The SSA dosen't care how many hours you can and cannot work and if you CAN only work marginal,part time, casual etc. you will be what the ssa calls able to do sedendary type work.BUT age, and vocational skills will play a part in deciding if you will indeed be eligible for benefits.If you are WORKING the ssa will require you to file for all and any other benefits programs and to exhaust those programs before they would even think about giving you benefits.(state disability etc.) Again the ssa is all or nothing. The ssa will fight you tooth and nail on this. Good Luck

What I still haven't seen answered was if you receive a VA disability pay and military retirement pay if this is subtracted from what the earnings statement states you would receive if elgibile. Or can you receive the full amount. I know when you apply for regular ss, you get the full amount, however I am not sure how this works with medical SS.

Yes you will get both with no offset............you will get the full amount.

Something you need to think about as you start your SSDI journey. SS and in particular SSDI are running deficits now........SSDI is in the red and is predicted to hit defcon in 3-4 years.

You do have a valid point about working and winning you claim........Yet, I say you are fighting a much bigger uphill battle due to the financial shape the SSDI fund is in while you are working regardless of what a vague rule in the SS code states.

I read a pretty good financial article last week dealing with the ballooning military retirement account or MRA........the 75% increase in the last 6 years alarmed him and he was piling into graphs trying to figure out why such an increase in such a short time.........I pointed out the CCR changed the graphs without explanation as the military can no longer pawn off the retirement on the VA due to CCR.........he was amazed that he had never heard of it until now, and explained alot of the sudden jump in the MRA.

Make no mistake.........there are changes coming to the system as the red float gets brighter. Those in control have screwed the system in many ways and things will have to be re-aligned to bring in a balance , if thats even possible at this point with the debacle we are in..........how they accomplish this is the big question.

Do yourself a favor.....buy some gold and silver! The printing presses are in overdrive.

I have been working less then 40 hours a week-keep getting sick, or just plain tired. If I am put on oxygen due to my breathing problems that should override any less favorable decision. My age is quite favorable(57), and the long list of disabilities are as well.

I know they will fight me, however I am up to the challenger. If one has the proper medical evidence to justify why you are filing a claim, that is one less hurdle. It is those that file who are just plain lazy, have no medical evidence or other excuses, those are the ones that should be denied. There are too many abusing the system. Getting the ssi and running to the casino and blowing it is what I see in my state.

They have a good system for weeding folks out, however it does have its flaws

You might want to download from one of the many sites dealing with ssa a form called RESIDUAL FUNCTIONAL CAPACITY FORM for all the disabilities you have and have your pcp fill out this form and submit this form with your application if you decide to apply. This form is VERY important. If you are disabled as you say you are, along with the medical evidence of record, and this form properly filled out you have a better chance to win the first go round if you were to stop working. I followed this format and i was approved without an attorney in 10 months.

In Florida they have a way of weeding out fakers. They deny everyone. Only the desparate persist to the end and hire lawyers and starve for years. I got mine because I had expert medical and legal advice.

I filed the claim today listing over 25 disabilities. And of course I have medical documentation for all of them. I wonder if that is enough or is the number too low?

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
