  2. congrats! just remember, now it goes to your varo where they decide the final dates and back pay etc...the 1-2 months is a lie just an fyi. i was awarded 100% on May 20th and was informed by iris it may be several more weeks til completed. you know the motto...HURRY UP AND WAIT! now must have patience.
  3. I hate to say it, but they can take it. They do tell you at separation and during that process that if you file a claim within a certain period of time, they can recoup any separation pay from you. It's the way they tell you that many do not understand. They did this to me also and yes got their money back. It is not a loan you sign but the final paperwork during the final processes when you sign that MEB which I was also MEB out. Is it legal for them, YES...doers it suck ass for us, YES 100%. I got out in 1999, got my first claim rated at 10% 2005, finally rated 100% in May by judge( still waiting in final VARO letter and back pay). All back money for me paid off years ago though. Just be happy and feel lucky your fight is over.
  4. No. The VA will not pay but any good VA lawyer will not take any money until your case has been won, then most are a standard 20% of your back pay. Well worth it. I been fighting for over 20 yrs. Was stuck at 80, in May was awarded 100% by the BVA. Still waiting on back pay and final eff date/back pay amount from my VARO. "1. can i submit any new evidence at this time?" I believe...BELIEVE it depends on what stage etc. I know once my stuff was at a certain point no more was allowed. I would contact a lawyer. I used Woods and Woods. Great people/staff.
  5. Judge granted mine on May 20th. Still waiting. No letter from VARO or ebenfit updates. Still being paid on old scale instead of 100%. Tick tock hurry up and wait.
  6. Thanks for the response! The judge on May 20th approved my 100% TDIU claim. That is what I am waiting on now. The RO to decide the date and determine the back pay. I have been fighting for over 20 years. Got Woods and Woods about 18 months ago. On week 6 of the hurry up and wait for the RO. We already know due to a law change I will get screwed and they will only go back to 2017 but its all good. Just want it over. Hopefully yours will end this year also. It sucks how many hops and bullshit we have to jump thru. Luckily tho I was already at 80%.

I use Woods and Woods also and waiting on backpay, judge granted me my TDIU on May 20th but my RO is Phoenix and they are slow, my question is.... so you got your money from the VA itself and it wasnt sent to the lawyer first and then they issue it to you? Was curious how that process worked. I was under the impression ALL money went to the lawyer and then they sent us our share (so to speak). Am I wrong? If so, that makes me very happy that it wont take even longer for more people to touch it it and sent it out to me.
  8. That sucks! Sorry they are doing that to you. Mine was at the BVA so the judge granted my 100% TDIU and the RO has to assign the effective date to determine back pay. Dont give up trust me. 21 yrs later...21 yrs..oh man I never thought this day would come. I finally hired Woods and Woods. They are great. File the TDIU paper work yourself asking for it.
  9. Still nothing here. You RO must be way faster than mine..but mine would be Phoenix. I already know they will be screwing me and only going back 3 yrs. Just shy of 6 weeks now. How bad did they screw you??? Due to a law change in 2014 is how I am being screwed. But after 21 years of fighting I am just ready for it to be done. Now give me my final letter I am so done with this hurry up and wait bullshit lmao.
  10. Still nothing here. No update on ebenefits or a letter. Maybe today will be my lucky day...doubtful though. I figured if ebennies doesnt update today, then come the 1st, it will still be the same then also. How many times can a person check that site a day...HUNDREDS lol. Good luck.
  11. Your award had nothing to do with Anthrax as they denied it..and always will. I have the actual lot form from one of my shots showing I got bad anthrax, and have family history of diabetes (documented) where even the anthrax vaccine insert states do not give to family history of diabetes people. They even tried to first diagnose me with Gulf War syndrome..one problem with that. I never left Ft Bliss. Never served in the Gulf...and this is happening to many veterans who never went overseas but are being diagnosed with gulf war...cuz gulf war doesnt exist it is all ANTHRAX!
  12. Well as a veteran who for sure got bad lots...even have the record that proves i received a bad lot...they are never going to pay us for it. 21 yrs I been fighting them over it. I have stage 3 CKD now. Even the anthrax insert states do not give to people with family history of diabetes..well thats me, and yes medically documented in my family for a few generations but i had to get it anyway. Its all good tho..karma will come for those who forced it on us...and i will laugh and laugh when it does.
  13. the tinnitus is the MAX they will give..i am shocked they gave you 10% for the hearing loss..mine is stuck at ZERO even tho they issued me a hearing aid. they love 10% for knees also. if they are going to give you a final degree of 100% then honestly just be happy. I have been fighting for 21 years and finally just got my 100%. VA love common core math. the headaches/migraines was the hardest fight for me...they didnt want to admit it was caused by the mandatory anthrax vaccines even tho i started complaining from day 1 and its proven i was given the bad lot. at 70% they treat you for everything anyway and not just service connected disabilities. congrats....
  14. I am wondering the same thing. The 15 day rule does not apply to a BVA hearing. My claim was granted on May 20th and still no updates on ebenefits, nor any new letters for the commissary. Letters still state the old rating and pay. VA.gov states 100% rating for individual unemployability If this decision changes your disability rating or your eligibility for VA benefits, you should see this change made in 1 to 2 months. The only letter received so far is fron the BVA themselves. Still no letter from my RO telling me what the effective date is or any other info.
