A Few Questions About Ptsd Claim

Rate this question

Question

Just a little background, Im 10% service connected for asthma. Ive been out of the Army for 10 years now. I sought couples therapy a few months ago for myself and my wife through the VA and the counselor was thinking most of my problems were attributed to PTSD. She referred me to the PTSD unit who I had an appointment with yesterday for a screening. Using the info the other counselor gave me and the questions she went through she told me I have PTSD and is going to talk with my other family counselor and call me back to make a treatment plan. So last night I went on the E-benefits site and submitted a new claim. So far I have pretty much told my story which is pretty traumatizing to 2 counselors and to the e-benefits website. Basically my question is will I have to go back to the same place and sit with someone else for the claim and do it all over again and go through the whole thing or do they just use what they have? Im assuming its also the same people who do the claims because its in the same building. Last time I think I waited about a year for processing of my claim, is it still around the same time? I will try to get some sort of copies and post them on here to see what other people think. Thanks for your help

Pat yourself on the back for seeking help. I know it's a hard thing to do. It shows that you value your health & your family. And there's nothing more important than those 2 things.

In some rare cases the rater can make a decision based on info already in the file. But in most cases, a C&P exam will be scheduled & you will need to retell your issues.

Depending on how busy your regional office is, a year sounds like a good ballpark average. But don't plan on any set timeframe.

Read up on the PTSD regulations for VA claims.

You will have to go for a C&P exam no doubt. Do it Bro because it will be worth it in the end. My good friend from Nam waited over 40 years to get help. He got a DX of PTSD, but in the meantime his life was reduced to ashes and he was 64 years old. PTSD and depression ruined his life. When I encouraged him to get help and file a claim he was living in backwoods of N. Carolina in real poverty with a sick wife. I really wish my wife would go to couples counseling. She has PTSD, but as is often the case refuses to acknowledge it.

thanks for the replies. The couples counseling has far exceeded my expectations in just a short time. The psychologist is trying to come up with a plan for the PTSD treatment because they are saying its very time consuming at least for 12 weeks.

one other question is about the new ebenefits site, seems like they put some effort into it and it looks better than when I filed before on vonapp i think it was called. Does anyone actually get an estimated time of completion on here or is this just wishful thinking. Also the site is painfully slow. I had to type my experiences in word and copy and paste due to it refreshing and clearing everything

Titan,

You will hear mixed reviews on eBenefits. Some have had experiences where the time line was way off. My experience was great. I put in a claim back in Sep for PTSD and tinnitus. It stayed in the "under review" phase for months. Finally in April I noticed it went to "gathering of evidence". I got my letterbthe same week for my C&P exam scheduled for May 16. At this time the estimated claim compketioj date was from mid July to early Sept. Well on May 28 my claim jumped up to "Pending decision approval". Totally bypassed two or three phases. The estimated completion date jumped up to late June to early Aug. Then suddenly yesterday, claim was completed and I was able to see my new rating when I downloaded my benefit summary letter. So you just never know. It seems lately (maybe because of political pressure) claims are moving quick. Good luck.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
