I Took The Offer

Question

VSO called within the last 2 hrs and DRO offered 100% IU PT Chapter 35 no future exams if I would drop all of my other claims. Thought about it, talked about it to my good friend Larryj, and to my daughter, and I settled for it today.

If not I was looking forward to 6+ new C&P exams...realizing 1 claim went back to 04, another 05, 2 more 07, and BVA remanded one , and knowing how dirty they have treated me, I asked the eight ball and rolled the dice and got "outlook looks favorable" so I decided I didn't want to risk them taking away what I already had, and took the 100% PT.

I am having second thoughts, but one never knows...it has been consuming me and engulfing me in its grip for all these years...and as we all know with them denying me/declaring me deceased/severing me/low balling me/remanding me...My great advisors said "Follow the yellow brick road to the bank now!"

So I just called my VSO and told him ok as the VA would not use my older TDIU claim dates as they said I was not meeting the criteria for these using those dates but did meet the criteria as of Nov last yr.

So within the last 4 1/2 weeks I went from 50% to 60% to 70% to 100%...

Come on fellow friends tell me you would have accepted this offer.

I am such a "RIGHT" person, and a strong one I was willing to battle on, but the system is not a fair one and they could last longer and hold out longer then I could live, so I accepted the offer also suggested by my VSO.

Why don't I feel great about it now though??

Wings,broncovet,Cruinthe,James Breckenridge,Just PLS,babyray,johnjjr,East, and hedgey, WOW the response to this post, but more the words of hope and encouragement are the essence of true feelings, caring, and sharing. Wild isn't it how the people you work with on your claims really know nothing about you(VSO's) and yet here with our private,secluded, space we get such an outporing of support and honest opinions/suggestions/empathy/compassion from others we really know little about except one's pllight to have justice. Justice is everything to me. Getting your true justice. Guess my "obsession" with my claim/claims has possibly overruled my objectivity. The ultimate goal or capturing the golden ring has been placed at my feet, and yet I want to be acknowledged with some sort of validation from someone at the varo level, "yes we screwed with your claims and are SORRY, but go on take the money and run!! Never happen. At my age it is hard to teach an old dog new tricks...I need to live in the here and now, all the what if's won't buy me anything but grief. So it is with open arms I respect and I do VALUE each and everyone on this site and thank everyone for the support and genuiness, and learn to practice the serentity prayer...wisdom to know the difference. I think the claims process has the potential to take over as an obsession, and not fighting would feel odd for some.

I have been doing a semi side line position in helping a few other vets with their claims, guess now I will spend all of my "free time" seeing whatelse needs to be done with their claims. Also will check in here too and give my 2 cents worth. Obessions can be good or bad, but this was obviously a good one.

Halos , that is so good.....I have been looking for my eight ball and cannot find it. I can't believe you have one for all those years and that it still works. I would not ever look back. You said it that your not getting any younger and the VA can fight you forever if they want to. I am so glad to hear of another victory here at Hadit, it is sweet for all of us as we that are still in the fight have encouragement with each victory as yours. Please go out an eat a big juicy ribeye steak for me , even if I can't . You worked so hard and put up with alot of VA nonsense. CONGRATS......but remember NEVER GIVE UP. C.C.

CC you can eat a ribeye if you really want to cook it put it in a blender and turn it on and put it into a form you can eat it may not look like a steak but I pormise you if you don't put anything other than the steak in the blender then what comes out will TASTE like the rib eye does it may not look like it but it WILL taste like it rofl I don't have any teeth unless I put my dentures in and I have been gumming ribeyes for years without using the blender method just cut the steak into pieces small enough that your gums can crush it and don't cook it until it's well done and as tough as a tennis shoe

I make all major decision according to the Eight Ball. For any answer you get from the Eight Ball you can build a good case for action, inaction or come back later.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
