When it comes to the Federal System of hiring Vets ( even 10 point preference ), it is the biggest con game and slap in your face system on the planet. I have been on the applicant side so many times, wrote my congressman, etc.

We may have preference and are covered by the law, the problem is not a sole is checking on if a VET was passed over for a job. Another is that the agencies won't tell you who they hired. If you feel that preference was not applied, the only recourse is to file a complaint with the labor department ( one person per region that handles ). But how are we supposed to obtain the facts?

The good ole boy system never dies. The managers will " hook up" someone else because someone " hooked " him up.The only ways I see fixing this is full exposure of all hiring and make it a Federal Felony for not obeying hiring laws that pertains to VETS.

All that OPM, USAJOBS, ETC. is Bull

PS- Go into USAJOBS, click on the 10 point vet preference tab. They want to make us feel special. How? By providing a " search engine " for jobs. Wippie Doo

In the Federal Sector Veterans are covered by the following.

VEOA under 5 U.S.C. 3330

USERRA under 38 U.S.C. 4324

If you think you were passed over for a job that you were qualified for then you file a complaint with DOL, if DOL cant resolve this then you will be notified , then you would take your claim and appeal this to the MSPB.

If you are passed over for a Federal job that you are qualified for , the agency MUST get approval from DOL to do this.

Vet's have rights, and good protections in place but you must know what they are and how to proceed, and that is the complicated system we live in......Its not a matter of whether you were harmed as it is , do you know how to fight for your rights.

Do yourself a favor.....buy some gold and silver! The printing presses are in overdrive.

I think that Vets preference is a scam and gives false hope to Veterans and Spouses that qualify. Taking a look at VAMC in Dallas the best way is to take any job that will get you into the system and than apply for openings. That is your real competition and I have senn with my own eyes Veterans go to VAMC and work at low ranked jobs and than apply for openings that they are qualified for and move up.

Something is very weird cause most of the hiring now is for temporary workers who do have benefits but only work 4 hours at a time.

The whole system needs looking at and a redo.

By State Law Texas is supposed to fill half of new jobs with Veterans but they don't do it.

Veterans deserve real choice for their health care.

The VA is the easiest place to get a job if you are a disabled vet. Like Pete says you will have to start at the bottom probably as a part timer. That is what I did about 25 years ago before I transferred to the Post Office. I never could get a decent job at the VA ,and although I had a degree I never got out of the lowest level job, so I went for a job at the Post Office where I took a test and was hired. If you have a severe disability you won't get hired at the Post Office. In some sense the Feds have to hire a certain number of vets, but they do not have to keep you. At the USPS they will hire a vet with a disability and then start trying to fire him so they can replace him with someone's girlfriend.

Very true, I saw alot at the PO, I was lucky to get that job, but it was a constant fight to keep it, but it taught me alot about the Federal system. sure glad I am out of there now.

First off, I don't want to sound like the typical " Angry Vet ". Its just that this topic is very very sensitive to me. Again, the system of "Preference" is merely " Preference, prefer", Not " MANDATE. True, back in the old days, kids join the military out of high school and expect to work for the government when they get out. It was almost an expectation to get hired.

The problem now is that we have so many " Reserves and Guard " folks with professional careers already that are disabled and have experiences that place them directly for that key position, and not from the bottom up. The tools they have now ( key words, websites, etc. ) are too convaluted. What ever happened to a " Veterans" contact for employment for each agency??

Three years ago, I applied for a director job for the VA as a 10 point preference. I was found ( it was the same job that I was doing in the Civilian world ) qualified by the board and given a certificate.

I got the run around everytime I contacted them in regards to the status. My senses were telling me that the hiring manager did not expect someone of my qualifications and preference to be calling. I called the head of employment at the VFW in DC for help. He agreed to looked into it.

He said-

" Good News, you were number 8 out of 200 some that applied."

"Bad News, they were not a chance in hell you were going to get that job anyway, even before you applied." Sorry, have a nice day.

That job by the way, pays $120,000 per year.

I never even got a letter explaining why I got shot down, and by law, as a Certificated Disabled Veteran.

This government Agency was .... The VA. LOL

True Story.

I will never know, nor will they tell me, who the other 7 were that beat me to compare. Therefore, I can't even know what to complain about.

Its very hard to think possitive when the system is broken. I have filled out hundreds of jobs with the FEDS with not even an interview, even for simple driving or clerical jobs. I have more luck in the private sector.

Regardless, I move on.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
