Id Love Your Opinion On My 70% Ptsd

Hello all,

I just heard of this website and I must say it is full of info and I thank everyone for that.

I'm currently receiving 70percent for ptsd. I initally received a rating of 30 till I requested another exam. The new doctor was much more ccaring than my initial one (he was texting on his blackberry most of the time). I received a letter outta nowhere in sept 2011 stating since I'm at 70 I can request 100. I initially didn't want to fight the va again bc of the frustrating process. That was until recently when I could no longer goto school bc of the thoughts that the professor n students were against me somehow. I don't want to list everything that's going on in my head on here like some people bc I don't like bringing up my experiences unless I have to. Needless to say I dropped out of school and can't work. I stay in my room all day with my mind going a million miles a minute. I don't sleep (yes I have meds for that but I don't wanna b a walking Zombie). Last night I woke up in the middle of the night to answer natures call and next thing I know I passed out in my kitchen on my way to my room. I woke up several minutes later w my dog hovering over me. To say the least I was petrified. I went to the va hospt n was found to have extremely high blood pressure. I know this is from my ptsd n being stressed from just dropping out of college.

My question is I sent all the info for a board review on oct7 2011 for 100%. I haven't received a letter stating they received it although I did send it certified so I have proof someone at the office received it just in case. I was wondering will I have to go to another c & p since this will be my 3rd n everytime I have to tell the stories of horror I was involved w during my two tours as a infantry grunt. Or will they realize I am totally disabled especially after my last c n p exam stated I was pretty much messed up without another exam? Thank you everyone in advance

Welcome.

Not enough time has passed for any action to have happened yet, to include the VBA mailing you a computer generated letter

stating they have received your info there, is a huge backlog, they are short on manpower and they are working on something.

Being that you are ALREADY SC'd for mental health, there should be NO NEED to continue discussing your stressor/s from active duty.

At this point, in regards to your request for an increase in percentage evaluation,for mental health disability or

IU (due solely to SC'd disability) what will be factored into adjudication of these issues is how they effect your life now in relationship

to Occupational and Social functioning.

Other's will chime in.

If the VARO didnt send you the TDIU form we have it here-=to the right of the forums under Forms. It is VA form 21-8940.

On Question 18 check Yes and then apply for SSA disability benefits.

Under Remarks # 25 refer them to separate page (put your name, address and C file number on every thing you send them)

and tell them of the problems you had with your education.

If this was through VA Voc Rehab and the Voc Rehab counselor has documented that your SC disability has interfered with or hindered your ability to maintain Voc Rehab-this is Excellent evidence for TDIU at the 100% comp rate.

If one is un vocrehabable , they are unemployable.

Get proof of mailing anything you send because they lose stuff.

I always send stuff to them by Priority mail with a USPS tracking slip.

I track my stuff on the USPS site until I see the RO has received it and then I print this out as proof of receipt if I need it.

They are counting on us not to file more claims and to give up.

My daughter insisted I reopen my claim in 2003.

It was a doozy and I knew they would fight me hard-

but I fight better than they do and 6 years later I was awarded that claim and then battled almost a year for the $$$$$

that they tried to tell me was not due me.

I got every penny. I see you are a NYer too-

I deal with the Buffalo RO.

They have federal employees there who are illiterate.

If the VA knew you were unemployable due to PTSD when they granted you 70% they should have inferred TDIU. When did they grant the 70%? Unless they specifically denied TDIU I don't see why you need to go to the BVA or some Board you are talking about. You just have to fill out the paperwork for TDIU form 21-8940 and send it to the VBA. I know I don't have the whole picture.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
