A Reduction In Rating

Rate this question

RUREADY

Question

I notice some people are getting a proposal to reduce rating...

just remember what it took to get the rating you got. Then you go to

Primary Care Doctor or another C&P for a new claim or increase claim

THEY WILL CHECK YOU FOR YOUR ALREADY service connected disabilities .

Example: you are rated 40% back 40 % radiculopathy of legs, your new claim is for

sleep apnea they ask you to bend and touch your toes and this is even at PC appointments

you bend and its 30 degrees or less to keep 40% you bend 50 degrees this will drop your rating.

Just keep this in mind what it took to get your rating and what it take to keep it. RU

Sad to say bud that you are right. As most of you know on here I was granted 100% VA Mar 14. Put in an FDC in Nov 14 to reopen a few previously denied, a few new and a few secondary. Well after that claim completed recently almost all conditions were granted. But what did the DAM*** VA to decide to re eval all of my high Conditions, even though they were not scheduled for a re eval until Feb 2016. Well those exams sucked especially the PTSD review, well in my case it back fired on the VA and in fact the 70% PTSD was continued and Migraines/TBI increased from 30 to 50%. Well last week got a call and then the VA decides to Re eval scars and tongue damage. Why would VA even want to look at these conditions. Well went yesterday and it was actually thru the VES and it was a dang Heart Specialists, WTH!!! Went there did all these chemicals on my tongue with no reaction, as most of the taste buds where damaged when I had 2 throat surgeries. Then Doc looked at all my Scars, and in fact I have 2 knee ones caused by a fall last year, so he took measurements and pics of those. Don't know what to think, but I am very aware when I go to VA and see Docs, and by the ways I have a ton of Specialists so it is a job in itself to watch what I say and do around those crappy people. Thanks again for putting this info out. Hope you have a good weekend.

Are you saying to mimic what happened the first exam, even if it is not true? Sounds fishy to me.

mimic what it took to get your rating?? or be smart to keep your rating

by not telling your doctor when he ask you how are doing today. I see

most veterans always reply. I'm doing good or I'm doing great today. Then

why the hell you going to see the doctor if you are doing great. They write this sh**

down in your records. I know because it happen to me. I was in the Empower

veterans program for pain every week we have to tell whether the program was working

or was it helping with pain. It did help me a lot with the acupuncture I am doing better than

I been in 8 years don't take no pain meds anymore. I wrote this down or we discuss it in class.

Everybody in the class all had back problems and most people cant sit for long and cant stand

for long with back problems the class is about 4 hours long with 10 minutes breaks every hour

here is the catch how can you sit for an hour and you file a claim saying you cant sit or stand but

15 minutes because it cause you back pain but if everyone sat there for an hour with no problems

do you have back pain or is it in your mind. They will use this against you. AT The end of class we were

told that a physical therapist who was teaching from Green bay on TV she could see us and we could see

her but she was watching us the whole class on web cam and nobody knew until the end. So what I was doing

is sit a while then stand a while and everybody thought I was crazy but that's my disabilities.

I ask for more treatment for acupuncture and they told me I was doing better and I just need treatment

once per month and that's what I told EMPOWER VETERANS in class. I explain my pain level went from a

10 to a 5 from treatments twice per week not once per month. long story be careful what you say or do

never know who's looking or listening. I will do what it take to keep my rating because VA plays dirty

Some SC Conditions may improve or worsen with time, that's a given. Vets by virtue of their "HONORABLE" military service, irregardless of their being Drafted or Enlisting, are eligible for Tax Free "SC Disability Compensation." Maintaining a SC % by exaggeration or false statement would be committing a Fraud (LIE) and that's kinda against the rules, big time.

Think about your civilian neighbor collecting Workers Comp for a bad back and you see him carrying shingles up a ladder to re-roof his house. He's getting over on the system, but is he an Honorable Man?

How would a VA Clinician's note, indicating they think a Vet is exaggerating their symptoms, look in a Vets MRs or on a C & P? VA PTSD C & P Clinicians are trained to do a forensic type exam, looking for over exaggeration and falsehoods.

A Vet must remember that everything the Vet says to a VA Clinician, can and will be used for or against them. Better not to exaggerate one way or another. I've personally found and had to put in a correction statement to my VA MR's where a Nurse completed a form erroneously. Had I not checked My Healthy Vet account, an erroneous intake note would have gone unchallenged.

If I could not sit or stand more than 10/15 minutes at a time I would not have took a 4 hour class with 10 minute breaks every hour!

I am surprised the VA did this to reduce a veterans disability! & surprised at the veterans with Back problems/disability took the class!

I have had turn down opportunities because of my disability's & left out of the happiness I can't have with my grand children, things like hold them and understand them play games ect,,ect,, because (hearing impaired), other disability's as well & not getting to have fun with your grandchildren is very hard for most veterans.

Even tho pain meds helps with the physical pain nothing can bring back the love and fun your missing out with your grandkids & loved ones!

go to a park and watch the daddy or the grand paw's having fun with there kiddo's and you can't because of your disability.

I consider my self lucky compared to most veterans with worse disability's than me & my children and grand children understands. but even so a crippling disability is what it is!

I would gladly give up my compensation to be able to work and enjoy the love of my family.

I am glad to get what the VA gives me for without it I/d just be living on SSD...and not have most of the things I got because of my VA compensation.

AS for as talking with your VA-PCP or C&P Examiner its Always best to be honest & friendly.

the truth always prevails.

However what some of the things PUREADY mention I agree but still that is up to the veteran how they want to greet the Doc.

to say things like ''I'm doing good doc & you'' is just a general way to greet someone, rather or not your not doing good is Irrelevant.

You go to see the Doc to get your pain meds and make sure your not having other problems that your Doc needs to know about.,,,period.

The only thing with my experience is Some not all but some of the VA Doc do write up things in their reports that was not said, Now how a veteran can prove that is yet to be determined.

I Also Add this , I realize some veterans are just paranoid .& a cute pain/fatigue makes us think crazy things at times.

All in all All of us veterans are in this together as fellow Brothers & We all should be thankful we are here and getting what the VA gives us, at least were above ground.
