Navy4life reacted to Buck52 in Waco DRO review hearing - anybody want to weigh in???
No I don't think it would be inappropriate to PM him
but he may not notice it?
You can direct your post to Him...in a post and he would see that (Navy4life>Meddac)...
He is a nice guy and has a lot of information we all need and him working at the R.O. he knows a lot of do's and don'ts.
He probably could give you some information that us others could not.

There was a change in the law for a request for Reconsideration at the Regional Office level dated July 2015, however your claim is too close to the one year cut off for filing a NOD and it is better for you to file the NOD before the one year is up.

I looked at this and suggested you file a NOD even if the old one was previously withdrawn, and there was Chris Attig, saying the same thing, but better than I could.
I will add, when you do (re)file the NOD, do so within a year. And, if possible, have the decision with you,
and, refute the reasons and bases for the decision. I also like the DRO hearing idea, and this may be a good time to look into legal representation.
In all cases, get a copy of your Cfile.
Finally, dont expect much from your congress critter.
Someone once said if "Pro" is the opposite of "Con", the what is the opposite of Progress?
Answer: Congress.

Navy4life reacted to DevilDog12 in Fully Developed Claim question
Yes I am. Under the direction of my VSO. We had a long discussion, and he went through my STR's, with my permission of course, and asked why I never filed for Tinnitus, my foot injury (required surgery), Skin Condition (Folliculitis), and Painful joints. Also stated that I should apply for an increase of my 30% rating for Migraines, since my VA treatment records basically meet the criteria for 50%. Yes, I am 90%, but this is still all new to me. I filed my first claim in April of 2015. So he did up all the paperwork for me, and we filed away. So we will see what happens. Right now, I am at 90% (89 total).

Navy4life reacted to DevilDog12 in Fully Developed Claim question
Yeah, it was kicked out of FDC status, but I'm not worried about it. I filed the claims, then a few days later, it went to Gathering of Evidence, and they called me to schedule C&P's. So it seems like it is moving pretty quick.
I hope you hear something in regards to your NOD decision soon!

Navy4life got a reaction from flores97 in Fully Developed Claim question
I had a traditional claim start May 2013 - got a partial award June 2014 - then final award with denials in November 2014. Filed an NOD November 2014 and had my hearing in February 2016. Still awaiting the results of the NOD hearing.
Filed an FDC twice while my appeal was pending and both separate FDC's took about 3 months tops for me.

Navy4life got a reaction from Gastone in C&P Exam for PTSD increase - might have backfired!
Well UPDATE on this thread!!! My thread is a PRIME example to NOT draw conclusions from a C&P exam!!! I was granted 50% from 30% yesterday. I was completely shocked and happy at the same time. I can't wait to get the decision letter to see the reasoning behind it.

When you fill out the NOD, be sure to state you request a DRO Review Hearing! If you do not put this on the NOD they can review the NOD and evidence w/o you present. You are your own best advocate so the hearing is what you want!
Most importantly....STAY in TREATMENT for the PTSD!

Ebennies is notorious for being inaccurate. Just wait until the claim closes or check with your VSO or DAV rep if you have one.

Navy4life reacted to Stardust in C&P Exam
Thanks for your feedback Navy4life.
I actually have a copy of my meds physical and my feet were fine before I joined. The only issue I had was I was underweight so I had to get a waiver. When I actually got a chance to see what was written I was pretty pissed. It's almost as if she made up whatever kind of answer she wanted. I will let you know how it goes tomorrow. Not looking forward to it at all.

Navy4life got a reaction from jfrei in Two months and counting since DRO review hearing
Well most here know my situation.....It's now going on two months since I had my DRO review hearing. I talked to my DAV rep today and she said "this rater" takes his time and not to expect anything for at least 90 days if not more. There is a "completion" date in the system of 9/28/16 so it's just the waiting game at this point....
Hope everyone has a great weekend!

Navy4life got a reaction from Andyman73 in Now what?
I understand you want the S/C and the retro/back pay but if they won't give you the S/C then you should file for secondary service connection.
The decision is not favorable for direct s/c but since you are now s/c for the Asthma, the secondary s/c is an option. I agree, go ahead and ride it out but in the end if you lose the s/c, then all this time you have lost the potential secondary s/c right? Just a thought....
