Got My Denial Letter...

Gee it only took them 9 months. They just make my head steam!!! I just can't beleive I was denied after all the crap I have gone through. They never even wrote all the medical conditions I wrote in the original application. They also wrote that I could do things frequently that I can't. I have no idea where they got that from. They just must have had their head up their ..... well you know where when they wrote the decision letter.

Ok. Now I want to appeal, because they really do have stupid errors, leaving out medical info and infor that I wrote. How do I go about doing this. Can I write them a letter telling them what they forgot and resending them the medical info that they have seemed to overlook. Can I resend them more medical info? I really didn't want to get an atorney this time if they were just relooking at everything then making another decision. Then if they said no, I could appeal with an attorney. I should be hearing anyday about my VA TDIU (unofficially awarded IU,as per VA rep). So, I am trying to wait to get my award letter so I can foward that to them showing I got total disability. any input would help, thanks.

Tamara,

I would certainly go to a lawyer and have them ask for the reconsideration, as it will save you time versus an appeal.

My niece has never had the surgery. In fact she is the same age of 39 years as yourself.

I would gather up all of my medical information and go straight to the lawyers.

This is very unfair.

I saw your pictures and I was pretty sure that it was you.

Her life has been a piece of cake compared to yours.

I know that you have bouts of dizziness, just as she does and the headaches.

I would urge you, being that it took my daughter 5 years, to seek to advice of an attorney.

So sorry but I usually just ask for new posts and click on them. I am sort of quasi attention deficit so I rarely pay attention to which forum is posted in. I really think that you will prevail with Socil Security since you are not working and they have no legitimate reason to deny.

I will think good thoughts and wish for the best.

Appeal Forms to File and Where to File Them

Although Social Security is a national program, every State has its own rules for the processing of Social Security disability claims. In some States, the appeal form used after an initial denial is called a Request for Reconsideration. In other States, there is no reconsideration and your next step is a Request for Hearing.

I can empathize and sympathize. And believe the fact that I can spell both of those words would be a denial from SSDI. I too submitted my evidence from the VA and the fact that I am 80 and TDIU. Actually I'm 80% because I didn't push any further last year when they agreed to give me the TDIU, as I was in dire need of financial help. I also gave up my right to home assistance through Vocational Rehabilitation after they turned me down, as my counselor there told me it would speed up my claim for TDIU. Now when I call them back for living assistance I'm told, we have no record of your application you have to reapply to be reconsidered.

And they wonder why people have anxiety issues, and problems with the government.

I'm going to an attorney this week, as they disregarded everything I sent them paperwork wise for my original claim. I like you, they took two report out of about 20 I submitted to deny me. Everything they stated in my denial was crazy as hell, and showed that they never looked at the other info, or just chose to overrule it in lieu of some piece of shit info. So with that, I would like to fight it on my own, as it would serve me some justice on the gov't, but then again they would tell me that I was wise enough to fight them and support my own case so therefore........................................... DENIED. I can't handle the stress. And to think that they believe I can be a manager. Even after Voc Rehab (VA) turned me down, and I've lost out on several Federal Jobs within the last 3 years after they checked my disabilities after the 2nd interview. Yeah right. So mush for the ADA act.

80% SC/100% TDIU

70%PTSD All the rest is Back problems.

My denial was from SSDI, not VA. I should be getting my VA "award" letter anyday now. That is on pending auth. now.

Sorry. I must have been not clear on that. I thought you figured that because I was in that section.

Was wondering you filled for ssd prior to receiving your "should be award letter " from the VA ? Seems to me you would file upon receiving an award of 100% from the VA, not before. Think I may have missed something here, on why you have filled for ssd ? Was there another reason for you ssd filing? sorry about the ?s

Mike filing one has nothing to do with the other. If a veteran is disabled and not working then they should file for SSDI asap. If you waited on VA you could lose thousands in SSDI payments. Same the other way around.

      Frost v. Shulkin (2017)

This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
