What's Wrong With 800# People...threats?

I called the 800# again today. I have a legitimate reason for doing so. I have been trying to find out a simple question. All I want to know is if in fact my response to the VA's 10/27 request for addition info and medical records have been received. Nobody can tell me.

Yes, I do call often. IRIS is useless. All they have told me is they will forward my request to Atlanta RO. They did that on 12/8. Today is the 23rd and I haven't heard a word back.

So I fired of an Update to my IRIS asking them "Do you plan on responding to my question or not?'

Well, the guy on the 800# said that he sees where I responded to the IRIS with a smart remark. I said I did because I can never get a reply to my question or a straight answer from anyone. I told him I need to know if the "IMPORTANT" medical evidence I submitted that included a diagnosis and NEXUS was received and in my file.

He go really rude with me and told me that he was going to flag my file so that if I called again whoever answered my call would know not give me any information that I asked for. He also told me that by flagging my file it would delay my claim for several more months.

Can they do that?

I have this on good authority.

Not to shed a bad light on a single station, but the delay issue may with the RO.

If you have a POA at the RO, they can see if the material was received.

Do you have a service officer? You never get the same person twice on the 800 line so keep calling, but be low key and very polite. The person you talked to is a worm. They sadistically enjoy making vets suffer. They are everywhere, but don't give them power. I would say to contact your congressman but that might slow things down even more while they investigate (they will take the VA's word). Maybe the IG's office can help, but you must keep your cool. If you show anger that will just reinforce what this jerk said about you.

Can they do that?

These folks are in the drivers seat. You have absolutely no recourse as they answer to no one.

Send all documentation certified return receipt and get a VSO hand carry a copy.

Under no circumstances are you to alienate these people. This can cost you precious time. These folks play dirty and there is nothing you or anyone can do but wait.

What you can do is make a trip to the RO to see the folder yourself to verify it is in there.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
