Translation Please......c&p Mumbo Jumbo!

Hey Hadit family. It's been a while since I last posted but I have a few questions regarding my C&P for an increase 50% (PTSD/MST). I know that Hadit.com forum is the best place to get straight, honest answers. Well I just got a copy of my C&P and I don't understand a couple of notes the C&P Dr. wrote in my record.

Everything that I mentioned below is pertaining to the increase of the PTSD and was either checked off or iooiwritten just as described.

1.GAF score of 45-50 mean?

2. What does Total Occupational and Social Impairment mean?

3. The claimed condition was at least as likely as not (50 percent or greater probability) incurred

in or caused by the claimed in -service, injury, event, or illness. Provide rationale in section C.

(section C) RATIONALE: It is least likely as not that the veteran is unemployable due to her PTSD. She has not been able to work since 2006. She is on a large amount of Quetiapine 300mg qhs, Bropropian SA 150mg po BID and 0.5mg of Clonazepam. She has significant psychiatric symptom due to her PTSD.

Can anyone tell me what this means regarding my increase? Does this look good? Does the Dr. Say that I am unemployable? I get lost when the Dr. Refers to least likely not. (What is this mumbo jumbo? II thank you all in advance!!! :)

45 to 50 gaf score is 70 to 100 percent rating

Total Occupational Or Social Impairment means you don't do well around people in a social or working environment.

At least as likely as not is the magic term used to kick the benefit of the doubt in on your claim in your favor as it weighs the evidence 50/50. This Doc said you are not employable.

They work like this: was not due to is 100 percent against. Less likely as not means 25 percent At least as likely as not is 50 percent

Most likely is 75 percent was due to means 100 percent sure.

It wont be too long but I see a success story real soon for you.

Sorry for not understanding the last part of your message.

It means you'll probably get an increase and could get TDIU but in the end decision is up to the rater, not the doctor. jmo

They are rules in the VA system that use the terms I have written that interpet these opinions. Yours is at least as likely as not means the doctor is 50 percent sure. It has nothing to do with the rating of 50 percent just the opinion. The opinion equals out so it is supposed to go in your favor.

I agree with PR. You should get 100 percent or IU but it is in the hands of the rater and they hold the cards.

A GAF score is dynamic and can change from hour to hour, day to day and month to month. According to the examiner at my husband's first PTSD C&P exam his GAF was 45. He was award 50%. We have an active claim for increase/IU.

There is no rhyme or reason to the different ratings one Vet receive over another having the exact same symptoms, even thou there are regulations that the raters are suppose to use to determine percentage. I have come to NOT get any hopes up for any persenage and awards so my hubby won't become angry and depressed. Saying that, what the C&P examiner did say about 'likely as not' is very good wording for an approval of some kind. At best, IU will be approved, at worst, you should keep your present rating of 50%. I pray you receive what you deserve and get 100%.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
