejune/ Vietnam AO or Radiation.
    12/2015- recieved denial from VA
2/2016- turned in N&M along with a DR nexus (I did NOT pay for, it's from my treating oncologist)
3/12/2016- recieved letter of DRO hearing on 3/22.
3/22/2016- DAV Rep called me at 0730 said he got a call from the DRO who told him I do NOT need to bother coming in for a hearing, my evidence was overwhelming and he had already approved my claim.
3/23/2016- ebennies changed last night, shows I have no "claims in progress" and it is now in Historical Claims, shows a descision made and talks about verifying my dependants. I saw the letter that is coming in the mail.
6 months from application to approval. It is possible to connect the two but you really have to have your gear wired tight.
My Hadit mentor was/is Gastone. He has been a good friend and a wealth of knowledge. If it had not been for the little things, like making my statements Sworn Affidavits etc I'm not sure my stuff would have looked as good as it did. Good enough where they balked before the hearing.
I post this for my burn pit cancer vets, you can win if your outside all these presumptive time lines, just follow the science and talk to your oncologist, once I explained what a nexus letter was she was more than willing to help.
Thank you hadit for the board, and thank you Gastone for your help, friendship and ear for all those times I bitched.
And finally props to the DAV my VSO, he did me right he actually studied up on my disease so he knew what was up. Thank you! And the VARO, I have read horor stories about the VA. I'm a boot, this is my first and only claim. I was really flying blind but the VARO was fast, attentive and they really did good service, faster than SSDI. So you won't hear this often but thank you VA and DAV, this is a feather in your cap.

    Tbird, this is terrible news!
I remember when Carlie first came here many many years ago as a novice to the inner workings of the claims process...and then she became so valuable to all here with her incredible help and dedication to her fellow veterans, and her excellent posts and advice here will continue to help others.
The last claim she had was a hard one to win but she did win it and it gave many here hope.
I will ask my prayer group to pray for her today. And I urge that we all pray for Lucy too and the difficult road she has ahead with dealing with this.
Carlie was concerned that Lucy would be eligible for DIC if she died ,and we discussed that here earlier this year, when VA posted the new  same sex marriage DIC criteria.
But Lucy isnt thinking of that, she is dealing with a very difficult decision and that decision will bring Carlie Peace with Honor.
I never thought ,even though Carlie has been ill, I would read something this sad today at hadit.
It is very heartbreaking. She did so much for others and will never ever be forgotten.
    May God bless them both.

Many of you awesome people on this site have been following my journey and offering encouragement and support along the way, and for that I am truly grateful.
I was granted TDIU with  P and T with no future exams scheduled. In the end it turned out to be just what I predicited it would be.. A mexican standoff ending in  negotiations with a favorable outcome.. I would like to thank my awesome benefits agent Mr.John Dorle for his epertise in getting my complicated claims sorted out in such a way that we could muster up an effective plan of action.  John  noticed some very key aspects of my claims that put us in a very good position and we were able to make lemonade out of lemons.
I would highly reccommend John Dorle to anyone struggling with thier claims and want to get on the right track, to success.
I learned many things on this long journey, and one of them is that you cannot take the VA s word for it that they did things correctly ......they make MANY mistakes.. These mistakes can be very valuable to you in your quest for benefits. Sometimes we get so engaged over specific issues we miss the big picture, we miss the specific things that will win the claim and VA  certainly isnt likely to point them out to you.. Theres SO many people on this forum who helped I will not try to recall all, because it wouldnt be right if I missed someone,  I will just say, THANKS  to all, from the bottom of my heart.
God has been my rock, and I believe he led me to this website.
TBIRD,,,,,,,, be looking for a nice little bump to your paypal acct. the retro should hit the bank very soon, and  its the very least I can do to show my appreciation for the hard work you do to keep the site going.. God bless you !!!! If I had not found this site and the GREAT people on it, I would still be wandering aimlessly, in the darkness and confusion.

ncjoe1970 reacted to Berta in 1151 Hbp Award Letter
Yesterday I received my 1151 HBP award letter

I might have mentioned the RO call I got on this last week but I never pay too much attention to RO phone calls.

    I LOLed at this: :

    "Dear Mrs. Simmons,

We received a request to reopen a previous claim on March 27th 2015."

That was the bogus denial letter I got in late March and I raised Hell right away.
    "What we decided:

"Hypertension for accrued benefits purposes granted 10% EED Aug 9, 1992."

They actually read my evidence this time.

They state that no additional accrued is due to me.....

That would only be true if they fail to properly 'reopen' the other March 27 2015 bogus denial of my CUE claim.

In that claim (a CUE awarded in 2012), they paid only 6 months of 1151 accrued. They owed from Aug 1992 to Oct 1994,100% under 1151 , plus 2 dependents, plus SMC, but aid only for 6 months.

I know my husband would be proud of me for trying to finally get this all properly rectified.

He made me promise to do that if they killed him.20 years ago ...and 4 hours later he suddenly dropped dead..

I have had many award letters over the past 20 years (all after a battle) but I DONT really win anything. My husband does.
I am just his voice from the grave.
And hopefully his victories will help other vets who VA has committed malpractice on.

Free_spirit has been the voice for her deceased husband.too

A different situation then mine but nevertheless,
it is evidence and perseverance that awards claims.

1151 HBP due to lack of proper dosage of lisinopril compounded by 6 years of Sudafed, presxcribed 4 times a day for a condition (still rated at 10% maybe I should file a claim on that He He)
for a suinus condition he didnt even have,
as one of multiple " deviations" in VA's lingo , in a standard of care ,
    that caused his death.

I say the worse CUE claim is the one that is never filed.
That goes for 1151 claims too. (And FTCA claims in some circumstances)

We cant just get denials and spin on our thumbs over them.....VA does enough of that as it is. to generate these bogus denials.

Just so you know it's not how bad something was but how it affected you, so don't feel that someone else should have it and you shouldn't because your service wasn't that bad. My Mom always said she'd sent a sweet, caring, young man, to the Army and she received a bastard back, when I returned home, from Vietnam. I feel that PTSD affects mostly caring individuals. Your symptoms are classic. Just know it will never be cured but it can be managed, if you get treatment soon. I no longer go into a rage, like I used to. It's taken awhile but I am soooo much better than I was before. You may need to take some meds, to help, for a short period of time, but if your family supports you, you can have a somewhat normal life.
