Nov 1, 2010 filed for VA SC for PTSD

Jul 1, 2011 Award VA SC 80% for PTSD (Approx. 9 months)

Sep 15, 2011 Applied for Social Security Disability Insurance (SSDI) for PTSD or anxiety according to SSA

Sep 15, 2011 Retained Harris Federal Law Firm for Federal Disability Retirement (FDR) from USPS

Jan 3, 2012 FDR submitted to OPM for approval

Jan 31, 2012 FDR case number assigned (CSA #) (Approx. 4.5 Months)

Feb 4, 2012 Awarded SSDI (Approx. 5 months)

Mar 26, 2012 OPM assigns case worker for FDR (Less than a month)

Apr 12, 2012 OPM approves FDR (2 weeks)

Apr 16, 2012 Separate from Federal Service @ USPS

Apr 18, 2012 Receive SSDI payments (Approx. 2 months)

MPsgt - no offense meant but you need to correct the 80% PTSD rating. PTSD is rated 10%, 30%, 50%, 70% or 100%. There is no 80% rating for PTSD. To get an 80% award you must have some other SC disability, combined, to get the 80% award. Just sayin' . . .

Philip Rogers, no offense taken. Yes, you are correct. I have a combined SC rating at 80%. The PTSD rating makes up 70% of the combined rating. I'm always learning new things regarding this rating. I wouldn't even have sought SC if my wife hadn't been my biggest advocate. Our marriage at the time was in the toilet, my anger was uncontrollable, and much more. I do well to even share my experiences on this site. I'm only looking to help those who suffer. My faith in the Federal Government is nil.

So you have TDIU, SSDI and OPM now? When you reach age 62 the SSDI offset to your OPM goes away. So in the end you will have you TSP, OPM, TDIU, and SSDI. I think it you handle this right you will be OK.

John999, The only thing that is uncertain is the TDIU. I had to appeal with an NOD. My local VAMC still has this claim. The VAMC made a decision on TDIU before I was approved for SSDI & Federal Disability Retirement. I also submitted a letter from my VA doctor staying unemployability. It's just a waiting game now. My family & I have been blessed through this whole process.

You have very good proof for TDIU since you have SSDI and OPM. You have definite date and awards from feds saying you are unemployable. Most don't have that kind of evidence. Also, you are not starving while you wait for TDIU since you have 80% VA.

john999, I agree 100% with you about TDIU. The most devastating thing about PTSD is not so much about me. There will always be treatment and camaraderie with fellow Veterans at the VAMC. It's my family that I believe suffer the same as me, if not more. I need TDIU to ensure the wife and kids are taken care medically too. They shouldn't suffer because their dad is "damaged goods." I fight with myself continuously to not say things to them about me leaving or wanting to disappear. I did this once when I thought my marriage was in the toilet. Yet, I just made it hard on my family. I will try to be optimistic about the future and the possibility of TDIU. Thanks for the encouragement!

In your experience with VA SC, OPM, & SSDI. How long has it taken recently for the VA to come to a decision on IU? This is my situation.

While employed by the Gov't

70% PTSD

10% Migraines

10% Tinnitus

Post employment Sep 2011

70% PTSD

10% Migraines

10% Tinnitus

Oct 2011 Requested increase to IU

Nov 2011 Denied increase to IU

Jan 2012 Filed NOD, w/SSDI Award, w/FDR approval, & a doctors statement "supporting" IU, waiting on appeal

Apr 2012 Received my initial SSDI payments

Apr 2012 Approved Federal Disability Retirement

Finally, could the VA find me TDIU P&T based on the evidence provided or will I have to fight tooth & nail for P&T too?

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
