  4. ok, I'll get them posted; may take a minute since it is 12 pages long. Also, I asked for an increase for these conditions and never appealed the initial ratings on them since they were going to be "re-examined" to determine yada, yada, yada....
  5. Thanks for the response; one correction on my rating. I am SC 0% (zero) fot c-spine and 10% for low back pain with herniated nucleous pulpous. For both conditions on the original decision back in 2005 stated I would be scheduled for re-examination because the examiner "did not discuss whether there is likely to be decreased range of motion or functional limitations with repetitive use". Well, it's been 3 years and I never heard from VA on the exams. From this info, if an increase rating is granted, the EED should apply in my opinion since they never contacted me with a new exam date on these 2 issues.
  6. Already SC 10% for c-spine; was involved in a MVA back April 08 and started having spasms in neck which reinjured an old MVA from when I was on AD. This is the last page from a C&P done in June 08 for spine increase, which also says on the front that "C-file was: not requested by VARO, Medical records were: not requested by VARO; comments on records: VISTA CPRS REVIEWED" (what ever that means)! B) The attachment also the beginning (first page) of a C&P from April 06, and as you can see, it says, "REVIEW OF MEDICAL RECORDS: No C-File to review" and it states that throughout for each condition that was examined; some of the examined issues where SC at what I thought were the appropriate level; several others were denied because some of the data the examiner listed in the C&P was just plain wrong and not what I told them. Just two brief questions, 1) based on the spine diagnosis, what are my chances of an increase for the spine? 2) Can I challenged specific areas of the April 06 C&P exam results or would the entire exam have to be challenged? I should have requested this long time ago but I didn't know about it until I found this great site with wonderful fellow Vets in February 2008 this year! B)
  7. Just sent my IRIS complaint too about the "picking up and hanging up" after 3:30 pm; I'll post the response I get when received...
  8. The part that Carlie listed is exactly what I was talking about; thanks Carlie. Majik, the picking up the phone and hanging up must be the norm any time after 3:30 pm because it has happened to me too and it needs to be addressed. I would think that I lost the connection on my cordless, but you just confirmed that it is not my phone. And then to have to listen to the recording (Yulk); but Ron gave advice in a recent post on how to get around that. I will send an IRIS complaint about the phone issue (picking up and hanging up) today. If they don't want the job that my tax dollars are paying them to do, then dammit, they need to quit or resign. :P
  9. Majik, in my opinion, I would try to get a copy of that letter the doctor is talking about or ask to read it for yourself if you can because this could affect your claim if it is true. Also, if you can't do either of the above, I would do a sworn statement or notarized statement quoting what "Doctor X" said about me making someone mad as this may help you later. Reason I would do this is because I've read on the VA website where it says the VA employees must basically treat each Vet with courtesy and respect, even if the Vet is angry, mean, or rude or something to that affect. Again, just my opinion.
  10. Carlie, I didn't know that about the 50% or higher SC # as I thought it was only the SC treatment that was not charged. Thanks for that info. :P
  11. In my opinion, the 30 days should not matter. Remember, we want the VA to stop moving like mulasses and "timely" process claims. <_< <_< :P I am reminded of what John Roche stated in his book about preparing a "well grounded claim" and to "collect your own evidence" to submit with your "well grounded claim". Doing this should present no problem at all and the 30 days would not be an issue. I welcome the shorter 30 day turn-around timeframe.

  13. Interesting subject; however, if the Vet was to use a recording device, would not the Vet be obligated to inform the examiner that a recorder is being used? Correct me if I'm wrong, but in general, I thought that the other party had to at least be made aware that a conversation is being recorded in order for it to be admissable in any court, and potentially, a Vet's claim could go to the Veterans Courts or the one above it. Just thinking out loud... :P
  14. Ron, this is great as I have gotten confused on several occasions calling the 800 # and trying to work my way through all the prompts. I'm printing this one for the future and hope the VA don't change it. :P
  15. I make it a point to send a compliment via IRIS when my spouse or I get good service from a VA employee, be it a doctor, nurse, examiner, the 1-800-827-1000 service officer, or the cashier. In my opinion, with all the negative press out there for the VA, I'm sure the really good employees who are honestly trying to make a difference appreciates it. :P
  16. Had procedure last year; report show post op diagnosis as "irregular appearing ileo-cecal valve (biopsy), hyperplastic polyp, and colonic mucosa with prominent lymphoin aggregates". Doc called and said he removed some polyps and the test were negative; repeat test in 5 years. Already SC for hemmorroids (0%) and GERD (0%). Since this procedure, the "irritation" of the bowel area has significantly increased. My question is, 1) are any of the SC conditions mentioned above related to this procedure, 2) or is the procedure and after effects separate, 3) anyone know what is meant by "irregular appearing ileo-cecal valve", is this a ratable condition to file? ;)

  19. Pete has a valid point and I agree with him. Moral support goes a long way and we should keep that in mind as well; it's a mental thing.... I believe the current forums that are here are sufficient. When I came to this sight initially and posted, I posted in the wrong forum and Berta answered my question and suggested that I move it to the proper forum so many other members would see it. My point is, it should be kept as simple as possible. I refer many retiring and separating Soldiers to this site. Out of the "newbies" that I have referred (at least 20 or more), they all said that the site had good info but a "lot of different areas" to search. Just my opinion. Respectfully,....me. B)

  21. When I retired from the military, I turned in all my claims at once with the VA (via the DAV). I had over 30 active current conditions that I claimed. of that number, at least half of them came back within 6 months SC granted, and the others were "deferred" for c&p. Out of those that were "deferred", at least 4 of them have come back SC granted and the rest were "denied". Of course, the denials are being appealed.
  22. I agree with Teac. I have submitted several "new claims" while awaiting a DRO review. The key for me is that I mail everything certified to the VA, so even if they "get confused", I can help to "unconfused them", even if it's at the BVA or CAVC level, just my opinion. B)
  23. Phred, Welcome to HADIT and thank you and your spouse for your service to the nation. First, I would say that you have been given some great advice thus far. Second, it appears to me that you (or your wife) did not keep copies of the complete claim for increase, or the initial claim submitted to the VARO. B) Just remember to keep everything you send to the VA; all documents, and send it certified mail or with some form of tracking to know that they received it. Good luck to you.
